<b>I attended the Civil BRICS Forum in Moscow last month. My session fell under the Economics and Trade category; and I spoke on the importance of maintaining a balanced IP regime, strengthening access to knowledge and medicines, and ensuring free speech and innovation. The event was held in Moscow from June 29 to July 1, 2015.</b>
<p>The working group also invited comments to the Zero draft recommendations and I drafted a quick response to the problematic aspects of the draft. <p style="text-align: justify; ">BRICS is a unique interactive format of the five largest and most dynamically developing countries - Brazil, Russia, India, China, and South Africa. BRICS member states in total occupied about a quarter of the land on the world map. The total population of the BRICS countries is about 40%. The cumulative gross domestic product (GDP) is about 26% of the global one. However, BRICS is not only a club intended to strengthen the economic impact of the rapidly developing countries, but as well a fundamentally new form of international or rather an inter-civilizational dialogue based on the principles of polycentricity, non-hierarchy and networking. Therefore it seems that BRICS is able to propose a new concept of equal interaction over all vectors of interstate cooperation: in the monetary sphere, allocation of resources, trade, political and human relations.</p>
<p style="text-align: justify; ">Our Internet resource will help not only to get acquainted closer with history and activity of the BRICS club, to trace news and analytical articles on the agenda both the international process of BRICS, and Civil BRICS, but also to participate directly in Civil BRICS activity by means of forums of the Dialogues Internet platform.</p>

<b>In this blog post, Amulya Purushothama announces our new MHRD IPR Chair Series and charts the sequence of events, starting from the establishment of the MHRD IPR Chairs, to discussions surrounding their purpose and functioning, to concerns surrounding the lack of information about the IPR Chairs, the first round of RTIs CIS had filed in regard to this and the responses received. This series will document and analyze further RTIs filed and responses received in this regard.

<p style="text-align: justify; "><b>Genesis of MHRD IPR Chairs</b></p>
<p style="text-align: justify; ">The Intellectual Property Education, Research and Public Outreach (IPERPO) scheme (Scheme) was set up by the Ministry for Human Resources and Development (MHRD) to encourage study of IP rights and research and create awareness about IP matters. The Scheme was also supposed to develop specialized courses, train enforcement personnel, organize seminars and workshops on IPR matters, develop inputs, awareness on WTO matters and evolve strategies of regional co-operation.</p>
<p style="text-align: justify; ">It was under this scheme that the MHRD-IPR Chairs were set up. These IPR Chairs were set up in 20 Universities and Institutes across India including 6 in Universities, 6 in IITs, 5 in National Law Universities and 3 in IIMs.</p>
<p style="text-align: justify; "><b>Performance of MHRD IPR Chairs</b></p>
<p style="text-align: justify; ">CIS had reported that the Planning Commission and the MHRD in 2014 organized a stakeholders consultation where they discussed India’s National Program on Intellectual Property Management. Apart from <a href="http://cis-india.org/a2k/blogs/mapping-institutions-of-intellectual-property-part-a">discussing</a> the need to revisit the purpose behind the MHRD IPR Chairs program, One of the documents <a href="http://cis-india.org/a2k/blogs/mapping-institutions-of-intellectual-property-part-b">discussed</a> in the context of evaluating how the IPR Chairs function was the <a href="http://cis-india.org/a2k/blogs/report-of-the-evaluation-committee.pdf">Report of the Evaluation Committee on Continuation of the Scheme of IPERO in the XII Five Year Plan Period 2012-2017</a> (Evaluation Committee Report).</p>
<p style="text-align: justify; ">The Evaluation Committee Report among other things noted that many IPR Chair positions are left vacant, that there is no explicit mandate for the activities to be undertaken by the MHRD IPR Chairs, that most of the Chairs only organize a few workshops and deliver lectures and as a consequence the research outputs produced by the Chairs have been very weak. This leads to underutilization of funds available under the scheme.</p>
<p style="text-align: justify; ">The Evaluation Committee Report stated that the IPR Chairs were not performing well due to a number of reasons such as: inability to find a suitable Professor level person to occupy the IPR Chair, absence of qualification-criteria for the IPR chair in the Scheme, lack of focus on research, development of human resource and teaching, non-appointment of adequate staff by IPR Chairs, flow of funds to the IPR Chair being interrupted due to lack of proper documentation, uncertainty about the continuation of IPR Chairs etc.</p>
<p style="text-align: justify; "><b>Informational vacuum around MHRD IPR Chairs</b></p>
<p style="text-align: justify; ">The MHRD launched the <a href="http://www.mhrdiprchairs.org/Home.aspx">MHRD IPR Chair Gateway</a> recently. It was developed by the IPR Chair of NALSAR to serve as a forum where the information about the team of the MHRD IPR Chair, research work done by them, events hosted by them and degrees offered by them are available in one common platform. This gateway is a definite improvement when compared to the website of the <a href="http://copyright.gov.in/frmlistiprchair.aspx">Copyright Office</a> which was the central host for the MHRD IPR Chairs earlier.</p>
<p style="text-align: justify; ">However, the website is difficult to navigate through and even though the design of the gateway is comprehensive, the information is uploaded by the individual IPR Chairs themselves. The information about some MHRD IPR Chairs is up to date, while some others. None of the Chairs seem to have uploaded the mandated Annual Report of their work.</p>
<p style="text-align: justify; ">As CIS has <a href="http://cis-india.org/a2k/blogs/mhrd-ipr-chairs-underutilization-of-funds-and-lack-of-information-regarding-expenditures">reported</a> earlier there exists an informational vacuum around the activities of the MHRD IPR Chairs, the funds allocated to them and accounts of utilization of these funds. Most of the information that is available can only be found in pieces and fragments. The last near comprehensive account of allocation and expenditure of funds with regard to all the IPR Chairs is the Evaluation Committee Report that dates back to 2013.</p>
<p style="text-align: justify; ">The following table shows a matrix of individual MHRD IPR Chairs, their status, and information available about them.</p>

