WIPO to Convene a Diplomatic Conference in Morocco to Finalise TVI

<b>In a landmark development, on December 18, 2012, the Extraordinary General Assembly of the World Intellectual Property Organisation agreed to convene a diplomatic conference, likely to be in Morocco, in June of next year to finalise the Treaty for Visually Impaired Persons/Persons with Print Disabilities.</b>
<p style="text-align: justify; ">This comes about five years after a team of about ten of us sat down in the offices of <a href="http://keionline.org/">Knowledge Ecology International</a> in Washington D.C. to draft the first cut of the Treaty.</p>
<p style="text-align: justify; ">Even as late as December 17, it was uncertain as to whether the outcome would be positive, particularly as the United States was fixated on the word "instrument" and not "treaty". At one point during the EGA it was rumored that the US and the EU were insisting on a "kill switch" in the decision document of the Extraordinary General Assembly. Essentially the US and the EU were apparently pushing for wording in the decision text stating that if the text of the Treaty was not fully agreed by the end of the upcoming WIPO Standing Committee on Copyright and Related Rights in February, then the diplomatic conference was off. Luckily none of this type of wording was reflected in the decision of the EGA. The EU was insisting on a non-binding instrument as opposed to a treaty till November this year when they finally capitulated due to the extensive pressure applied internally by blind groups such as the European Blind Union and the Royal National Institute of Blind People in the United Kingdom.</p>
<p style="text-align: justify; ">However, it is not smooth sailing from here on since there are still some very critical issues to be resolved in the text of the Treaty. Possibly the most critical issue from the perspective of blind groups is the outstanding issue of commercial availability. The European Union and the United States insist that the Treaty should apply only when works in accessible formats such as Braille or <a href="http://en.wikipedia.org/wiki/DAISY_Digital_Talking_Book">Daisy</a> are not commercially available. The contentious provision in the Treaty in relation to export of accessible format copies is the following: "The Member State/Contracting Party may limit said distribution or making available of published works which, in the applicable accessible format, cannot be otherwise obtained within a reasonable time and at a reasonable price, in the country of importation." There is also a similar clause with respect to national exceptions as well.</p>
<p style="text-align: justify; ">The problem that we have with this clause is that it places the burden on exporting organizations to determine, prior to export, whether a work is available in an accessible format in the importing country within a "reasonable time" and "reasonable price". In reality, this will be impossible for organizations to verify this position with any degree of certainty without spending substantial amounts of money or dedicating significant resources for this. As a result the organizations will not export accessible format copies because they are nervous about copyright violation thereby meaning that the treaty will not be used in reality. Obviously from our perspective there is no point in having a treaty which cannot be used to benefit the millions of persons with visual impairment.</p>
<p style="text-align: justify; ">Another outstanding issue that is crucial to us is that a beneficiary (such as a visually impaired person) in one country should be able to import accessible format copies directly from organizations abroad. The European Union does not want to permit this and insists that export and import should only be between organizations. The position of the European Union will be counterproductive because it will add too much burden on organizations in developing countries to serve their disabled populations.</p>
<p style="text-align: justify; ">We get the opportunity to fix these issues during the next session of the Standing Committee meeting in February 2013. If required there could another session called to sort out text related issues before the diplomatic conference in June.</p>
<p style="text-align: justify; ">Ultimately, the success or failure of the Treaty will boil down to whether the US and the EU actually end up ratifying the Treaty. After all, they have the largest collections of material in accessible formats which we need to import into India. The <a href="http://www.hathitrust.org/">Hathi Trust</a> in the United States has approximately 10 million books in accessible formats which will be invaluable for the visually impaired community in India. Given the recent rejection of the United States of the <a href="http://www.huffingtonpost.com/human-rights-watch/us-senate-misses-opportun_b_2244885.html">United Nations Convention on the Rights of Persons with Disabilities</a> it remains to be seen what the future holds.</p>

<b>The National Resource Kit team is pleased to bring you its research on the state of laws, policies and programmes for persons with disabilities in the state of Puducherry.</b>
<h3>Executive Summary</h3>
<p style="text-align: justify; ">The union territory of Puducherry has not passed any legislation for persons with disabilities but implements the provisions under the central laws. The benefits that are currently being offered to persons with disabilities include educational scholarships and social protection programmes that provide financial assistance, aids and appliances and subsidised fuel among others. The government currently implements around 21 schemes for persons with disabilities.</p>

<h3>Legal Provisions</h3>
<p style="text-align: justify; ">The union territory of Puducherry has not passed any special legislation for persons with disabilities but implements the provisions under the three central laws:</p>

<li style="text-align: justify; ">National Trust for Persons with Cerebral Palsy, Autism, Mental Retardation and Multiple Disabilities Act 1999</li>
<li style="text-align: justify; ">Rehabilitation Council of India Act 1992</li>
</ul>
<p style="text-align: justify; ">Puducherry implements various schemes for the welfare of persons with disabilities that are listed below in various categories:</p>
<h3 style="text-align: justify; ">Education</h3>
<p>The government offers scholarships to eligible students with disabilities in the following categories:</p>

