    <title>Digital Markets and India: Demystifying the Draft DCB</title>

        &lt;b&gt;This document summarises the proceedings of the Roundtable on the draft Digital Competition Bill (DCB) [hereinafter referred to as ‘the Roundtable’]. The Roundtable was conducted online on April 1, 2024, and included representation from academia, law, civil society, and policy organisations. The primary objective of the Roundtable was to discuss the recent report published by the Committee on Digital Competition Law (CDCL) in March 2024 along with the draft of the DCB. &lt;/b&gt;
        
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The event was organized by Abhineet Nayyar and Isha Suri.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The Roundtable began with a brief presentation by Abhineet Nayyar (Centre for Internet and Society - CIS) providing an overview of the various important themes identified by CIS during the course of their research. This introduction was followed by Roundtable discussions moderated by Isha Suri (CIS), focusing on important areas identified by CIS for the course of this discussion.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;This summary seeks to crystallise the learnings that emanated from this Roundtable to inform the discourse and contribute to the ongoing public consultation for the draft DCB, due by April 15, 2024.&lt;/p&gt;
&lt;h2&gt;&lt;strong&gt;I. &lt;em&gt;Ex-ante &lt;/em&gt;or &lt;em&gt;ex-post&lt;/em&gt;&lt;/strong&gt;&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;The initial parts of the discussion focused on the shift from a largely ex-post model to an ex-ante model to competition regulation in India. It was briefly summarised during the discussion that while the extant Competition Act of 2002 relied on &lt;em&gt;ex-post&lt;/em&gt; methods to recognise anti-competitive practices, the proposed DCB adopts an &lt;em&gt;ex-ante&lt;/em&gt; approach similar to what has been adopted or is being deliberated in other jurisdictions. Few participants highlighted the benefits and costs of switching from the former to the latter and highlighted specific learnings for digital markets in India, while some were sceptical of this shift towards an &lt;em&gt;ex-ante&lt;/em&gt; model, given its potentially detrimental impact on MSMEs and lack of enforcement capacity in India.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The discussion began with the participants highlighting the gaps in the extant &lt;em&gt;ex-post&lt;/em&gt; regulatory framework, including delayed enforcement and disposal of appeals, and its under-reliance on private enforcement techniques that increase the ecosystem’s dependence on CCI as a central node. Simultaneously, however, several participants also warned against potential issues in the &lt;em&gt;ex-ante&lt;/em&gt; approach proposed under the draft DCB. While some of these concerns related to the general ineffectiveness of &lt;em&gt;ex-ante &lt;/em&gt;regulations – as highlighted, for example, in data protection and broadcasting – many participants deliberated on specific sections of the draft DCB.&amp;nbsp; It was also pointed out that telecom regulation does have ex-ante provisions to address competition concerns within the sector. One participant, for instance, highlighted the proposed bill’s wide scope and the risk it poses for an under-resourced regulatory regime.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Overall, the group emphasised the need to carefully consider the particulars of the &lt;em&gt;ex-ante &lt;/em&gt;approach proposed under the draft DCB. While there was a broader consensus that this approach may address some issues with digital markets particularly, the discussion brought to the fore many concerns with how this approach is currently being articulated. In addition to the bill’s wide scope, the Roundtable also discussed the necessity for an impact assessment study to understand its effects better. Other concerns regarding the proposed threshold values and the draft DCB’s focus on ‘contestable’ markets were also tabled during the discussion.&lt;/p&gt;
&lt;h2&gt;&lt;strong&gt;II. Building Regulatory Capacity&lt;/strong&gt;&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;The participants discussed existing regulatory capacity in light of the proposed &lt;em&gt;ex-ante&lt;/em&gt; approach under the draft DCB. Several participants highlighted factors that currently inhibit CCI’s capacity, the foremost of them being the Commission’s reliance on enforcement by bureaucrats with time-bound deputations affecting continuity and sustained capacity. In the absence of professional capacity, particularly in digital markets, the wide scope proposed by the draft DCB is only likely to further test CCI’s ability to deliver on its mandate. Moreover, in discussing how to build CCI’s professional capacity, a participant also highlighted the risk of regulatory capture by the private sector if one were to follow a ‘revolving door’ approach.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Participants then delved into potential solutions for CCI’s constrained capacity. In addition to staffing the Commission with subject matter experts, a participant also stated that given the political economy, it may be prudent to design the regulatory ecosystem to work around the problem of legacy issues of lack of professional capacity and independence. The participants also briefly discussed the role of impact assessment in resolving this problem, specifically by including the effect of the draft DCB on CCI’s already strained capacity.&lt;/p&gt;
&lt;h2&gt;&lt;strong&gt;III. Proposed Threshold Values&lt;/strong&gt;&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Deliberations began with the rationale for the Threshold Values (TVs) proposed by the draft DCB. Several participants shared their reservations about the bill’s reliance on international standards, especially for metrics such as market capitalisation and global turnover. Some also identified certain areas where the proposed bill seeks to identify TVs that are more relevant to the Indian market. For example, a participant highlighted that the draft DCB, in Section 3(4) chooses to identify and calculate business users and end users for each of the core digital services separately.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;In addition to discussing the rationale behind TVs, many participants also suggested avenues for potential improvement. For instance, one of the participants recommended the identification of threshold values for each of the core digital services, as opposed to the current service-agnostic thresholds. It was posited that the expedited timeline of three months may have constrained the committee from recommending nuanced thresholds suited for Indian contexts since that would require market studies or commissioned (independent) research for evidence gathering and analysis.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Some participants were optimistic that the currently open consultation process may leave room for further negotiation on the prescribed TVs. This includes, among other things, identifying more representative calculation methods for arriving at appropriate values and incorporating global best practices.&lt;/p&gt;
&lt;h2&gt;&lt;strong&gt;IV. Remedies and Penalties&lt;/strong&gt;&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;The participants sought to ascertain the effectiveness of penalties in the form of fines as a tool for deterring abusive conduct by dominant entities in general, and digital behemoths, more specifically. On one hand, some participants highlighted the lack of evidence to support the assumption that currently imposed fines deter such abuse in the market. For instance, one of the participants referred to a recent incident where the Dutch competition regulator imposed a €5 million fine for every week Apple failed to comply with an antitrust decision by the regulator. In the end, Apple had accumulated fines worth €50 million, instead of allowing dating app providers to use alternative modes of payment, ostensibly indicating how companies perceive penalties as yet another operating cost.&lt;a href="#_ftn1"&gt;&lt;sup&gt;&lt;sup&gt;[1]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;On the other hand, a few participants also underlined the need to look at ‘penalties’ as a part of a larger toolkit and not as a standalone deterrent. In this context, the draft DCB’s focus on settlements and commitments, and criminal penalisation were also highlighted by some attendees; while others pointed out the need for an institutional redesign – for example, by reviewing the current appellate process, or by potentially reintroducing the Competition Appellate Tribunal (COMPAT).&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Additionally, the question of penalties led to a discussion on the calculation of the quantum of fines and the process followed therein. Stressing the need for more elaborate penalisation guidelines, one participant questioned CDCL’s choice of capping penalties at 10% of the enterprise’s global turnover, especially for industries that have comparatively higher profit margins. It was also pointed out that there is no empirical evidence suggesting the efficacy of the 10% cap, as a sufficient amount.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The discussion also briefly delved into the issue of structural remedies as a tool for correcting harms in digital markets, given the presence of strong network effects and winner-take-all outcomes. Even though there was not a deep dive into the issue of structural remedies, per se, a participant indicated that certain obligations under the DCB, such as the one on tying and bundling comprise a form of structural reform.&lt;/p&gt;
&lt;h2&gt;&lt;strong&gt;V. Digital Mergers and Acquisitions&lt;/strong&gt;&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Unlike the Competition Act 2002, the draft DCB explicitly excludes combination review from its scope, instead relying on the 2023 amendment to the Act. It was pointed out during the discussion that recent amendments in the merger review process such as the inclusion of deal value thresholds should check anticompetitive mergers. However, as highlighted by a few participants during the Roundtable – even though the amendment would potentially enable CCI to investigate digital M&amp;amp;As, the Commission would still have to rely on theories of harm established under the extant Act, which largely examines price-based effects of mergers. For instance, one participant highlighted the role of price-based assessments informing CCI’s working in many merger review cases and pointed out the limitations of these assessments in examining combinations in the digital market.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;On the other hand, many obligations identified and elaborated under the proposed DCB are, in fact, better suited to support CCI’s regulation of such digital M&amp;amp;As. Another participant pointed out that while sections 3 and 4 of the extant Act can still, theoretically, allow CCI to borrow from the draft bill, the proposed regulatory landscape does not ensure this synergy between the two pieces of legislation.&lt;/p&gt;
&lt;h2&gt;&lt;strong&gt;VI. Gaps in the Consultation Process&lt;/strong&gt;&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Finally, the discussion highlighted the consultation process adopted by the CDCL during the drafting of this bill. While there was a general agreement that the process was not very representative, different participants brought up diverse perspectives. One participant, for instance, underlined the importance of including MSMEs in the drafting process, given their deep reliance on digital tools and technologies. Other attendees also echoed this viewpoint, highlighting that although the CDCL incorporated inputs from BigTech companies and industry associations, the perspectives of consumers, technology experts, and platform workers were missing from the list of stakeholders consulted during the process.&lt;/p&gt;
&lt;p&gt;There was cautious optimism in the room that subsequent drafts of the Bill might address some of these concerns by including a diverse set of stakeholders and incorporating a bottom-up consultative process.&lt;/p&gt;