<p style="text-align: justify; ">As can be seen, out of the twenty MHRD IPR Chairs, only 13 remain active while the rest have become inactive. The MHRD Chair at IIT Kanpur was last active over five years ago in June 2010. Out of the twenty, 11 IPR Chairs either do not have a website or redirect to a broken link. Out of the 20, fifteen do not provide any information or only provide for outdated information. Only one of the twenty, the IIT Madras Chair, has provided the mandated Annual Report for 2014-2015.</p>
<p style="text-align: justify; "><b>RTIs and Responses</b></p>
<p style="text-align: justify; ">CIS has filed several RTIs before the IPR Chairs asking for information regarding allocation of funds and utilization of funds.</p>
<p style="text-align: justify; ">The first round of RTIs filed in November 2014, elicited adequate <a href="http://cis-india.org/a2k/blogs/rti-responses-mhrd-ip-chairs-details-of-funding-and-expenditure">responses</a> from seven out of twenty IPR Chairs. Among the rest, the IPR Chairs at Jawaharlal Nehru University, Delhi University, Delhi School of Economics, Tezpur University and CUSAT Kerala did not provide information. And IIT Kharagpur sought exemption from providing this information under Section 8(1) (d) of the RTI Act, 2005.</p>
<p style="text-align: justify; ">Of those who did respond favorably to the RTI and had received money (five in number), three institutions, NLU Jodhpur, NALSAR University of Law, Hyderabad and IIT Bombay had underutilized the funds allocated to them. NLSIU, Bangalore had spent more than the allocated funds and IIM, Bangalore had spent the entire amount allocated.</p>
<p style="text-align: justify; "><b>MHRD IPR Chair Series </b></p>
<p style="text-align: justify; ">We have since followed up with the IPR Chairs with further RTI applications and received responses for the same. Updates on the same will now be part of our MHRD IPR Chair Series. Watch this space.</p>