<p>Students with disabilities applying for the scholarships should fulfil the following conditions:</p>
<ul>
<li style="text-align: justify; ">Total income of the family should not be more than Rs. 35,000 per annum</li>
<li style="text-align: justify; ">Extent of disabilities of applicants should be 40 per cent or more</li>
<li style="text-align: justify; ">Applicants should not be less than five years of age and should have resided in Puducherry for not less than five years.</li>
</ul>
<h3 style="text-align: justify; ">Social Protection</h3>
<p style="text-align: justify; ">The government offers annual state awards in recognition of persons with disabilities and services rendered to them. An award of Rs. 10,000 is offered to one outstanding employee with disability in either government or private employment or a person who is self employed. An award of Rs. 15,000 is given to an individual serving the cause of persons with disabilities. An award of Rs. 25,000 is given to an institute serving the cause of persons with disabilities. The awards are given subject to selection by a state level committee. Persons with disabilities selected for awards should have a minimum of 40 per cent disability.</p>
<p style="text-align: justify; ">Persons with disabilities who are employees of the government are covered by a group insurance scheme. In case of death of any employee with disability due to an accident while in service, the sum insured would be paid to the family of the deceased employee as follows:</p>

<p style="text-align: justify; ">Employees of the government with 40 per cent or more disability are covered under this scheme.</p>
<p style="text-align: justify; ">Persons with disabilities who are not employees of the Puducherry government are covered under the Insurance Scheme for Persons with Disabilities other than the employees of the Government of Puducherry 2004. In case of death of the disabled person due to an accident, an amount of Rs. 25,000 is paid to the family. In case of loss of one limb or one eye, an amount of Rs. 12,500 is paid to the person. The policy covers persons with disabilities in the age group of five to 74 years with disability of 40 per cent or more and who are residents of Puducherry for not less than five years.</p>
<p style="text-align: justify; ">The government of Puducherry issues identity cards to persons with disabilities for ready reference to avail the benefits of welfare schemes. Persons with disability of not less than 40 per cent and whose total income does not exceed Rs. 35,000 per annum are eligible to apply for identity cards.</p>
<p style="text-align: justify; ">The government provides marriage grant for persons with disabilities. For marriage between a disabled person and a non disabled person, a grant of Rs. 25,000 is provided, of which Rs. 5000 is given in cash and Rs. 20,000 is given in the form of National Savings Certificate. For marriage between persons with disabilities, a grant of Rs. 50,000 is given. Of this, Rs. 20,000 is paid in cash and Rs. 30,000 is given in the form of National Savings Certificate. Persons with disabilities applying for this grant should fulfil the following eligibility criteria:</p>
<ul>
<li>Total income should not exceed Rs. 35,000 per annum</li>
<li>Should be above the age of 18 years (in case of women) and 21 years (in case of men).</li>
<li>Extent of disability should be 40 per cent or above</li>
<li>Should be the first marriage of the applicant</li>
<li>Marriage should be registered with the registrar</li>
<li>Should be a resident of the union territory of Puducherry</li>
<li>Application for the grant should be made within 120 days of the marriage</li>
</ul>
<p style="text-align: justify; ">The government of Puducherry implements a scheme to provide subsidy on fuel to persons with disabilities who own motorised vehicles. The scheme provides 50 per cent subsidy on fuel to a maximum of 25 litres per month. Applicants who fulfil the following eligibility criteria are eligible to apply:</p>
<ul>
<li>Total income should not exceed Rs. 35,000 per annum</li>
<li>Extent of disability should be 40 per cent or more</li>
<li>Applicant should have resided in Puducherry for more than five years</li>
<li>The vehicle should be registered in the name of the applicant</li>
<li>Applicant should have a valid driver’s licence</li>
</ul>
<p style="text-align: justify; ">The government of Puducherry grants financial assistance to persons with disabilities. Persons whose extent of disabilities are between 40 percent and 65 per cent are eligible for a grant of Rs. 1100 per month, those with disabilities between 66 per cent and 85 per cent are eligible for a grant of Rs. 1400 per month and persons with more than 86 per cent disabilities are eligible for a grant of Rs. 1750 per month. Persons applying for financial assistance should not have income exceeding Rs. 35,000 per annum and should have resided in Puducherry for not less than five years. Extent of disabilities for visually impaired, orthopedically disabled and hearing and speech impaired should be 40 per cent or more and those with mental disabilities should have an IQ less than 69 to be eligible to apply.</p>
<p style="text-align: justify; ">The government offers reimbursement for maintenance of tricycles for persons with disabilities. A grant of Rs. 200 per annum is offered to persons who fulfil the following criteria:</p>
<ul>
<li>Extent of disability should be 40 per cent or more</li>
<li>Applicant should have resided in Puducherry for not less than five years</li>