    <title>Deployment of Digital Health Policies and Technologies: During Covid-19</title>

        &lt;b&gt;In the last twenty years or so, the Indian government has adopted several digital mechanisms to deliver services to its citizens. &lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Digitisation of public services in India began with taxation, land record keeping, and passport details recording, but it was soon extended to cover most governmental services - with the latest being public health. The digitisation of healthcare system in India had begun prior to the pandemic. However, given the push digital health has received in recent years especially with an increase in the intensity of activity during the pandemic, we thought it is important to undertake a comprehensive study of India's digital health policies and implementation. The project report comprises a desk-based research review of the existing literature on digital health technologies in India and interviews with on-field healthcare professionals who are responsible for implementing technologies on the ground.&lt;/p&gt;

    <title>Nothing to Kid About – Children's Data Under the New Data Protection Bill</title>

However, each time they access the internet, data about them and their choices are inadvertently recorded by companies and unknown third parties. The growth of EdTech apps in India has led to growing concerns regarding children's data privacy. This has led to the creation of a &lt;a class="_1lsz7 _3Bkfb" href="https://economictimes.indiatimes.com/tech/startups/edtech-firms-work-to-get-communication-right-with-the-asci/articleshow/89082308.cms" rel="noopener noreferrer" target="_blank"&gt;self-regulatory&lt;/a&gt; body, the Indian EdTech Consortium. More recently, the &lt;a class="_1lsz7 _3Bkfb" href="https://economictimes.indiatimes.com/tech/startups/edtech-firms-work-to-get-communication-right-with-the-asci/articleshow/89082308.cms" rel="noopener noreferrer" target="_blank"&gt;Advertising Standard Council of India&lt;/a&gt;&lt;span class="_3zM-5"&gt; has &lt;/span&gt;also started looking at passing a draft regulation to keep a check on EdTech advertisements.&lt;/p&gt;
&lt;p class="public-DraftStyleDefault-text-ltr fixed-tab-size public-DraftStyleDefault-block-depth0 iWv3d b+iTF _78FBa _1FoOD iWv3d _1j-51 mm8Nw" style="text-align: justify; "&gt;The Joint Parliamentary Committee (JPC), tasked with drafting and revising the Data Protection Bill, had to consider the number of changes that had happened after the release of the 2019 version of the Bill. While the most significant change was the removal of the term “personal data” from the title of the Bill, in a move to create a comprehensive Data Protection Bill that includes both personal and non personal data. Certain other provisions of the Bill also featured additions and removals. The JPC, in its revised version of the Bill has removed an entire class of &lt;a class="_1lsz7 _3Bkfb" href="https://prsindia.org/billtrack/the-personal-data-protection-bill-2019#:~:text=Obligations%20of%20data%20fiduciary%3A%20A,specific%2C%20clear%20and%20lawful%20purpose" rel="noopener noreferrer" target="_blank"&gt;data fiduciaries&lt;/a&gt; – guardian data fiduciary – which was tasked with greater responsibility for managing children's data. While the JPC justified the removal of the guardian data fiduciary stating that consent from the guardian of the child is enough to meet the end for which personal data of children are processed by the data fiduciary. While thought has been given to looking at how consent is given by the guardian on behalf of the child, there was no change in the age of children in the Bill. Keeping the age of consent under the Bill as the same as the age of majority to enter into a contract under the 1872 Indian Contract Act – 18 years – reveals the disconnect the law has with the ground reality of how children interact with the internet.&lt;/p&gt;
&lt;p class="public-DraftStyleDefault-text-ltr fixed-tab-size public-DraftStyleDefault-block-depth0 iWv3d b+iTF _78FBa _1FoOD iWv3d _1j-51 mm8Nw" style="text-align: justify; "&gt;In the current state of affairs where Indian children are navigating the digital world on their own there is a need to look deeply at the processing of children’s data as well as ways to ensure that children have information about consent and informational privacy. By placing the onus of granting consent on parents, the PDP Bill fails to look at how consent works in a privacy policy–based consent model and how this, in turn, harms children in the long run.&lt;/p&gt;
&lt;h3 class="public-DraftStyleDefault-text-ltr fixed-tab-size public-DraftStyleDefault-block-depth0 iWv3d aujbK _3M0Fe _1FoOD iWv3d _1j-51 mm8Nw"&gt;1. Age of Consent&lt;/h3&gt;
&lt;p class="public-DraftStyleDefault-text-ltr fixed-tab-size public-DraftStyleDefault-block-depth0 iWv3d b+iTF _78FBa _1FoOD iWv3d _1j-51 mm8Nw" style="text-align: justify; "&gt;By setting the age of consent as 18 years under the Data Protection Bill, 2021, it brings all individuals under 18 years of age under one umbrella without making a distinction between the internet usage of a 5-year-old child and a 16-year-old teenager. There is a need to look at the current internet usage habits of children and assess whether requiring parental consent is reasonable or even practical. It is also pertinent to note that the law in the offline world does make the distinction between age and maturity. For example, it has been &lt;a class="_1lsz7 _3Bkfb" href="https://cis-india.org/internet-governance/blog/pallavi-bedi-and-shweta-mohandas-cis-comments-on-data-protection-bill" rel="noopener noreferrer" target="_blank"&gt;highlighted&lt;/a&gt; that Section 82 of the Indian Penal Code, read with Section 83, states that any act by a child under the age of 12 years shall not be considered an offence, while the maturity of those aged between 12–18 years will be decided by the court (individuals between the age of 16–18 years can also be tried as adults for heinous crimes). Similarly, child labour laws in the country allow children above the age of 14 years to work in non-hazardous industries, which would qualify them to fall under Section 13 of the Bill, which deals with employee data.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;A 2019 &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="https://reverieinc.com/wp-content/uploads/2020/09/IAMAI-Digital-in-India-2019-Round-2-Report.pdf" rel="noopener noreferrer" target="_blank"&gt;report&lt;/a&gt;&lt;span&gt; suggests that two-thirds of India’s internet users are in the 12–29 years age group, accounting for about 21.5% of the total internet usage in metro cities. With the emergence of cheaper phones equipped with faster processing and low internet data costs, children are no longer passive consumers of the internet. They have social media accounts and use several applications to interact with others and make purchases. There is a need to examine how children and teenagers interact with the internet as well as the practicality of requiring parental consent for the usage of applications.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Most applications that require age data request users to type in their date of birth; it is not difficult for a child to input a suitable date that would make it appear that they are &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="https://www.theguardian.com/media/2013/jul/26/children-lie-age-facebook-asa" rel="noopener noreferrer" target="_blank"&gt;over 18&lt;/a&gt;&lt;span&gt;. In this case they are still children but the content that will be presented to them would be those that are meant for adults including content that might be disturbing or those involving use of &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="https://www.theguardian.com/media/2013/jul/26/children-lie-age-facebook-asa" rel="noopener noreferrer" target="_blank"&gt;alcohol and gambling. &lt;/a&gt;&lt;span&gt;Additionally, in their privacy policies, applications sometimes state that they are not suited for and restricted from users under 18. Here, data fiduciaries avoid liability by placing the onus on the user to declare their age and properly read and understand the privacy policy.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Reservations about the age of consent under the Bill have also been highlighted by some members of the JPC through their dissenting opinions. &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="http://164.100.47.193/lsscommittee/Joint%20Committee%20on%20the%20Personal%20Data%20Protection%20Bill,%202019/17_Joint_Committee_on_the_Personal_Data_Protection_Bill_2019_1.pdf#page=221" rel="noopener noreferrer" target="_blank"&gt;MP Ritesh Pandey &lt;/a&gt;&lt;span&gt;suggested that the age of consent should be reduced to 14 years keeping the best interest of the children in mind as well as to support children in benefiting from technological advances. Similarly, &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="http://164.100.47.193/lsscommittee/Joint%20Committee%20on%20the%20Personal%20Data%20Protection%20Bill,%202019/17_Joint_Committee_on_the_Personal_Data_Protection_Bill_2019_1.pdf#page=221" rel="noopener noreferrer" target="_blank"&gt;MP Manish Tiwari &lt;/a&gt;&lt;span&gt;in his dissenting opinion suggested regulating data fiduciaries based on the type of content they provide or data they collect.&lt;/span&gt;&lt;/p&gt;