<b>This post provides a factual description about the operation of Ministry of Human Resource Development IPR Chair’s Intellectual Property Education, Research and Public Outreach (IPERPO) scheme in the Indian Institute of Technology, Kharagpur.</b>
<p style="text-align: justify; ">The author has analysed all the data received through which, the author seeks to trace the presence of unjustified underutilisation of funds by the aforementioned university as provided by the MHRD during the period of 2013-2014.</p>
<p style="text-align: justify; ">To collect the information for the given study, an RTI application was filed to IIT, Kharagpur on 25/11/2014 by the Centre for Internet and Society. The reply to the same was received on 17/12/2014. Following this, a second application was filed on the 10/03/2015 by the Centre for Internet and Society. The reply to RTI application was received on 17/04/2015.</p>

<p style="text-align: justify; "><b>Comparative Analysis between University Response and the guidelines of MHRD Scheme Document<br /></b><a class="external-link" href="http://copyright.gov.in/Documents/scheme.pdf">The Scheme document of MHRD</a> is comprehensive document which consists of guidelines regarding Intellectual Property Education, Research and Public Outreach. It talks about a list of objectives, purposes, conditions and eligibility criteria for a University to ensure in order to implement IPERPO in a truest sense. This document provides the procedural as well as qualifying conditions for an Institute to ensure or fulfil before applying for the MHRD grant. Some of these conditions include maintenance of utilization certificates, audit reports, expenditure statements and event information which would be open to access on demand by MDHR or Comptroller and Auditor General of India.</p>
<p style="text-align: justify; ">A. Objectives <br />In order to fulfil the objectives mentioned in the scheme document, IIT, Kharagpur undertook following activities:<br />a. Conducting multiple workshops over the years to further the training of teachers as well as at a student level<br />b. Hosting numerous conclaves on the subject of IPR and their relation to business <br />c. Providing short term course on training of teachers in the field of IPR<br />d. <b>This post provides a factual description about the operation of Ministry of Human Resource Development IPR Chair’s Intellectual Property Education, Research and Public Outreach (IPERPO) scheme in the West Bengal National University of Juridical Sciences.</b>
<p style="text-align: justify; ">The author has analysed all the data received under various heads such as income, grants from MHRD, planned and non-planned expenditure, nature and frequency of programmes organised and the allocation of funds for the same. Throughout the course of observation and presentation of the analysed data, the author seeks to trace the presence of unjustified underutilisation of funds by the aforementioned university as provided by the MHRD during the period of 2013-2014.</p>