<li>Tricycle should have been supplied by the Department or NGO free of cost</li>
<li>Applicant should produce the bill for repair charges issued in their name</li>
</ul>
<p style="text-align: justify; ">The government supplies motorised tricycles free of cost to persons with locomotor disability affecting the lower limbs. The disability should be not less than 65 per cent. Total annual income of the applicant’s family should not exceed Rs. 35,000. Applicant should have resided in Puducherry for not less than five years. The applicant should be certified by the concerned medical authority that he or she is able to operate the motorised vehicle. The applicant should not be in receipt of transport allowance for conveyance from the department or any other source. The applicant should be in gainful employment or be pursuing higher studies.</p>
<p style="text-align: justify; ">Persons with disabilities are provided aids and appliances such as callipers, crutches, tricycles, hearing aids, spectacles and low vision aids by the government upon the advice of the specialists concerned attached to government general hospitals at Puducherry, Karaikal, Mahe and Yanam. Persons applying for these appliances should have an income not exceeding Rs. 24,000 per annum, should have resided in Puducherry for not less than five years and the extent of their disability should be 40 per cent or more.</p>
<p style="text-align: justify; ">The government provides free bus passes to persons with disabilities for travelling within the union territory. Persons with at least 40 per cent disabilities, who are residents of Puducherry for not less than five years and whose annual income does not exceed Rs. 35,000 are eligible to apply for the free bus passes.</p>
<p style="text-align: justify; ">Persons with disabilities are eligible to receive Rs. 100 per month through Anganwadi centres towards transport allowance. Persons applying for the allowance should fulfil the following eligibility criteria:</p>
<ul>
<li>Total income should not exceed Rs. 35,000 per annum</li>
<li>Should be above five years of age</li>
<li>Extent of disability should be 40 per cent or more</li>
<li>Should not have any formal educational qualification</li>
<li>Should have resided in Puducherry for not less than five years</li>
</ul>
<p style="text-align: justify; ">If the applicant is in possession of free bus pass, he or she should surrender the same to the Directorate of Social Welfare. Applicant should also declare in the application form whether he or she would prefer to avail the transport allowance or the free bus pass.</p>
<p style="text-align: justify; ">Organisations working for the welfare of persons with disabilities are eligible to received musical and sports equipment from the government. Organisations must be registered to be eligible for this scheme.</p>
<p style="text-align: justify; ">Persons with visual impairment are eligible to receive a radio from the government. Applicants must meet the following eligibility criteria:</p>
<ul>
<li>Income should not exceed Rs. 35,000 per annum</li>
<li>Extent of disability should be 40 per cent or more</li>
<li>Should have been a resident of Puducherry for not less than five years</li>
</ul>
<p style="text-align: justify; ">Persons with disabilities are provided sarees and dhotis during Deepavali and other regional festivals. Persons wishing to benefit from the scheme should have at least 40 per cent disability, should have resided in Puducherry for not less than five years and should have registered themselves with the local Anganwadi centres.</p>
<p style="text-align: justify; ">The government of Puducherry conducts a free annual tour for persons with disabilities to places of interest. Participants are selected for the tour conditionally upon meeting the following eligibility criteria:</p>
<ul>
<li>Should be in the age group of 18 to 50 years</li>
<li>Extent of disability should be 40 per cent or more</li>
<li>Should not be a government employee or child of a government employee</li>
<li>Income should not exceed Rs. 35,000 per annum</li>
<li>Should not have attended the tour in the past ten years</li>
<li>Should not suffer from any contagious diseases</li>
<li>Should have registered their names in the local Anganwadi centres</li>
</ul>
<p style="text-align: justify; ">The government of Puducherry celebrates the International Day for Persons with Disabilities on the 3rd of December every year with activities and games.</p>
<p style="text-align: justify; ">Puducherry implements the Perunthalaivar Karmaveerar Kamaraj scheme towards funeral expenses of persons with disabilities. A grant of Rs. 2000 is given for the funeral expenses of persons with at least 40 per cent disability who have resided in Puducherry for not less than five years and whose income was less than Rs. 35,000 per annum. The grant is paid to the family member under whose care the deceased person was living at the time of his or her death.</p>
<h3 style="text-align: justify; ">Miscellaneous</h3>
<p style="text-align: justify; ">Puducherry offers cash incentive to eye donors to encourage eye donation. An incentive of Rs. 10,000 is awarded to a close relative of the donor. Donors should be 18 years of age or older to be eligible. Donors should have resided in Puducherry for not less than five years. The incentive can be claimed by a close relative only after the transplantation is completed. The incentive can be claimed only upto 90 days after the transplantation.</p>