&lt;h3&gt;&lt;span&gt;2. How is the 2021 Bill Different from the 2019 Bill?&lt;/span&gt;&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="http://164.100.47.4/BillsTexts/LSBillTexts/Asintroduced/373_2019_LS_Eng.pdf" rel="noopener noreferrer" target="_blank"&gt;2019 &lt;/a&gt;&lt;span&gt;draft of the Bill consisted of a class of data fiduciaries called guardian data fiduciaries – entities that operate commercial websites or online services directed at children or which process large volumes of children’s personal data. This class of fiduciaries was barred from profiling, tracking, behavioural monitoring, and running targeted advertising directed at children and undertaking any other processing of personal data that can cause significant harm to the child. In the previous draft, such data fiduciaries were not allowed to engage in ‘profiling, tracking, behavioural monitoring of children, or direct targeted advertising at children’. There was also a prohibition on conducting any activities that might significantly harm the child. As per Chapter IV, any violation could attract a penalty of up to INR 15 crore of the worldwide turnover of the data fiduciary for the preceding financial year, whichever is higher. However, this separate class of data fiduciaries do not have any additional responsibilities. It is also unclear as to whether a data fiduciary that does not by definition fall within such a category would be allowed to engage in activities that could cause ‘significant harm’ to children.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The new Bill also does not provide any mechanisms for age verification and only lays down considerations that verification processes should be undertaken. Furthermore, the JPC has suggested that consent options available to the child when they attain the age of majority i.e. 18 years should be included within the rule frame by the Data Protection Authority instead of being an amendment in the Bill.&lt;/span&gt;&lt;/p&gt;
&lt;h3&gt;&lt;span&gt;3. In the Absence of a Guardian Data Fiduciary&lt;/span&gt;&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The 2018 and 2019 drafts of the PDP Bill consider a child to be any person below the age of 18 years. For a child to access online services, the data fiduciary must first verify the age of the child and obtain consent from their guardian. The Bill does not provide an explicit process for age verification apart from stating that regulations shall be drafted in this regard. The 2019 Bill states that the Data Protection Authority shall specify codes of practice in this matter. Taking best practices into account, there is a need for ‘&lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="https://cuts-ccier.org/pdf/project-brief-highlighting-inclusive-and-practical-mechanisms-to-protect-childrens-data.pdf" rel="noopener noreferrer" target="_blank"&gt;user-friendly and privacy-protecting age verification techniques&lt;/a&gt;&lt;span&gt;’ to encourage safe navigation across the internet. This will require &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="https://cuts-ccier.org/pdf/bp-global-technological-developments-in-age-verification-and-age-estimation.pdf" rel="noopener noreferrer" target="_blank"&gt;looking at &lt;/a&gt;&lt;span&gt;technological developments and different standards worldwide. There is a need to hold companies &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="https://www.livemint.com/opinion/columns/theres-a-better-way-to-protect-the-online-privacy-of-kids-11615306723478.html" rel="noopener noreferrer" target="_blank"&gt;accountable&lt;/a&gt;&lt;span&gt; for the protection of children’s online privacy and the harm that their algorithms cause children and to make sure that they are not continued.&lt;/span&gt;&lt;/p&gt;
&lt;p class="public-DraftStyleDefault-text-ltr fixed-tab-size public-DraftStyleDefault-block-depth0 iWv3d b+iTF _78FBa _1FoOD iWv3d _1j-51 mm8Nw" style="text-align: justify; "&gt;The JPC in the 2021 version of the Bill removed provisions about guardian data fiduciaries, stating that there was no advantage in creating a different class of data fiduciary. As per the JPC, even those data fiduciaries that did not fall within the said classification would also need to comply with rules pertaining to the personal data of children i.e. with Section 16 of the Bill. Section 16 of the Bill requires the data fiduciary to verify the child’s age and obtain consent from the parent/guardian. The manner of age verification has also een spelt out.  Furthermore, since ‘significant data fiduciaries’ is an existing class, there is still a need to comply with rules related to data processing. The JPC also removed the phrase “in the best interests of, the child” and “is in the best interests of, the child” under sub-clause 16(1), implying that the entire Bill concerned the rights of the data principal and the use of such terms dilutes the purpose of the legislation and could give way to manipulation by the data fiduciary.&lt;/p&gt;
&lt;h3&gt;&lt;span&gt;Conclusion&lt;/span&gt;&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Over the past two years, there has been a significant increase in applications that are targeted at children. There has been a proliferation of EduTech apps, which ideally should have more responsibility as they are processing children's data. We recommend that instead of creating a separate category, such fiduciaries collecting children's data or providing services to children be seen as ‘significant data fiduciaries’ that need to take up additional compliance measures.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Furthermore, any blanket prohibition on tracking children may obstruct safety measures that could be implemented by data fiduciaries. These fears are also increasing in other jurisdictions as there is a likelihood to restrict data fiduciaries from using software that looks out for such as &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="https://www.unodc.org/e4j/en/cybercrime/module-12/key-issues/online-child-sexual-exploitation-and-abuse.html" rel="noopener noreferrer" target="_blank"&gt;Child Sexual Abuse Material&lt;/a&gt;&lt;span&gt; as well as  online predatory behaviour. Additionally, concerning the age of consent under the Bill, the JPC could look at international best practices and come up with ways to make sure that children can use the internet and have rights over their data, which would enable them to grow up with more awareness about data protection and privacy. One such example to look at could be the Children's Online Privacy Protection Rule (COPPA) in the US, where the rules apply to operators of websites and online services that collect personal information from kids &lt;/span&gt;&lt;a class="_1lsz7 _3Bkfb" href="https://www.ftc.gov/tips-advice/business-center/guidance/childrens-online-privacy-protection-rule-six-step-compliance" rel="noopener noreferrer" target="_blank"&gt;under 13 &lt;/a&gt;&lt;span&gt;or provide services to children that are directed at a general audience, but have actual knowledge that they collect personal information from such children. A form of combination of this system and the significant data fiduciary classification could be one possible way to ensure that children’s data and privacy are preserved online.&lt;/span&gt;&lt;/p&gt;