<b>The Kannada-language Wikipedia, arguably the largest online encyclopedia in Kannada language, celebrated its 13th anniversary on February 14, 2016 in Mangalore.</b>
<p id="docs-internal-guid-f8142534-c87e-3859-9966-b4739a2a351e" dir="ltr">To celebrate the journey of the project and the community, Kannada Wikipedians gathered at St. Aloysius College Mangalore, Karnataka. The larger Kannada Wikimedia community including long time Wikipedians and new members like the students, faculty involved in <a href="https://outreach.wikimedia.org/wiki/Education">Wikipedia Education Programs</a> gathered, participated in a day long edit-a-thon and chalked out plans for the future. The event is organised by the Kannada Wikimedia community and Dr. Vishwanatha Badikana, Wikipedian and Assistant Professor of Kannada department at St. Aloysius College coordinated the event locally.</p>
<p dir="ltr">117 people gathered in the event out of which 96 were active editors of the Kannada Wikipedia community. Noted Kannada-computing researcher Kinnikambla Padmanabha Rao (widely known as KP Rao) addressed the public event and engaged with the audience about defining Kannada Wikipedia’s role a large role in widening Kannada’s presence on the Internet. The local organisers also took the event participants through a heritage walk in the heritage village of Pilikula Nisarga Dhama, an open library of the rich cultural heritage of Karnataka. The heritage walk resulted in over 300 image uploads on Wikimedia Commons ranging from the life and culture of coastal Karnataka to select rich heritage of the state. 20 new editors also participated in the event and they were oriented on basics of Wikipedia editing and <a href="https://creativecommons.org/licenses/">Creative Commons licenses</a>.</p>
<p dir="ltr">Triveni.K, one of the participants who is now pursuing her MSc. at Christ University, explains this event as a great learning platform for even core Wikipedia policies in details apart from many other Wikipedia policies she learnt here. “I’m little occupied for my exams but when it is over, I will be back on Wikipedia”, shares Triveni.</p>
<p dir="ltr">Prior to the event, four edit-a-thons were organised in four different cities of Karnataka. Themes chosen for the cities were <a href="https://en.wikipedia.org/wiki/Kannada_literature">Kannada literature</a> in Mysore, Mechanical Engineering in Sagara, Science-related articles in Bangalore and article on notable female of the coastal Karnataka region in Mangalore. Follow up edit-a-thons were organised after the anniversary celebration with the same themes that were there in the previous session for the first three places where the follow up edit-a-thons in St. Aloysius College and St. Agnes College were both on medicinal plants.</p>
<p dir="ltr">The<a href="https://kn.wikipedia.org/wiki/?diff=1"> first ever edit</a> on Kannada Wikipedia was made on 12 June 2003 with a message “Kannada Vishwa Koshakke Suswaagatha!” (meaning “Welcome to the Kannada encyclopedia” in Kannada). However it took over a year -- on July 12, 2004 the first article about a city<a href="https://en.wikipedia.org/wiki/Shimoga"> Shimoga</a><a href="https://kn.wikipedia.org/w/index.php?title=%E0%B2%B6%E0%B2%BF%E0%B2%B5%E0%B2%AE%E0%B3%8A%E0%B2%97%E0%B3%8D%E0%B2%97&oldid=1463"> was created</a>. Over the last decade Kannada Wikipedia has been a great gamechanger for the<a href="https://en.wikipedia.org/wiki/Kannada"> Kannada language</a> where the Wikipedians have played a great role in making it a household name -- needless to say that <a href="https://commons.wikimedia.org/wiki/File:Kannada_Wikipedia_stats_%28December_2015%29.png">705,199 unique visitors</a> read the articles every month as per the December 2015 statistics. The annual average of active editors for last year was 48, 91 (February) being the highest and 22 (May) the lowest and 80 being the count in last December. The peaks and valleys also signify that major outreach like<a href="https://outreach.wikimedia.org/wiki/Education/Countries/India/Christ_University/CUWEP2015_NOVEMBER"> Wikipedia Education Program at Christ University Bengaluru</a> could have boosted the total number of editors during the months when the program was being rolled out. The project since its inception has gone through many ups and downs over time, the major one being a small community to edit and curate such a high level task of creating new articles in Kannada, editing and enriching them with more information and citations, and cleaning up many articles. The biggest hurdle, as<a href="http://www.hpnadig.net/blog/2011/10/22/how-google-irreparably-wounded-kannada-wikipedia/755"> explained</a> by Wikimedian<a href="https://kn.wikipedia.org/wiki/User:HPNadig"> Hari Prasad Nadig</a>, has been cleaning up the articles created by paid translations of Google when Kannada Wikipedia along with many other Indian language Wikipedias were used as testing grounds for improving<a href="http://translate.google.com/"> Google Translate</a>, a multilingual machine translation tool.<a href="https://kn.wikipedia.org/wiki/User:VASANTH_S.N."> Vasanth S.N.</a>, a Kannada Wikipedian who has cleaned up over 60 such articles prefers to use an existing good quality encyclopedia like the 14 volume Kannada Vishwakosha, published by Mysore University and<a href="http://cis-india.org/openness/blog-old/university-of-mysore-releases-kannada-vishwakosha-under-cc-license"> relicensed</a> under<a href="https://creativecommons.org/licenses/by-sa/3.0/us/"> CC-BY-SA 3.0</a> by the university, as a resource to create and improve articles.</p>