<p style="text-align: justify; ">The Centre for Internet and Society (CIS) was one of the organizations whose experiences, views, recommendations and proposals went into the making of this report. CIS name is mentioned in Annex 1 on page 57.</p>
<p style="text-align: justify; ">The report demonstrates how Information and Communication Technologies (ICT), have become a positive force of transformation and a crucial element of any personal development, empowerment and institutional framework for inclusive development.</p>
<p style="text-align: justify; ">While the Millennium Development Goals (MDGs) represent a concerted effort to address global poverty, there is a striking gap in the current MDGs and their inclusion of persons with disabilities. The estimated 1 billion persons with disabilities are still excluded from equitable access to resources (education, healthcare, etc.) and as a result persons with disabilities experience disproportionately high rates of poverty. In spite of the conclusion of the Convention on the Rights of Persons with Disabilities in 2006, disability remains largely invisible in most mainstream development processes.</p>

<b>The Centre for Internet & Society (CIS) submitted comments for the consideration of the Department of Empowerment of Persons with Disabilities (DEPD) on the Vision Document 2030 brought out earlier this month.</b>
<p style="text-align: justify; ">We appreciate the efforts by the Department of Empowerment of Persons with Disabilities (DEPD) to put together a vision and strategy document to inform and direct the implementation of the new Rights of Persons with Disabilities Act, 2016 (RPWD), and give effect to the rights of persons with disabilities as enshrined in various international treaties.</p>
<p style="text-align: justify; ">Overall, we recommend that the vision articulate more clearly in terms of quantifiable targets what it seeks to achieve at different points of time and that these targets, while taking into account the realistic situation in our country, are not so minimally set as to undermine the aims of the Act and the national commitments outlined therein.</p>
<p style="text-align: justify; ">We submit that it be kept in mind that this is not the first time that a national conversation has taken place around accessibility and standards, and that many previous attempts such as the Guidelines on Indian Government Websites (GIGW) have been in existence for nearly 8 years.</p>
<p style="text-align: justify; ">Therefore, we submit that the steps taken towards implementing this act should be more ambitious, and should seek to resolve the issue within the next 2-3 years. Accordingly please find our brief comments below:</p>
<h3 style="text-align: justify; ">Background</h3>
<ol>
<li style="text-align: justify; ">Section 2(i) is as follows: Vision: ‘To build an inclusive society in which equal opportunities are provided for the growth and development of Persons with Disabilities so that they can lead productive, safe and dignified lives.’ We propose the addition of the word ‘integration/inclusion/assimilation’ as in the phrase ‘growth, integration and development’, since that implies social acceptance, which is crucial. We also propose the addition of one more sentence as follows: ‘To enable access to technology and technology enabled resources for every person with a disability to facilitate effective communication and integration in society, as well as to ensure that accessibility considerations and standards are included across the board in all government programmes and initiatives.’</li>
<li style="text-align: justify; ">We propose in 3(a) - the inclusion of the word technologies in the phrase ‘providing appropriate aids and appliances.’ This is important since aids and appliances are not always technology-based and often times a new technology may be suitable, efficient and contemporary to address a specific need.</li>
<li>We propose in 3(b) - the inclusion of the word accessibility in the phrase ‘developing rehabilitation professionals/personnel.’</li>
</ol>
<h3 style="text-align: justify; ">Long Term Vision by 2030</h3>
<ol>
<li style="text-align: justify; ">Inclusion of curriculum related to e-accessibility such as knowledge of the Web Content Accessibility Guidelines (WCAG) and universal design principles in all institutes and institutions teaching courses in engineering, computer science, IT etc.</li>
<li>Inclusion of disability-related issues in the curriculum of university courses in other fields as well, such as law, sociology, economics, and architecture. </li>
<li style="text-align: justify; ">Creation of a mechanism to gather more comprehensive and accurate data on persons with disabilities, such as their levels of access to technologies, information and basic resources and amenities.</li>
<li style="text-align: justify; ">Provision of training to use computers for students and children with disabilities in rural areas and provide training to students receiving aids and appliances as part of schemes. In addition, the Government should also focus on providing appropriate training and access to appropriate content in order to make full use of these technologies.</li>
<p style="text-align: justify; "><br /><b>Seven Years' Strategy</b></p>
<li style="text-align: justify; ">The point about making documents, buildings, websites, documents etc. accessible under the Accessible India campaign <a href="#fn1" name="fr1">[1]</a> is appreciated; however, it should be accompanied with a mechanism for transparency and accountability. This should include periodic reports giving updates on the details of websites, documents, etc. taken up for retrofitting. At the moment, this information is not available on any of the public domain web sites such as the Accessible India campaign URLs, and repeated RTIs have failed to make this information available. Hence, there is no clarity on what the exact number of URLs and documents which have been made accessible so far is. Without accountability built into this procedure moving forward, there is very little to ensure that it happens.</li>
</ol>
<h3>Three Years Strategy</h3>
<ol>
<li style="text-align: justify; ">Review of legislations for persons with disabilities : we propose that a time line be set for this, say within 6 months and a list of existing and new policy/ legislation requiring interventions/ formulation be drawn up for action. Priority tasks could be to take up accessible procurement, accessibility of mobile applications, web sites and electronic documents.</li>
<li style="text-align: justify; ">One of the foremost tasks should be to identify and notify appropriate standards for different domains of accessibility such as procurement, electronic documents, television and so on, as well as reaffirm/ update any existing standards already recognized by the Government so that the process of retrofitting existing resources, as well as building new accessible ones commences at the earliest.</li>
<li style="text-align: justify; ">It is recommended that the Government of India put together an advisory committee of subject matter experts from NGOs and other civil society bodies who can advise on initiatives to be taken for environmental and information accessibility.</li>
<li style="text-align: justify; ">Regarding the plan for making 50% of all government web sites and documents accessible<a href="#fn2" name="fr2">[2] </a>, this target needs to be revised. The Accessible India campaign, which lists the same target in its strategy document,<a href="#fn3" name="fr3">[3] </a>has already been underway for the past one and a half years, and we hope that this target would have already been achieved under those efforts. Hence, if the Government sets a target of 50% over the next three years, this implies either that work has not been taking place thus far, or that very little will be done over that period of time. Furthermore, the RPWD Act requires all service providers to make their services accessible within 2 years of notification of regulation by the Central Government<a href="#fn4" name="fr4">[4]</a>, hence the time stipulated under the Act is much lesser than the vision is providing for and should be amended to making all web sites and documents accessible within 2 years. It may further be noted that the GIGW had been notified since 2009 and despite being in place for eight years, there is currently no official information on how many websites been made fully compliant with these standards. Therefore, we submit that a strict approach with regard to any deadlines and regulatory measures are necessary.</li>
<li style="text-align: justify; ">It is respectfully submitted that the number of 500 language interpreters<a href="#fn5" name="fr5">[5] </a> is simply not enough. This would work out to approximately 15 interpreters per state in 3 years, a number that we consider far too low for the time allotted. We submit instead that it is urgent that an attempt be made to train at least 30 people per state/UT per year, which would work out to 90 interpreters per state/UT over the 3-year period.</li>
<li style="text-align: justify; ">It is crucial the DEPD try to work with the Digital India campaign and the Smart Cities Mission to ensure that upcoming smart cities are born accessible. To this end, there needs to be specific measures to ensure that accessibility standards are part of the Terms of Reference and contracts for smart cities and that there is sufficient guidance and accountability for this.</li>