    <title>Notes for India as the digital trade juggernaut rolls on</title>

&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Despite the cancellation of the Twelfth Ministerial Conference (MC12) of the World Trade Organization (WTO) late last year (scheduled date, November 30, 2021-December 3, 2021) due to COVID-19, digital trade negotiations continue their ambitious march forward. On December 14, Australia, Japan, and Singapore, co-convenors of the plurilateral Joint Statement Initiative (JSI) on e-commerce, welcomed the ‘substantial progress’ made at the talks over the past three years and stated that they expected a convergence on more issues by the end of 2022.&lt;/p&gt;
&lt;h3&gt;Holding out&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;But  therein lies the rub: even though JSI members account for over 90% of  global trade, and the initiative welcomes newer entrants, over half of  WTO members (largely from the developing world) continue to opt out of  these negotiations. They fear being arm-twisted into accepting global  rules that could etiolate domestic policymaking and economic growth.  India and South Africa have led the resistance and been the JSI’s most  vocal critics. India has thus far resisted pressures from the developed  world to jump onto the JSI bandwagon, largely through coherent legal  argumentation against the JSI and a long-term developmental vision. Yet,  given the increasingly fragmented global trading landscape and the  rising importance of the global digital economy, can India tailor its  engagement with the WTO to better accommodate its economic and  geopolitical interests?&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;Global rules on digital trade&lt;/strong&gt;&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The  WTO emerged in a largely analogue world in 1994. It was only at the  Second Ministerial Conference (1998) that members agreed on core rules  for e-commerce regulation. A temporary moratorium was imposed on customs  duties relating to the electronic transmission of goods and services.  This moratorium has been renewed continuously, to consistent opposition  from India and South Africa. They argue that the moratorium imposes  significant costs on developing countries as they are unable to benefit  from the revenue customs duties would bring.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The  members also agreed to set up a work programme on e-commerce across  four issue areas at the General Council: goods, services, intellectual  property, and development. Frustrated by a lack of progress in the two  decades that followed, 70 members brokered the JSI in December 2017 to  initiate exploratory work on the trade-related aspects of e-commerce.  Several countries, including developing countries, signed up in 2019  despite holding contrary views to most JSI members on key issues.  Surprise entrants, China and Indonesia, argued that they sought to shape  the rules from within the initiative rather than sitting on the  sidelines.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India  and South Africa have rightly pointed out that the JSI contravenes the  WTO’s consensus-based framework, where every member has a voice and vote  regardless of economic standing. Unlike the General Council Work  Programme, which India and South Africa have attempted to revitalise in  the past year, the JSI does not include all WTO members. For the process  to be legally valid, the initiative must either build consensus or  negotiate a plurilateral agreement outside the aegis of the WTO.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India  and South Africa’s positioning strikes a chord at the heart of the  global trading regime: how to balance the sovereign right of states to  shape domestic policy with international obligations that would enable  them to reap the benefits of a global trading system.&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;A contested regime&lt;/strong&gt;&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;There  are several issues upon which the developed and developing worlds  disagree. One such issue concerns international rules relating to the  free flow of data across borders. Several countries, both within and  outside the JSI, have imposed data localisation mandates that compel  corporations to store and process data within territorial borders. This  is a key policy priority for India. Several payment card companies,  including Mastercard and American Express, were prohibited from issuing  new cards for failure to comply with a 2018 financial data localisation  directive from the Reserve Bank of India. The Joint Parliamentary  Committee (JPC) on data protection has recommended stringent  localisation measures for sensitive personal data and critical personal  data in India’s data protection legislation. However, for nations and  industries in the developed world looking to access new digital markets,  these restrictions impose unnecessary compliance costs, thus arguably  hampering innovation and supposedly amounting to unfair protectionism.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There  is a similar disagreement regarding domestic laws that mandate the  disclosure of source codes. Developed countries believe that this  hampers innovation, whereas developing countries believe it is essential  for algorithmic transparency and fairness — which was another key  recommendation of the JPC report in December 2021.&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;India’s choices&lt;/strong&gt;&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;India’s  global position is reinforced through narrative building by political  and industrial leaders alike. Data sovereignty is championed as a means  of resisting ‘data colonialism’, the exploitative economic practices and  intensive lobbying of Silicon Valley companies. Policymaking for  India’s digital economy is at a critical juncture. Surveillance reform,  personal data protection, algorithmic governance, and non-personal data  regulation must be galvanised through evidenced insights,and work for  individuals, communities, and aspiring local businesses — not just  established larger players.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Hastily  signing trading obligations could reduce the space available to frame  appropriate policy. But sitting out trade negotiations will mean that  the digital trade juggernaut will continue unchecked, through  mega-regional trading agreements such as the Regional Comprehensive  Economic Partnership (RCEP) and the Comprehensive and Progressive  Agreement for Trans-Pacific Partnership (CPTPP). India could risk  becoming an unwitting standard-taker in an already fragmented trading  regime and lose out on opportunities to shape these rules instead.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Alternatives  exist; negotiations need not mean compromise. For example, exceptions  to digital trade rules, such as ‘legitimate public policy objective’ or  ‘essential security interests’, could be negotiated to preserve  policymaking where needed while still acquiescing to the larger  agreement. Further, any outcome need not be an all-or-nothing  arrangement. Taking a cue from the Digital Economy Partnership Agreement  (DEPA) between Singapore, Chile, and New Zealand, India can push for a  framework where countries can pick and choose modules with which they  wish to comply. These combinations can be amassed incrementally as  emerging economies such as India work through domestic regulations.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Despite  its failings, the WTO plays a critical role in global governance and is  vital to India’s strategic interests. Negotiating without surrendering  domestic policy-making holds the key to India’s digital future.&lt;/p&gt;
&lt;hr /&gt;

    <title>State of Consumer Digital Security in India</title>

        &lt;b&gt;This report attempts to identify the existing state of digital safety in India, with a mapping of digital threats, which will aid stakeholders in identifying and addressing digital security problems in the country. This project was funded by the Asia Foundation.&lt;/b&gt;
        