<b>This post provides a factual description about the operation of Ministry of Human Resource Development IPR Chair’s Intellectual Property Education, Research and Public Outreach (IPERPO) scheme in the National Law School of India University. </b>

<p style="text-align: justify; ">The author has analysed all the data received through which, the author seeks to trace the presence of unjustified underutilisation of funds by the aforementioned university as provided by the MHRD during the period of 2013-2014. To collect the information for the given study, an RTI application was filed to NLSIU on 17/11/2014 by the Centre for Internet and Society. The reply to RTI application was received on 18/12/2014.</p>

<h3>Comparative Analysis between University Response and the guidelines of MHRD Scheme Document</h3>
<p style="text-align: justify; ">The Scheme Document of MHRD (http://copyright.gov.in/Documents/scheme.pdf) is a comprehensive document which consists of guidelines regarding Intellectual Property Education, Research and Public Outreach. It talks about a list of objectives, purposes, conditions and eligibility criteria for a University to ensure in order to implement IPERPO in a truest sense. This document provides the procedural as well as qualifying conditions for an Institute to ensure or fulfil before applying for the MHRD grant. Some of these conditions include maintenance of utilization certificates, audit reports, expenditure statements and event information which would be open to access on demand by MDHR or Comptroller and Auditor General of India.</p>
<p>A. Objectives <br /> In order to fulfil the objectives mentioned in the scheme document, NLSIU undertook following activities:</p>

<li>Introduction of UG and PG level courses on IPR</li>
<li>Introduction of PhD fellowships in the field of IPR.</li>
<li>Conducting multiple workshops over the years to further the training of teachers as well as at a student level</li>
<li>Hosting numerous conclaves on the subject of IPR and their relation to business </li>
<li>Providing short term course on training of teachers in the field of IPR</li>
<li>Held various symposiums, seminars and conferences for the furtherance of IPR</li>
<li>Invited esteemed professors from the field for guest lectures</li>
<li>Established an IPR library in the IPR cell</li>
<li>Website on IPR launched</li>

<p>B. Eligibility <br /> NLSIU is recognized by the University Grants Commission. Therefore, it fulfils the eligibility criteria mentioned in the scheme document.</p>

<b>The Centre for Internet & Society (CIS-A2K) team is organizing the Train the Trainer programme at its office in Bengaluru from June 15 to 17, 2016. </b>
<p style="text-align: justify; ">After two successful iterations of Train the Trainer in 2013 and 2015, CIS-A2K is planning to organize the third iteration of the program. The exact dates and venue of the event have not been decided still, but like our previous iterations, this year also be a 3-days' residential program.</p>
<h3 style="text-align: justify; ">What's new in TTT 2016</h3>
<ul style="text-align: justify; ">
<li style="text-align: justify; "><strong>Extensive feedback gathering:</strong> The planning of TTT 2016 started in mid-April when we started contacting TTT 2015 participants for their ideas and suggestions to design this year's Train-the-Trainer program. We asked them a number of questions such as "what could be improved in the last TTT?, how can be improve this year's TTT etc." We'll reach mailing lists and village pumps for for further inputs. Based on all these suggestions and feedback, this year's TTT will be designed.</li>
<li style="text-align: justify; "><strong>MWT session:</strong> Based on the feedback we have received, it seems the participants are interested to learn some topics which were previously discussed during MWT. So, MWT sessions many be included in this year's program.</li>
</ul>
<h3 style="text-align: justify; ">Registration</h3>
<p style="text-align: justify; "><strong>Note:</strong> Participants will be selected based on their on wiki and off wiki activities and their responses to the questions asked in the Google form. <b>The Kannada-language Wikipedia celebrated its 13th anniversary on February 14 in Mangalore. To celebrate the journey of the project and the community, Kannada Wikipedians gathered at Saint Aloysius College, Mangaluru on May 14. </b>