<li style="text-align: justify; ">Ting-Yi Chang wrote an article on the state of women editors in Wikipedia. In a <a class="external-link" href="http://cis-india.org/a2k/blogs/your-story-ting-yi-chang-february-7-2017-only-8.5-percent-of-wikipedia-editors-are-women-how-do-we-fix-the-gender-gap-on-the-internet">write-up published by Your Story</a> on February 7, Ting-Yi explored the reasons for the low percentage of women centric articles on the social media platform and how could the gender gap be bridged. </li>
<li style="text-align: justify; ">In a <a class="external-link" href="http://cis-india.org/internet-governance/files/digital-india-report.pdf">research paper</a> Anisha Gupta has assessed the privacy protections under 15 e-governance schemes. The paper analysed the schemes rolled out by the government, starting from 2010. </li>
<li style="text-align: justify; ">Amber Sinha, Vanya Rakesh and Vidushi Marda authored <a class="external-link" href="http://cis-india.org/internet-governance/files/big-data-compilation.pdf">a research paper</a> that has sought to understand the most effective way of researching Big Data in the Global South.</li>
<li style="text-align: justify; ">The <a class="external-link" href="http://cis-india.org/raw/irc17">second edition of the Internet Researchers' Conference</a>, an annual conference initiated by CIS to bring researchers, academicians and others on a common platform to share insights and chart the way foreword was held in Bengaluru. </li>
<li style="text-align: justify; ">Divij Joshi and Aditya Chawla in a report studied five Indian telecommunication companies and three Indian online service providers. <a class="external-link" href="http://cis-india.org/internet-governance/blog/ranking-digital-rights-in-india">The report has evaluated</a> the practices and policies of companies which provide internet infrastructure or internet services, and are integral intermediaries to the everyday experience of the internet in India.</li>
<li style="text-align: justify; ">General Data Protection Regulation (EU) 2016/679 was passed, which shall replace the present Data Protection Directive DPD 95/46/EC. This step is likely to impact the way of working for many organisations. In this light <a class="external-link" href="http://cis-india.org/internet-governance/blog/survey-on-data-protection-regime">CIS requests you to take part in a survey</a> aimed at understanding how various organisations view the changes in the Data Protection Regime in the European Union.</li>

The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.</p>

<h2 style="text-align: justify; ">Introduction</h2>
<p style="text-align: justify; ">We thank the Department of Empowerment of Persons with Disabilities (DEPD) for inviting comments on its draft rules. We provide brief comments on the Rules below. We would particularly like to draw the department’s attention to the need to have rules concerning measures relating to standards compliance, training and monitoring which we feel would help strengthen the Rules to address the issue of accessibility in a timely and effective manner.</p>
<h2 style="text-align: justify; ">Accessibility of the draft rules document</h2>
<p style="text-align: justify; ">At the outset, we would like to draw attention to the fact that the Rules when first published in PDF form were only partially accessible and not easily readable for persons using screen readers. We appreciate that at a later date, an accessible Word version was provided, however we feel that even the original PDF needs to conform to the <a href="https://helpx.adobe.com/acrobat/using/create-verify-pdf-accessibility.html">PDF/UA</a><a href="https://helpx.adobe.com/acrobat/using/create-verify-pdf-accessibility.html"> </a>standards.</p>
<h2 style="text-align: justify; ">Policy/Guidelines on accessible communication</h2>
<p style="text-align: justify; ">Following from the above point, we would like to propose that the DEPD publish at the earliest a set of guidelines for publishing accessible information and communication. The guidelines may define what constitutes information, explain how to create and disseminate accessible information and identify relevant accessibility standards. They may be applicable to all cases where printed or electronic information such as books, leaflets/ handbooks, mails, invoices, forms, data, policies and acts are created and communicated to diverse stakeholders. This guidelines may be mandatory across the Central and State Governments.</p>
<h2 style="text-align: justify; ">Reasonable Accommodation</h2>
<p style="text-align: justify; ">Rule 3(1) requires that every establishment take steps to provide reasonable accommodation. It may further be added that said measures towards reasonable accommodation be taken within a reasonable time frame, such that persons with disabilities are provided access to resources at the same time as others and not significantly later.</p>
<h2 style="text-align: justify; ">Standards and Guidelines</h2>
<ol style="text-align: justify; "> </ol>
<p style="text-align: justify; ">Standards are critical to implement accessibility, and it is important that we adopt the most updated globally recognised standards. To aid this endeavour, we recommend that the DEPD may appoint two experts who will primarily be responsible for implementing accessibility. Their tasks will involve identifying standards and policy requirements in different domains and coordinating with the relevant ministries to notify and implement the same. One expert may be responsible for environmental accessibility, while the other may be responsible for overseeing ICT accessibility. The experts may carry out the tasks of formulating strategies to implement accessibility compliance, as well as researching advances in international policies and standards and making recommendations to relevant Ministries.</p>
<ol style="text-align: justify; "> </ol> <ol style="text-align: justify; "> </ol>
<p style="text-align: justify; ">Regarding the Rules relating to the notification of standards for ICT accessibility (Rule 17.c.), we recommend that these may be expanded and made more comprehensive. To our understanding, some of the standards mentioned in relation to ICT accessibility such as telecasting and broadcasting do not as yet address the issue of accessibility. We recommend that the relevant ministries notify standards and guidelines to be followed in their regard at the earliest. There are also critical domains such as procurement, telecommunications and mobile devices, services and applications and emergency and disaster response for which standards and guidelines need to be notified.</p>