&lt;p style="text-align: justify;"&gt;&amp;nbsp;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Since 2006, successive Union governments in India have shown increased focus on digital governance. The National e-Governance Plan was launched by the UPA government in2006, and several digital projects led by the state such as digitisation of the filing of taxes, appointment process for passports, corporate governance, and the Aadhaar programme(India’s unique digital identity system that utilises biometric and demographic data) arose under it, in the form of mission mode projects (projects that are part of a broader National e-governance initiative, each focusing on specific e-Governance aspects, like banking, land records, or commercial taxes). In 2014, when the NDA government came to power, the National e-Governance Plan was subsumed under the government’s flagship project of Digital India, and several mission mode projects were added. In the meantime, the internet connectivity, first in the form of wire connectivity, and later in the form of mobile connectivity has increased greatly. In the same period, use of digital services, first in new services native to the Internet such as email, social networking, instant messaging, and later the platformization and disruption of traditional business models in transportation, healthcare, finance and virtually every sector, has led to a deluge of digital private service providers in India.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Currently, India has 500 million internet users — over a third of its total population — making it the country with the second largest number of Internet users after China. The uptake of these technological services has also been accompanied by several kinds of digital threats that an average digital consumer in India must regularly contend with. This report is a mapping of consumer-facing digital threats in India and is intended to aid stakeholders in identifying and addressing digital security problems. The first part of the report categorises digital threats into four kinds, Personal Data Threats, Online Content Related Threats, Financial Threats, and Online Sexual Harassment Threats. Threats under each category are then defined, with detailed consumer-facing consequences, and past instances where harm has been caused because of these threats.&lt;/p&gt;

&lt;p&gt;Sahapedia in collaboration with the Azim Premji University, The Centre for Internet and Society and the University of Cape Town is inviting papers in cultural mapping for the Culture For All conference scheduled to be held in March 2021.&lt;/p&gt;
&lt;p&gt;Cultural mapping is a set of activities and processes for exploring, discovering, documenting, examining, analysing, interpreting, presenting, and sharing information related to people, communities, societies, places, and the material products and practices associated with those people and places. It was recognised by UNESCO more than a decade ago as a crucial tool in sustaining the tangible, intangible, and natural heritage of the world.&lt;/p&gt;
&lt;p&gt;However, the exercise is either used inadequately or rarely highlighted in the Indian context thereby limiting accessibility to peer-reviewed work in this area. As part of the #CultureForAll festival and conference, an open call for research papers and action projects in cultural mapping is being made to consolidate knowledge created till date in India and regions with similar cultural history like Asia and Africa. Cultural mapping and documentation are intricate processes that attempt to solve complex questions of who, what, how, and for whom to map. We hope these papers will carve out a space to interrogate, discuss, and reflect upon the same.&lt;/p&gt;
&lt;p&gt;Another central objective of reviewing work in this area is to develop a mapping toolkit/guide that can help make cultural documentation accessible to anyone interested. Without being prescriptive or lending itself to a homogenous practise, the toolkit/guide would be a way to bring together varied approaches, contexts, and innovations in the field. In a sector like culture where financial and non-financial resources are insubstantial, we believe this toolkit/guide will give organisations and individuals a clear roadmap for future mapping projects.&lt;/p&gt;
&lt;h3&gt;Themes&lt;/h3&gt;
&lt;p&gt;All interested academicians, researchers, PhD students, and practitioners are invited to submit their papers under any one of the following themes. All papers will be evaluated by a review committee and select papers in each theme will be awarded INR 10,000 and presented in the #CultureForAll conference. Papers will also get an opportunity to be published in respected peer-reviewed journals and Sahapedia's web platform.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Cultural Mapping—Theory &amp;amp; Practise:&lt;/strong&gt; There is no fixed way to map cultural resources and the approach can be multi-fold. Efforts can also vary in terms of community involvement and collaborative processes. Papers submitted under this topic should explore and elucidate the theoretical and methodological frameworks used in mapping, with an emphasis on issues and challenges faced, the extent of community engagement, and the impact of such projects in policymaking and society, if any.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Technology for cultural mapping:&lt;/strong&gt; Technology and digitisation have shifted approaches to culture and heritage and the recent pandemic has made it indispensable to the society at large. Papers are invited on issues related to techniques and technologies for preservation, management and dissemination of cultural heritage with a focus on innovation and social equity specifically for the Indian context.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Evaluating impact of cultural mapping applications:&lt;/strong&gt; Cultural mapping provides rich cultural data by creating resource inventories that helps address varied issues like sustainability, intergenerational conflict, alienation of youth, and the role of women in society. It can create opportunities for communities to affirm identity and pursue land rights. Cultural mapping can be an informative classroom activity for children, and a valuable methodology for academic research. As a policymaking tool, it can be used to enhance and conserve heritage sites while promoting new tourism development approaches. Papers submitted under this topic should illustrate how cultural mapping has been used in areas like education, tourism, placemaking, conservation, and skilling, the issues and challenges faced, how impacts are measured, and the metrics associated with such measurement.&lt;/p&gt;

&lt;h3&gt;&lt;strong&gt;Digital humanities and new contexts of digital archival practice in India&lt;/strong&gt;&lt;/h3&gt;
&lt;p&gt;&lt;em&gt;This is the abstract of Sneha's presentation on digital humanities in India and transitions in digitization and cultural archival practices in the postcolonial context. The presentation was part of a session titled 'Community and Knowledge.'&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;The last few decades have seen several large-scale efforts in digitalization across various sectors in India. In space of Galleries, Libraries, Archives and Museums (GLAM) in particular, there have been several initiatives undertaken by state institutions, along with individual and collaborative efforts to digitize and make cultural heritage and educational content available online. The growth of new areas of research and creative practice like digital humanities has also brought to the fore the need for digital corpora, including new technologies and methods of research as ways to engage with cultural content through the development of digital pedagogies and creative practice.&lt;/p&gt;
&lt;p&gt;Many of these questions are located in long-spanning efforts in digitization and digital literacy more broadly, which are still fraught with challenges of access, usage and context. While digitization and archival practice form a significant aspect of the discourse on digital humanities, there still exist a number of anxieties around its practice. Especially in the case of community-led efforts, such as archiving oral histories or GLAM initiatives with collaborative knowledge platforms like Wikimedia, challenges of the digital divide are persistent, reflecting also a larger politics around the growth and sustenance of cultural heritage projects and the humanities and arts more broadly. &amp;nbsp;Drawing upon excerpts from work on mapping the field of DH in India, and ongoing conversations on the digital transition in cultural archives, this presentation seeks to understand the practices and politics of digitization and archival work today, and how it continues to inform the growth of fields like digital humanities in India.&lt;/p&gt;

They will form part of a broader narrative combining data and experience, highlighting how limited the current language capacities of the internet are, and how much opportunity there is for making our knowledges available in our many languages.&lt;/p&gt;