<p style="text-align: justify;">The larger community including long-time Wikipedians and new members like the students faculty involved in Wikipedia Education Programs gathered to participate in a day long edit-a-thon and chalk out plans for the future. The event was organised by the Kannada Wikimedia community and Dr. Vishwanatha Badikana, Wikipedian and Assistant Professor of Kannada department at St. Aloysius College, who coordinated the event locally.</p>
<p style="text-align: justify;">Prior to the event, four edit-a-thons were organised in four different cities of Karnataka. The local organisers also took the participants through a heritage walk in the village of Pilikula Nisarga Dhama, an open library of the rich cultural heritage of Karnataka. <p style="text-align: justify;">117 people gathered at the event out of which 96 were active editors of the Kannada Wikipedia to celebrate thirteen years of <strong><a href="https://kn.wikipedia.org/" rel="nofollow" target="_blank">Kannada Wikipedia</a></strong>, arguably the largest online encyclopedia in <strong><a href="https://en.wikipedia.org/wiki/Kannada" rel="nofollow" target="_blank"><strong>Kannada</strong> language</a></strong>. Noted Kannada-computing researcher Kinnikambla Padmanabha Rao (widely known as KP Rao) addressed the public event and engaged with the audience about defining Kannada Wikipedia’s large role in widening the language’s presence on the internet. The heritage walk resulted in over 300 image uploads on Wikimedia Commons ranging from the life and culture of coastal Karnataka to select rich heritage of the state. 20 new editors also participated in the event and they were oriented on basics of Wikipedia editing and <strong><a href="https://creativecommons.org/licenses/" rel="nofollow" target="_blank">Creative Commons licenses</a></strong>.</p>

<p>Triveni K, one of the participants who is now pursuing her M.Sc at Christ University, called this event a great learning platform for learning core Wikipedia policies in detail. “I’m little occupied for my exams but when it is over, I will be back on Wikipedia”, shares Triveni.</p>
<p>The <strong><a href="https://kn.wikipedia.org/wiki/?diff=1" rel="nofollow" target="_blank">first ever edit</a></strong> on Kannada Wikipedia was made on June 12, 2003 with a message saying “Kannada Vishwa Koshakke Suswaagatha!” (meaning ‘Welcome to the Kannada encyclopedia’). However it took over a year, July 12, 2004, before the first article, about a city <strong><a href="https://en.wikipedia.org/wiki/Shimoga" rel="nofollow" target="_blank">Shimoga</a></strong>, was created. Over the last decade, Kannada Wikipedia has been a great gamechanger for the<strong><a href="https://en.wikipedia.org/wiki/Kannada" rel="nofollow" target="_blank">Kannada language</a></strong> where the Wikipedians have played a great role in making it a household name. <strong><a href="https://commons.wikimedia.org/wiki/File:Kannada_Wikipedia_stats_%28December_2015%29.png" rel="nofollow" target="_blank">7,05,199 unique visitors</a></strong> read the articles every month as per the December 2015 statistics. The annual average of active editors for last year was 48, 91 (in February) being the highest, 22 (in May) the lowest and 80 being the count in December 2015. The peaks and valleys also signify that major outreach like <strong><a href="https://outreach.wikimedia.org/wiki/Education/Countries/India/Christ_University/CUWEP2015_NOVEMBER" rel="nofollow" target="_blank">Wikipedia Education Program at Christ University, Bengaluru</a></strong> could have boosted the total number of editors during the months when the program was being rolled out. The project since its inception has gone through many ups and downs over time, the major one being a small community to edit and curate such a high level task of creating new articles in Kannada, editing and enriching them with more information and citations, and cleaning up many articles. The biggest hurdle, as <strong><a href="http://www.hpnadig.net/blog/2011/10/22/how-google-irreparably-wounded-kannada-wikipedia/755" rel="nofollow" target="_blank">explained</a></strong> by Wikimedian <strong><a href="https://kn.wikipedia.org/wiki/User:HPNadig" rel="nofollow" target="_blank">Hari Prasad Nadig</a></strong>, has been cleaning up the articles created by paid translations of Google when Kannada Wikipedia along with many other Indian language Wikipedias was used as testing ground for improving <strong><a href="http://translate.google.com/" rel="nofollow" target="_blank">Google Translate</a></strong>, a multilingual machine translation tool. <strong><a href="https://kn.wikipedia.org/wiki/User:VASANTH_S.N." rel="nofollow" target="_blank">Vasanth SN</a></strong>, a Kannada Wikipedian who has cleaned up over 60 such articles, prefers to use an existing good quality encyclopedia like the 14 volume Kannada Vishwakosha published by Mysore University and <strong><a href="http://cis-india.org/openness/blog-old/university-of-mysore-releases-kannada-vishwakosha-under-cc-license" rel="nofollow" target="_blank">relicensed</a></strong> under <strong><a href="https://creativecommons.org/licenses/by-sa/3.0/us/" rel="nofollow" target="_blank">CC-BY-SA 3.0</a></strong> by the university, as a resource to create and improve articles.</p>