<p style="text-align: justify; ">We propose that the deadline for notification of standards be set within 6 months of the Rules coming into force and that the standards to be adopted are those which are globally followed, such as EN 301-549 for procurement.</p>
<ol style="text-align: justify; "> </ol>
<p style="text-align: justify; ">Past efforts have proven that the notification of guidelines alone does not necessarily result in the implementation of accessibility, and often times a web site or platform which has been made accessible, reverts to being inaccessible as time elapses and persons who are involved in updating it and maintaining are unaware of accessibility principles to be followed. Hence, each and every person developing, maintaining and updating a website should be familiar with accessibility core principles. Outsourcing accessibility compliance is a temporary solution, it will be rendered pointless as people continue to update the website and post new content that is inaccessible. Therefore, some level of training is an absolute necessity, although the specific level and nature of these trainings may vary based on the individual’s role in relation to the website. For example, a web developer would need more in depth training as compared to a communications or administrative officer whose role may be to upload documents to the web site. Creating accessible documents and communicating in an accessible manner is something which every government official should be able to do, while the needs of developers are more advanced and technical and may require two rounds of training. Each ministry and department at the Centre and state may allocate a certain portion of their budget towards this.</p>
<ol style="text-align: justify; "> </ol>
<p style="text-align: justify; ">An Accessibility specialisation unit may also be constituted within the NIC or any other appropriate agency whose task will be especially to provide on-going practical support to government agencies on how to implement accessibility across their web sites and publications. This team may work closely with the DEPD and other government agencies to audit, trouble shoot and guide continuous progress in implementing web site accessibility across the government.</p>
<ol style="text-align: justify; "> </ol>
<p style="text-align: justify; ">All Ministries and government agencies may be required to include a section on accessibility compliance and initiatives as part of their annual reporting. This report may also include their performance on expenditure relating to implementing accessibility, hiring employees with disabilities, trainings undertaken and affirmative action required to be taken by them as given in the RPWD Act 2016, such as steps towards incentivising affirmative action by the private sector and activities undertaken relating to Chapter VI, Chapter VII and Chapter VIII of the RPWD Act.</p>

<h2 style="text-align: justify; ">Training and Support</h2>
<h3 style="text-align: justify; ">Monitoring and reporting</h3>
<p style="text-align: justify; ">Regarding website accessibility, the DEPD may also consider taking up auditing web sites of government agencies at random from time to time and publish the reports periodically as a measure towards gauging progress. A comprehensive audit of all government web sites of both the Central and state government and applications may be undertaken every 3 years.</p>
<h2 style="text-align: justify; ">National fund</h2>
<p style="text-align: justify; ">Rule 43, relating to the Utilization of the National Fund is not clear on how much money is spent on accessibility initiatives each year. It is proposed that this rule specify the percentage of funds which have to be required to be utilised each year. In the absence of this, there is a concern that the fund will be under utilised, despite there being a large need for spending on accessibility. Details of projects and spending may be published from time to time.</p>
<h2 style="text-align: justify; ">Office of the Chief Commissioner</h2>
<p style="text-align: justify; ">The DEPD may require that at least one person of senior rank within the Office of the Chief Commissioner for Persons with Disabilities be a person with disability. This will ensure that the interests of the concerned group are directly represented at the highest level dedicated to ensuring their welfare and participation.</p>
<h2 style="text-align: justify; ">Transparency</h2>
<p style="text-align: justify; ">Finally we recommend that the rules emphasise the need for transparency in implementing the provisions of the Act and that all initiatives, programmes and expenditure may be published in a timely and accessible manner.</p>

<li style="text-align: justify; ">CIS along with like minded organizations <a class="external-link" href="http://cis-india.org/accessibility/blog/mobile-accessibility-practices">made a submission to the Government of India</a> to frame a feasible accessibility guidelines for mobile apps since there is no single standard in existence at the moment.</li>
<li style="text-align: justify; ">A <a class="external-link" href="http://cis-india.org/a2k/blogs/sambad-100-women-edit-a-thon">two-day 100 Women Edit-a-thon</a> was held in March 2017 by CIS-A2K team along with Odisha's biggest newspaper Sambad. The event was inspired by BBC’s 100 Women series and edit-a-thons with the same name in December 2016. More than 20 female journalists participated and registered as new Odia Wikipedians.</li>
<li style="text-align: justify; ">On March 31, 2017, the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training released a Circular framing rules under the Right to Information Act, 2005 (“RTI Rules”). The Ministry invited comments on on the RTI Rules. <a class="external-link" href="http://cis-india.org/openness/blog-old/comments-on-the-right-to-information-rules-2017">CIS submitted its comments</a>.</li>
<li style="text-align: justify; ">In an article originally published in <a class="external-link" href="http://cis-india.org/internet-governance/blog/the-hindu-businessline-march-31-2017-sunil-abraham-its-the-technology-stupid">Hindu Businessline</a> on March 31, Sunil Abraham lists out 11 reasons why Aadhaar is not just non-smart but also insecure.</li>
<li style="text-align: justify; ">Shuttleworth Foundation has announced <a class="external-link" href="http://cis-india.org/internet-governance/news/shuttleworth-foundation-april-19-2017-sunil-abraham-honorary-steward-september-2017">Sunil Abraham as Honorary Steward</a> for its September 2017 fellowship round. </li>