&lt;p&gt;As part of a broader movement to increase inclusion and diversity in emojis, Aboriginal people in Central Australia are creating Indigemoji, the first set of Australian Indigenous emojis delivered via a free app. Caddie, Joel, Leigh and Graham aim to describe how to reflect Aboriginal experiences online, to increase the accessibility of Arrernte language in the broader Australian lexicon, to position Arrernte knowledge on digital platforms for future generations of Arrentre speakers and learners, and to contribute more broadly to the decolonisation of the internet.&lt;/p&gt;
&lt;/li&gt;
&lt;li&gt;
&lt;h4&gt;&lt;em&gt;Claudia Soria&lt;/em&gt;&lt;/h4&gt;
&lt;p&gt;Claudia will describe “The Digital Language Diversity Project” funded by the European Commission under the Erasmus+ programme. The project has surveyed the digital use and usability of four European minority languages: Basque, Breton, Karelian and Sardinian. It has also developed a number of instruments that can help speakers’ communities drive the digital life of their languages, in the form of a methodology named “digital language planning”.&lt;/p&gt;
&lt;/li&gt;
&lt;li&gt;
&lt;h4&gt;&lt;em&gt;Donald Flywell Malanga&lt;/em&gt;&lt;/h4&gt;
&lt;p&gt;Donald will share his experiences conducting two panel discussions with elderly and ten young Ndali People in Chisitu Village based in Misuku Hills, Malawi. He aims to hear their stories and make sense of them relating to how Chindali could be spoken/expressed online, examine the barriers they face in sharing/expressing their language online, and unearth possible solutions to address such barriers.&lt;/p&gt;
&lt;/li&gt;
&lt;li&gt;
&lt;h4&gt;&lt;em&gt;Emna Mizouni&lt;/em&gt;&lt;/h4&gt;
&lt;p&gt;Emna will interview African and Arab content creators and consumers to share their experiences in posting content in their own language and expose their cultures. She will reach out to different ethnicities from Africa to gather data on the reasons they use the “colonial languages” on the internet and the burdens they face, whether technical such as internet connectivity and accessibility, lack of devices, social or cultural barriers, etc.&lt;/p&gt;
&lt;/li&gt;
&lt;li&gt;
&lt;h4&gt;&lt;em&gt;Ishan Chakraborty&lt;/em&gt;&lt;/h4&gt;
&lt;p&gt;Ishan will explore the experiences of individuals who identify themselves as both disabled and queer, and who are not visible online in Bengali. Online research papers and academic works in Bengali are significantly limited, and even more so in the case of works on marginalities and intersections. One of the most effective ways of making online material accessible to persons with visual disability is through audio material, and Ishan will explore some of these possibilities.&lt;/p&gt;
&lt;/li&gt;
&lt;li&gt;
&lt;h4&gt;&lt;em&gt;Joaquín Yescas Martínez&lt;/em&gt;&lt;/h4&gt;
&lt;p&gt;Joaquin will be describing the free software, open technology initiatives and the sharing philosophy of “compartencia” in his community of Mixe and Zapotec peoples in Mexico. He will explore initiatives such as Xhidza Penguin School, an app to learn the language online, and learning workshops to look at new methodologies for sharing and using the language. It is not only a means of communication but it also encompasses a different way of understanding the world.&lt;/p&gt;
&lt;/li&gt;
&lt;li&gt;
&lt;h4&gt;&lt;em&gt;Kelly Foster&lt;/em&gt;&lt;/h4&gt;
&lt;p&gt;Kelly will draw attention to the work being done to revitalise indigenous languages and the struggles to represent the Nation Languages of the Caribbean and its diasporas in structured data and on Wikipedia. She aims to have the native names of the islands, locations and indigenous peoples on Wikidata, labelled with their own language so she can generate a map of the Caribbean with as many native names as possible. But the language of the Taino people of the islands that are now called Jamaican, Cuba, Puerto Rico and Haiti has been labelled as extinct, as are the people, by European researchers. Though a victim of the first European genocide of the Caribbean, they live on in the tongues and blood of people who are more often racialised as Black and Latinx.&lt;/p&gt;
&lt;/li&gt;
&lt;li&gt;
&lt;h4&gt;&lt;em&gt;Paska Darmawan&lt;/em&gt;&lt;/h4&gt;
&lt;p&gt;As a first-generation college student who did not understand English, Paska had difficulties in finding educational, inspiring content about LGBTQIA issues in their native language, let alone positive content about the local LGBTQIA community. They plan to share a mapping of available Indonesian digital LGBTQIA content, whether it be in the form of Wikipedia articles, websites, social media accounts, or any other online media.&lt;/p&gt;
&lt;/li&gt;
&lt;li&gt;
&lt;h4&gt;&lt;em&gt;Uda Deshpriya&lt;/em&gt;&lt;/h4&gt;
&lt;p&gt;Uda will explore the lack of feminist content on the internet in Sinhala and Tamil. Mainstream human rights discussions take place in English and leaves out the majority of Sri Lankans. Women’s rights discourse remains even more centralized. Despite the fact that all primary criminal and civil courts work in local languages, statutes and decided cases are not available in Sinhala and Tamil, including Sri Lanka’s Constitution and its amendments. This extends to content creation through both text and art, with significant barriers of keyboard and input methods.&lt;/p&gt;
&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;The problem:&lt;/strong&gt; The internet we have today is not multilingual enough to reflect the full depth and breadth of humanity. Language is a good proxy for, or way to understand, knowledge – different languages can represent different ways of knowing and learning about our worlds. Yet most online knowledge today is created and accessible only through colonial languages, and mostly English. The UNESCO Report on ‘&lt;a href="https://unesdoc.unesco.org/in/documentViewer.xhtml?v=2.1.196&amp;amp;id=p::usmarcdef_0000232743&amp;amp;file=/in/rest/annotationSVC/DownloadWatermarkedAttachment/attach_import_8df09604-0040-4b44-b53c-110207ac407d%3F_%3D232743eng.pdf&amp;amp;locale=en&amp;amp;multi=true&amp;amp;ark=/ark:/48223/pf0000232743/PDF/232743eng.pdf#685_15_CI_EN_int.indd%3A.7579%3A23" target="_blank"&gt;A Decade of Promoting Multilingualism in Cyberspace&lt;/a&gt;’ (2015) estimated that “out of the world’s approximately 6,000 languages, just 10 of them make up 84.3 percent of people using the Internet, with English and Chinese the dominant languages, accounting for 52 per cent of Internet users worldwide.” More languages become endangered and disappear every year; &lt;a href="http://www.unesco.org/new/en/culture/themes/endangered-languages/atlas-of-languages-in-danger/" target="_blank"&gt;230 languages have become extinct between 1950 and 2010&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;At best, then, 7% of the world’s &lt;a href="https://www.ethnologue.com/statistics" target="_blank"&gt;languages&lt;/a&gt; are captured in published material, and an even smaller fraction of these languages are available online. This is particularly critical for communities who have been historically or currently marginalized by power and privilege – women, people of colour, LGBT*QIA folks, indigenous communities, and others marginalized from the global South (Asia, Africa, Latin America, the Caribbean and Pacific Islands). We often cannot add or access knowledge in our own languages on the internet. This reinforces and deepens inequalities and invisibilities that already exist offline, and denies all of us the richness of the multiple knowledges of the world.&lt;/p&gt;
&lt;p&gt;Some of the issues that shape our abilities to create and share content online in our languages include:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;The internet’s infrastructure (hardware, software, platforms, protocols…);&lt;/li&gt;
&lt;li&gt;Content management tools and technologies for translation, digitization, and archiving (voice, machine-learning systems and AI, semantic web…);&lt;/li&gt;
&lt;li&gt;The experience of those who consume and produce information online in different languages (devices like cell phones and laptops, messaging tools, micro-blogging, audio-video…);&lt;/li&gt;
&lt;li&gt;The experience of looking for content in different languages online, through search engines and other tools.&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;Understanding the range of these issues will help us map the possibilities and concerns around linguistic biases and disparities on the internet.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Who we are:&lt;/strong&gt; We are a group of three research partners who believe that the internet we co-create should support, share, and amplify knowledge in all of the world’s languages. For this to happen, we need to better understand the challenges and opportunities that support or prevent our languages and knowledges from being online. The Centre for Internet and Society (CIS) is a non-profit organisation that undertakes interdisciplinary research on internet and digital technologies from policy and academic perspectives. The areas of focus include digital accessibility for persons with disabilities, access to knowledge, intellectual property rights, openness (including open data, free and open source software, open standards, open access, open educational resources, and open video), internet governance, telecommunication reform, digital privacy, and cyber-security. The &lt;a href="https://www.oii.ox.ac.uk/" target="_blank"&gt;Oxford Internet Institute&lt;/a&gt; is a multidisciplinary research and teaching department of the University of Oxford, dedicated to the social science of the Internet. &lt;a href="https://whoseknowledge.org/" target="_blank"&gt;Whose Knowledge?&lt;/a&gt; is a global campaign to centre the knowledges of marginalized communities – the majority of the world – online.&lt;/p&gt;
&lt;p&gt;Together we are creating a State of the Internet’s Languages report, as baseline research with both numbers and stories, to demonstrate how far we are from making the internet multilingual. We also hope to offer some possibilities for doing more to create the multilingual internet we want.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Why we need YOU:&lt;/strong&gt; This research needs the experiences and expertise of people who think about these issues of language online from different perspectives.&lt;/p&gt;
&lt;p&gt;You may be a person who:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Self-identifies as being from a marginalized community, and you find it difficult to bring your community’s knowledge online because the technology to display your language’s script is hard to access or read&lt;/li&gt;
&lt;li&gt;Works on creating content in languages that are from parts of the world, and from people, who are mostly invisible and unheard online&lt;/li&gt;
&lt;li&gt;Is a techie who works on making keyboards for non-colonial languages&lt;/li&gt;
&lt;li&gt;Is a linguist who tries to bring together communities and technologies in a way that is easy and accessible&lt;/li&gt;
&lt;li&gt;... you may be any of these, all of these, or more!&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;We are looking for your experience online to help us tell the story of how limited the language capacities of the internet are, currently, and how much opportunity there is for making the internet share our knowledges in our many different languages. Most importantly: you don’t have to be an academic or researcher to apply, we particularly encourage people experiencing these issues in their everyday lives and work to contribute!&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h3&gt;Some of the key questions we’d like you to explore:&lt;/h3&gt;
&lt;ul&gt;
&lt;li&gt;How are you or your community using your language online?&lt;/li&gt;
&lt;li&gt;What do you wish you could create or share in your language online that you can’t today?&lt;/li&gt;
&lt;li&gt;What does content in your language look like online? What exists, what’s missing? (&lt;em&gt;you might think about, for example, news, social media, education or government websites, e-commerce, entertainment, online libraries and archives, self-published content, etc&lt;/em&gt;)&lt;/li&gt;
&lt;li&gt;How and where and using what technologies do you share or create content in your language? (&lt;em&gt;you might think about, for example, video, audio, writing, social media, digitization…whatever formats, tools, processes or websites you use for creating oral, visual, textual, or other forms of content&lt;/em&gt;.)&lt;/li&gt;
&lt;li&gt;What is challenging to create or share on your language online? (&lt;em&gt;you might think about, for example, access, device usability, platforms, websites, apps and other tools, software, fonts, digital literacy, etc when developing digital archives, online language resources, or just making any presence on the web in general for your language&lt;/em&gt;.)&lt;/li&gt;&lt;/ul&gt;