<p style="text-align: justify; ">This was a specific conference dedicated to Make in India especially Mobile, Telecom and role of Competition v/s IPR. The speakers were from CCI, Industry and Legal luminaries. There is a need to arrive at balance between Competition and IPR. The conference was aimed to address the issues of IPRs v/s competition, role of SSO in standard settings, SEP’s contentions, basis of FRAND negotiations and need to recommend to Government to form an appropriate policy that is suitable for Make in India.</p>
<p style="text-align: justify; ">The conference focused on the need to discuss these issues with all the stakeholders and come out with appropriate status on the date and its relevance on Make in India and appropriate recommendations to the government. <b>As an erstwhile journalist covering electronics technologies and IT a few years ago, I was privy to a litany of manufacturers' woes and their causes: Tangled tax laws and regulations, red tape, corruption, licence raj, unreliable infrastructure such as power and roads, and lack of skilled labour.</b>

<p style="text-align: justify; ">Unlike China, which raked in profits by keeping margins low and volumes high, every entity in the supply and distribution chain in India wanted a 30 per cent cut. India, they said, was no country for manufacturers. The only real electronics manufacturing was that of low-end or low-precision products. Where the products were of higher quality, they were merely assembled in India, often with the intent of circumventing taxes and of employing cheap labour.</p>
<p style="text-align: justify; ">Walking around the IT and Electronics pavilion at the Make in India Week in Mumbai early this year, I could see that not much has changed. As if symbolic of the scenario, there was one Indian company. The rest were MNCs based in Taiwan, China, Sweden, Japan, the US, and Germany. The push for indigenous manufacturing is nevertheless apparent from the flurry of proposed incentives, large infrastructural investments, and facilities made available to manufacturers and new entrepreneurs by the government. The Make in India mix, however, needs more than subsidies, tax waivers, reimbursement of duties, or monetary grants.</p>
<p style="text-align: justify; ">A pet peeve of brand owners and manufacturers with large patent portfolios operating in India is that research and development (R&D) in the country largely happens only in public research institutions and universities. Indian firms don't invest in R&D and subsequently fill patents. A patenting landscaping exercise conducted by us at the Centre for Internet and Society last year showed that all Indian patents, nearly 4,000 in number, pertaining to mobile technologies are owned by non-Indian companies. Out of approximately 19,500 patent applications, a meagre 18 were filed by Indian companies.</p>
<p style="text-align: justify; ">India's premier educational institutions also apply for far less patents within the country and abroad than their foreign counterparts. For example, the National Academy of Inventors has published a list of "Top 100 worldwide universities granted US utility patents in 2013" and another in 2014. One Indian school features on these lists - the Indian Institute of Science (IISc) - with 21 patents in 2013. Within India, the IITs and IISc file up to 200 applications every year; MIT files nearly 4,000 in the US. Several large MNCs run R&D facilities in India, hiring some of the best talent in the country. The patents for their work are first registered to these companies abroad, contributing to royalty outflows. One way to correct the famine of locally owned intellectual property is for the government to urge top Indian companies and academic institutions to push the envelope in terms of R&D and patenting. A promising development is that the Indian government has pledged start-up funds. So have companies such as Qualcomm, which has committed $150 million to a strategic venture fund in India.</p>