The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.</p>

<p style="text-align: justify; ">As part of the <a href="http://cis-india.org/a2k/access-to-knowledge-program-plan">project grant from the Wikimedia Foundation</a> we have reached out to more than 3500 people across India by organizing more than 100 outreach events and catalysed the release of encyclopaedic and other content under the Creative Commons (CC-BY-3.0) license in four Indian languages (21 books in Telugu, 13 in Odia, 4 volumes of encyclopaedia in Konkani and 6 volumes in Kannada, and 1 book on Odia language history in English).</p>

<li style="text-align: justify; ">CIS-A2K’s widely well-regarded flagship skill building program, Train The Trainer and MediaWiki Training was conducted in Kolkata earlier this year. <li style="text-align: justify; ">Although it has made the topographic maps or the Open Series Maps available to general public, Survey of India’s (SoI) Nakshe portal will have to go through a variety of litmus test, as the initiative fails to implement the mandates of public sharing of government data using open standards and open license as put forward by the NMP 2005 and NDSAP 2012, said Sumandro Chattapadhyay <a class="external-link" href="http://cis-india.org/openness/survey-of-india-open-series-maps-fails-to-implement-public-sharing-of-govt-data">in an interview with Geospatial World</a> on May 02, 2017.</li>

The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.</p>

<b>The National Resource Kit team is pleased to bring you its research on the state of laws, policies and programmes for persons with disabilities in the state of Sikkim. </b>
<h2>Executive Summary</h2>
<p style="text-align: justify; ">According to the 2001 Census, nearly 20,367 persons or 3% of the State population are identified as persons living with disabilities. The responsibility of ensuring the welfare of these persons with disabilities primarily rests with the Social Welfare Division of the Social Justice, Empowerment and Welfare Department of the Government of Sikkim. This Government department implements various policies, programmes and schemes aimed at the welfare and empowerment of persons living with disabilities.</p>
<p style="text-align: justify; ">Screening camps and medical camps emphasising the medical welfare of persons with disabilities are periodically arranged by the Government of Sikkim in conjunction with the STNM Government Hospital. Vide Notification No. 02/HC, HS&FW dated 30.01.09 by the Department of Healthcare, Human Services and Family Welfare, disability screening camps are to be arranged on specific dates of the month by the District Medical Board members in the respective District Hospitals accompanied by officers of the Sikkim Department of Social Justice, Empowerment and Welfare and the staff of various Deendayal District Rehabilitation Centres.<a href="#fn1" name="fr1">[1]</a></p>
<p style="text-align: justify; ">The Government of Sikkim has also introduced other measures such as the establishment of special schools for children with disabilities. The Social Welfare Department of Sikkim has established a Special School for Hearing impaired children in June 2004 at Sitchey Busty, Gangtok. The school is residential in nature, providing accommodation, education and other facilities towards ensuring the general welfare for children suffering from hearing impairments.<a href="#fn2" name="fr2">[2]</a></p>
<p style="text-align: justify; ">Furthermore, the Sikkim Government attempts to spread its reach by collaborating with several non- governmental organisations or NGOs in the state. The Government of Sikkim provides certain NGOs with financial assistance, subject to the fulfilment of certain conditions. As a result, NGOs have been able to provide better treatment and rehabilitation facilities to persons suffering from disabilities and living in the State of Sikkim.<a href="#fn3" name="fr3">[3]</a></p>
<p><b>Accessibility<br /></b>The only measures introduced in Sikkim on accessibility is concessions in transport. Free travel facility to the blind is provided in state owned buses.</p>
<p style="text-align: justify; ">Apart from the the State’s IT Policy issued by the Department of Information Technology states that it will develop special software for providing IT access to persons with visual impairment, cerebral palsy, speech and hearing disorders in association with NGOs and local enterpreuners. It is not clear if such software has already been developed by the State.</p>
<p style="text-align: justify; "><b>Education</b><br />The State of Sikkim provides special measures to children with disabilities in the pursuit of their education.</p>
<ul>
<li><span>Stipends and Scholarship Schemes</span></li>
</ul>
<ul>
</ul>
<ol>
<li style="text-align: justify; ">A stipend of Rs. 500/- per month per child, and Rs.500 per annum towards their studies in special schools outside of the state are provided for by the Department of Social Justice, Empowerment and Welfare. </li>
<li style="text-align: justify; ">The Government also provides a scholarship amount of Rs. 50 per month to every child studying in Class I to VI, Rs. 60 per month to every child in Class VII and Class VIII, and finally Rs.85 per month for every student in Class IX to XII. </li>
<li style="text-align: justify; ">A scholarship amount of Rs. 800 per month is provided to students desirous of pursuing their higher education in institutions established outside of Sikkim, and Rs. 2000 for all those students wishing to pursue their higher education in institutions in the State of Sikkim.<a href="#fn4" name="fr4">[4]</a></li>
</ol>

<p style="text-align: justify; "><span>Special Schools </span><br />The Social Welfare Division has established a Special School for the Hearing impaired children in June 2004 at Sitchey Busty, Gangtok. It is a residential School where accommodation, education and general welfare for the hearing impaired children are provided.</p>