&lt;p&gt;We would love to hear about your and your community’s experiences in response to any or some of the above questions!&lt;/p&gt;
&lt;p&gt;Your contribution could be in the form of a written essay, a visualization or work of art, a video or recorded conversation – we’d be happy to interview you if that’s your preference. We would be happy to accept in any language, and will review the submissions with the support of our multilingual communities and friends.&lt;/p&gt;

&lt;p&gt;எல்லா உள்ளடக்கத்தையும் கணக்கில் எடுத்தால் கூட, உலகின் 7% மொழிகளில் தான் ஆக்கங்கள் இருக்கின்றன. இவற்றில் சிலவே இணையத்தில் கிடைக்கின்றன. முற்காலத்தில் ஒடுக்கப்பட்டிருந்த பழங்குடியின சமூகத்தினர், அடக்குமுறைக்கு உட்பட்டிருந்த பெண்கள், நிறவெறிக்கு உட்பட்டிருந்தோர், மாற்று பாலின கருத்தியல் கொன்டோர் ஆகியோருக்கான ஆக்கங்கள் வெகு சில. பெரும்பாலானோர் இணையத்தில் தம் தாய்மொழியில் தகவல்களை தேடிப் பெற முடிவதில்லை. தம் மொழியில் கிடைக்கப்பெறாத பெரும்பாலானோருக்கு இவ்வுலகைப் பற்றிய அறிவுசார் ஆக்கங்கள் மறுக்கப்பட்டு, சமமின்மை வெளிப்படுகிறது.&lt;/p&gt;
&lt;p&gt;நம் மொழியிலேயே இணையத்தில் ஆக்கங்களை உருவாக்குவதிலும் பகிர்வதிலும் சில சிக்கல்களை எதிர்நோக்குகிறோம். அவை:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;கட்டமைப்பு வசதிக் குறைபாடு : வன்பொருள், மென்பொருள், இயங்குதளம், மரபுத்தகவு&lt;/li&gt;

&lt;li&gt;தேடுபொறிகளையும் பிற கருவிகளையும் கொன்டு வெவ்வேறு மொழிகளில் ஆக்கங்களைத் தேடிப் பழக்கம் இல்லாமை&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;இச்சிக்கல்களைப் புரிந்துகொள்வதன் மூலம், இணையத்தின் பன்மொழிச் சூழலுக்கான தேவைகளையும் அவற்றிற்கான குறைநிறைகளையும் சரிப்படுத்திக்கொள்ள முடியும்.&lt;/p&gt;

&lt;p&gt;3. ஹூஸ் நாலெட்ஜ் என்ற இயக்கம், உலகளவில் ஒடுக்கப்பட்ட சமூகங்களின் அறிவுசார் ஆக்கங்களை இணையவெளியில் கொண்டு வர முயற்சி எடுக்கிறது.&lt;/p&gt;
&lt;p&gt;நாங்கள் மூவரும் இணைந்து, இணையத்தில் பயன்பாட்டிலுள்ள மொழிகளைப் பற்றிய ஆய்வறிக்கையை தயாரிக்கிறோம். புள்ளிவிவரங்களையும், தகவல்களையும் வெளியிட்டு, பன்மொழிச் சூழலில் எந்தளவு பின்தங்கி இருக்கிறோம் என்பதை உணர்த்த உள்ளோம். இணையவெளியில் ஆக்கங்களை வெளியிட எங்களால் முடிந்த சில வாய்ப்புகளையும் வழங்க உள்ளோம்.&lt;/p&gt;