<p style="text-align: justify; ">Another gripe is that the manufacturing units in India are in reality assembly lines that only put together imported parts and components and generally make copied products. While the government has provided sops to encourage actual manufacturing to truly reduce dependence on 'screwdriver technologies', it needs to incentivise foreign corporations operating in India to transfer their technology to Indian entities, instead of only assembling here using automated or human labour. Moreover, India-manufactured products are infamously substandard. These products need to pass quality checks if India aspires for an export market and leverage in asking for transfer of technology.</p>
<p style="text-align: justify; ">To benefit from the transfer of technology, the workforce needs to learn to use it and assimilate it in its work life. Despite the intake of students in engineering schools in India being more than that in the US and China put together, a major chunk of newly graduated engineers in India is unemployable. The repairmen at Nehru Place's electronics market learn the ropes through an informal education system comprising their friends, peers and employers in small-time garage shops. Rookie engineers who secure the holy grail of college placement are trained from scratch by their employers, such as Infosys with its plush training campus located in Mysore. In either case, the employer is saddled with training new recruits. There is little in terms of professional excellence that institutions of formal education seem to impart. Prime Minister Modi believes that Indias human power would be among its largest exports by 2030, but monikers such as "coding coolies" only point to low valuation of its services. Unless quality vocational education produces professionals in different rungs of the manufacturing ecosystem - from technicians to production personnel to designers to ideators - manufacturing in the country will stay deprived of the benefits of the newest technologies.</p>
<p style="text-align: justify; ">Next would come developing indigenous technologies (governed by technical standards and otherwise) in order to reduce dependence on technologies owned by foreign rights holders. India's remote sensing capabilities are among the best in the world. Like GPS developed by the US and GLONASS by Russia, NAVIC is Indias own satellite navigation system. Where GPS in India becomes spotty or inaccurate, NAVIC is likely to be much more reliable and accurate. Mobile handsets sold in India are not equipped yet with the receivers needed to work with NAVIC. When they are, it will be a fillip for both manufacturing and location-based services in the country. There is also a need for diffusion of these technologies. India's public research organisations produce several potentially life-changing inventions, which unfortunately, almost never reach mass implementation.</p>
<p style="text-align: justify; ">With the emergence of new technologies comes a greater need for access to patenting. A patent is a monopoly granted to its owner for 20 years in return for publicly disclosing an invention. Without the ability to enforce it, such a monopoly is not of much use. Patenting is also expensive and time-consuming, especially for an individual innovator without the backing of an employer that has the wherewithal for it. Many opt for filing patents via large companies while retaining their names as the inventors. The company thus owns the patent. Small manufacturers without the resources to apply for a patent prefer to zealously guard their inventions. Instead of risking their unpatented inventions being stolen, they limit their use to their own establishments, and sometimes take the inventions with them to the grave.</p>
<p style="text-align: justify; ">Make in India was unveiled at a time when manufacturing worldwide was starting to experience the ongoing slump. China, so difficult to beat at its own game, has been facing the heat. There is a tiny window of opportunity for India, which may be akin to the guns made by Indian Ordnance Factories (IoF). These guns - exorbitantly priced and of low build quality - are notorious for backfiring. In the truly Indian spirit of jugaad, they are taken to gunsmiths by their buyers for big and small tweaks that would prevent unfortunate endings. Like the IoF guns, the Make in India recipe needs its own set of tweaks.</p>