<p><b>Employment</b></p>

<li style="text-align: justify; ">Reservation in Government Jobs: By Office Order No. 5/SW dated 31.12.1990, in Grade 'C' and 'D' posts reservation are provided in direct recruitment for physically handicapped persons as indicated below:</li>

<li>Orthopaedically handicapped – 1%</li>
<li>Hearing handicapped - 1%</li>
</ol>
<ul>
<li style="text-align: justify; ">Conveyance Allowance: Government and PSU employees who are blind and locomotor disabled are provided conveyance allowance.</li>
<li style="text-align: justify; ">Self-Employment: Persons with disabilities receive assistance for self-employment.</li>
<li style="text-align: justify; ">Vocational Training: Vocational training is given to persons with disabilities in sheltered workshops.</li>
</ul>
<p><b>Health and Rehabilitation<br /></b></p>
<ul>
<li>Aids and appliances: Persons with disabilities get free of cost prosthetic equipment.</li>
<li style="text-align: justify; ">Assistance to Disabled Persons for Purchase/Fitting of Aids and Appliances (ADIP) Scheme: As per the implementation of this Central Scheme, the Government of Sikkim provides assistance to those persons with disabilities who are in need of durable, sophisticated and scientifically manufactured, modern, standard aids and appliances. The purpose of this scheme is to ensure the promotion of the physical, social and psychological rehabilitation of persons with disabilities by reducing the effects of disabilities and to thereby enhance their economic potential. Aids and appliances that are provided include walking sticks, crutches, and wheel chairs. These appliances have been distributed to those persons with disabilities belonging to families living Below the Poverty Line (BPL).</li>
<li style="text-align: justify; ">Deendayal District Rehabilitation Scheme: Under this scheme, the Government of Sikkim has established a district disability rehabilitation centre in at STNM Hospital complex Gangtok in 2000. This DDRC has been working towards the rehabilitation of persons living with disabilities in Sikkim. In an effort to further facilitate the proper rehabilitation of persons with disabilities, the Government of Sikkim has made available the facilities of a Mobile Disability Van and a Mobile Rehabilitation Unit Van. In the Fiscal Year of 2009-10, 526 aids and appliances were distributed from the Deendayal District Rehabilitation Centre and 9 disability camps were conducted with two camps having been held in the Western district of the State, three in the South and East and one in the North.</li>
</ul>
<p><b>Social Protection<br /></b></p>
<ul>
<li>Disability Pension: Persons with disability above 40 years of age are provided disability pension of Rs. 100/- per month. Blind persons also get Rs. 100/- per month.</li>
<li style="text-align: justify; ">Indira Gandhi National Disability Pension Scheme: The State of Sikkim provides social protection to persons with disabilities by way of local implementation of the Indira Gandhi National Disability Pension Scheme. The purpose of the scheme is to provide persons with disabilities in the age group of 18 to 64 years, who are members of families living below the poverty line, with a certain sum of money in order to provide for their welfare. The beneficiaries under this scheme include all those persons suffering from severe or multiple disabilities as defined under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995and the ‘National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (National Trust Act 1999)’. In total, beneficiaries under this scheme receive an amount of Rs. 600/- per month.</li>
<li style="text-align: justify; ">Subsistence Allowance: Under the auspices of the Department of Social Justice, Empowerment and Welfare, the Sikkim Government provides a subsistence allowance amounting to Rs. 600 per month to persons with disabilities living in the state. In order to avail of the benefits under this scheme, beneficiaries must show that they are suffering from atleast 40% disability and that they should be a resident of the state of Sikkim. Furthermore, the beneficiary must hail from a family identified as a BPL or below the poverty line family. </li>

<h3>Making Voices Heard: Project Announcement</h3>
<p>Although voice enabled interfaces are being deployed there is a need to understand how they are beneficial, and what have been important knowledge gaps and challenges in their development, adoption, use, and regulation. Through the Making Voice Heard Project <a href="https://blog.mozilla.org/blog/2019/07/05/mozillas-latest-research-grants-prioritizing-research-for-the-internet/" target="_blank">supported by Mozilla Corporation</a>, we will be examining the current landscape of voice interfaces in India, and seek to address the following questions:</p>
<ul>
<li>What is the broad (sectoral and functional) typology of available voice interfaces in Indian languages? How widely are these voice interfaces (in Indian languages) used, and what barriers prevent their further adoption and use?<br /><br /></li>
<li>What are concerns related to privacy and data protection that emerge with the growth of voice interfaces? What kind of protocols for data processing may need to be built into the design of these interfaces?<br /><br /></li>
<li>How accessible are these interfaces for persons with disabilities (PWDs)? What kinds of accessibility features, especially for Indian languages, may need to be developed to ensure effective use of voice technologies by PWDs?<br /><br /></li>
<li>Where do challenges in these three areas intersect? For instance, is compromising on users’ privacy, including weak or missing data protection regulations, required to create comprehensive speech datasets that may help develop better accessibility features, and address linguistic barriers?</li></ul>
<p>In order to approach these questions we have begun mapping the various developers and users of voice interfaces in India. In the next stage of the process we will be looking at these interfaces through the lens of privacy, language, accessibility, and design. In order to add to the mapping and questions, we will be conducting interviews and workshops with users, developers, designers and researchers of voice interfaces in India, including the <a href="https://voice.mozilla.org/en" target="_blank">Common Voice</a> team at Mozilla.</p>