        &lt;b&gt;The inaugural conference of the Digital Humanities Alliance of India (DHAI) was held at the Indian Institute of Management (IIM), Indore on June 1-2, 2018. The event was co-organised by the IIM and the Indian Institute of Technology, Indore, with support from the Centre for Internet and Society, Bangalore. Puthiya Purayil Sneha was a keynote speaker at the event. Her talk was titled ‘New Contexts and Sites of Humanities Practice in the Digital’. Drawing upon excerpts from a study on mapping digital humanities initiatives in India, and ongoing conversations on digital cultural archiving practices, the keynote address discussed some pertinent concerns in the field, particularly with respect to the growth of digital corpora and its intersections with teaching learning practices in arts and humanities, including the need to locate these efforts within the context of the emerging digital landscape in India, and its implications for humanities practice, scholarship and pedagogy.&lt;/b&gt;

&lt;h3&gt;&lt;strong&gt;Abstract of the Keynote&lt;/strong&gt;&lt;/h3&gt;
&lt;p&gt;The discourse around the field of digital humanities in India has emerged at an interesting and crucial juncture, where the ‘digital’ has been the focal point of several changes in governance, policy, industry, education and creative practice among other areas over the last couple of decades. Even as the field has garnered much interest globally, it has also invited criticism, especially due to its largely Anglo-American framing, which traces a history in humanities computing and textual studies, located within a larger neoliberal imagination of the university and academia. Now with increasing efforts to address issues of representation and diversity in emerging digital initiatives, it is imperative to trace where efforts within India have been speaking to these concerns within the global discourse as well. 
In India, as with several parts of the world, a large part of the work and scholarship around digital humanities, as we have seen so far has centered around two key processes/concepts - that of digitization, or the creation of a corpora of cultural content, enabled by the availability of the internet and digital technologies, and the need for new methods and tools to work with or study them. These conversations have largely organized around two thematic areas of work within digital humanities and related digital practices - namely the creation of digital corpora in the form of archives and repositories, and the advancement of digital technologies and methods of research, or more specifically through the development of digital pedagogies. Drawing upon excerpts from a study on mapping digital humanities initiatives in India, and ongoing conversations on digital cultural archiving practices, this talk discussed some pertinent concerns in the field, particularly with respect to the growth of digital corpora and its intersections with teaching learning practices in arts and humanities, including the need to locate these efforts within the context of the emerging digital landscape in India, and its implications for humanities practice, scholarship and pedagogy.&lt;/p&gt;

        &lt;b&gt;The ubiquitous presence of the ‘digital’ over the couple of decades has brought with it several important changes in interdisciplinary forms of research and knowledge production. Particularly in the arts and humanities, the role of digital technologies and internet has always been a rather contentious one, with more debate spurred now due to the growth of fields like humanities computing, digital humanities (henceforth DH) and cultural analytics. Even as these fields signal several shifts in scholarship, pedagogy and practice, portending a futuristic imagination of the role of technology in academia and practice on the one hand, they also reflect continuing challenges related to the digital divide, and more specifically politics around the growth and sustenance of the humanities disciplines. A specific criticism within more recent debates around the origin story of DH in fact, has been its Anglo-American framing, drawing upon a history in humanities computing and textual studies, and located within a larger neoliberal imagination of the university and academia. While this has been met with resistance from across different spaces, thus calling for more diversity and representation in the discourse, it is also reflective of the need to trace and contextualize more local forms of practice and pedagogy in the digital as efforts to address these global concerns. This essay by Puthiya Purayil Sneha draws upon excerpts from a study on the field of DH and related practices in India, to outline the diverse contexts of humanities practice with the advent of the digital and explore the developing discourse around DH in the Indian context.&lt;/b&gt;

&lt;p style="text-align: justify;"&gt;The last couple of decades have seen an increasing prevalence of digital technologies and internet in the study and practice of arts and humanities. With the growth of fields like humanities computing, digital humanities (henceforth DH) and cultural analytics, there has been a renewed interest in the increasing role of the ‘digital’ in interdisciplinary forms of research and knowledge production. DH in particular has become a field of much interest and debate in different parts of the world, including in India. Globally, in the last two decades, there have been several efforts to organize the discourse around this field which seeks to explore various intersections between humanities and digital methods, spaces and tools1. But DH also continues to remain a bone of contention, with several perspectives on what exactly constitutes its methodology and scope, and most importantly its epistemological stake.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;A specific criticism has been the Anglo-American framing of DH, located within a larger neoliberal imagination of the university and the higher education system at large. As a result, the connection of these two threads—a history of DH located in humanities computing and textual studies and its contextualization within the American university—is often represented as the history of DH. This has been met with resistance from several scholars and practitioners across the world calling for more global perspectives on the field. Drawing upon excerpts from a recently completed study on mapping the field of DH and related practices in India, this essay will attempt to outline the diverse contexts of humanities practice emerging with the digital turn, along with a reading of some of the global debates around DH to understand the discourse around the field in the Indian context.&lt;/p&gt;

&lt;p&gt;Digital technologies involve, accompany and provoke changes in the structuring of industrial sectors. How are they more particularly transforming the creation, production, distribution processes in cultural and creative industries? What are reconfigurations and challenges associated with the rise in power of actors from the industries of communication and information? What are the new stakeholder strategies, economic models and power relationships involved? Does digital have the effect of empowering the smallest actors / self-employed / freelancers or on the contrary does it allow large players to relieve themselves of the promotion, production costs on individual creator?&lt;/p&gt;
&lt;p&gt;A growing interest in fields such as digital humanities, new media, digital cultures and the Galleries, Libraries, Archives and Museums (GLAM) sector is another important development here. The rise of a number of digital initiatives in arts and humanities practice, research and teaching has also brought up significantly the question of new skills or expertise required in these fields. The need for digital literacy and ‘re-skilling’ to adapt to new forms of arts and humanities practice in a digital environment has often come with much criticism, as it is viewed as an effort towards vocationalisation and professionalization of these disciplines, a result of the changing mandates of the university and higher education in general. How do we then productively engage with these questions of skill, expertise and labour that goes into the building of new digital industries, which are often located within and at the periphery of academia and creative practices? Importantly, how can concerns about a perceived conflict of creativity and industry be addressed as these transformations take place rapidly with the advent of the digital is an important point of focus.&lt;/p&gt;
&lt;p&gt;A critical exploration of the prevalent discourse around creative industries would offer ways of identifying what could be the different forms of digital creative and cultural industries developing in India, and how they problematize for us questions of cultural expression, knowledge production, creativity and labour. The conflation and overlap of both ‘cultural’ and  ‘creative industries’ and the location of these terms within a larger discourse around policy, economic development, livelihoods and rights, takes on different dimensions post the digital turn. In the context of initiatives like Digital India, and efforts to consolidate an IPR regime, the implications of policy reforms for creative work, especially that performed within informal/underground economies and in the cultural heritage sector are many. These discussions would inform and draw from the ongoing efforts in fostering of a digital economy in India, and the many ways in which it determines cultural production in the rest of the world.&lt;/p&gt;
&lt;p&gt;Topics that will be addressed at the symposium include, but are not restricted to:&lt;/p&gt;
&lt;p&gt;- Digital turns and transformations in cultural and creative industries&lt;/p&gt;
&lt;p&gt;- Media infrastructure, digital platforms, and changing landscape of actors&lt;/p&gt;

&lt;p&gt;Presented by the Labex ICCA and the Center for Internet and Society (CIS), the symposium will gather Indian, French, and international specialists in the cultural industries, new media and technology, information and communication sciences, and social sciences but also professionals and industrial actors in the cultural and artistic sectors. The event is driven an ambition to promote the creation of an interdisciplinary and inter-institutional Franco-Indian research network to initiate, develop and share research on cultural industries in India and more widely in South Asia.&lt;/p&gt;
