<b>The National Resource Kit team is pleased to bring you its research on the state of laws, policies and programmes for persons with disabilities in the state of Delhi.</b>

<h3>Executive Summary</h3>
<p style="text-align: justify; ">The Department of Social Welfare is responsible for the welfare of persons with disabilities in the National Capital Territory of Delhi (Delhi NCT). The territory has an estimated population of 2,35,886<a href="#fn1" name="fr1">[1] </a>persons with disabilities in a total population of 16,753,235 <a href="#fn2" name="fr2">[2]</a> people.The government of Delhi NCT offers two schemes in Education, three schemes in Skill Training & Employment, and five schemes and three services in Social Security, Health, Rehabilitation & Recreation.</p>
<h3>Legal Provisions</h3>
<p>The government of Delhi NCT has framed the Delhi Persons with Disabilities (Protection of Rights, Equal Opportunities and Full Participation) Rules 2001<a href="#fn3" name="fr3">[3] </a>and the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Rules 2000.<a href="#fn4" name="fr4">[4]</a></p>
<p>The various schemes brought out by Delhi NCT for persons with disabilities are listed below.<a href="#fn5" name="fr5">[5]</a></p>
<h3>Education</h3>
<ul>

<p>The government provides three per cent reservation in seats at I. T. I.s for persons with disabilities.</p>
<h3>Skill Training & Employment</h3>
<ul>
<li style="text-align: justify; ">Delhi NCT provides three per cent reservation in Grade C and Grade D state government posts in direct recruitment for persons with disabilities.</li>
<li style="text-align: justify; ">Persons with disabilities are provided ten years relaxation in the upper age limit for applying to state government posts.</li>
<li style="text-align: justify; ">The government provides persons with disabilities five per cent reservation in allotment of DDA shops and kiosks. Persons with disabilities are also provided two per cent reservation in allotment of municipality shops.</li>
</ul>
<h3>Social Security, Health, Rehabilitation and Recreation</h3>
<p>Persons with disabilities are issued Disability Identity cards at the offices of the sub-divisional magistrates under whose jurisdiction they reside from 9.30 a.m. to 6.00 p.m. on all working days.<a href="#fn6" name="fr6">[6]</a> Applicants should carry the following at the time of application:</p>

<li style="text-align: justify; ">Attested photocopy of first three pages of ration card showing proof of three years residence in Delhi</li>
<li style="text-align: justify; ">Attested photocopy of medical Certificate in respect of disability from All India Institute of Medical Sciences, Lok Nayak Jai Prakash Hospital, Hindu Rao Hospital, Safdarjung Hospital, Guru Teg Bahadur Hospital, Ram Manoher Lohia Hospital, Institute of Human Behaviour and Allied Sciences etc.</li>
<li style="text-align: justify; ">Two passport size photographs – one should be attested by a gazetted officer</li>
<li style="text-align: justify; ">For issuance of duplicate identity card, Rs. 10/- to be deposited with the cashier of District and the receipt should be attached with the application form</li>
<li style="text-align: justify; ">Ration Card is required at the time of submission of application form</li>
</ul>

<p>Persons with disabilities may also apply for Disability Identity card at the offices of the Deputy Commissioner / Additional Commissioner (Disabilities) of their respective districts.<a href="#fn7" name="fr7">[7] </a></p>

<p style="text-align: justify; ">Persons with mental illness, mental disabilities and neurological disorders can obtain disability certificates from:</p>
<ul style="text-align: justify; ">
<li>Institute of Human Behaviour and Allied Sciences</li>
<li>GB Pant Hospital</li>
</ul>
<p style="text-align: justify; ">Persons with disabilities up to the age of 60 years are eligible to receive financial assistance from the government under the 2009 scheme.<a href="#fn9" name="fr9">[9]</a></p>
<p style="text-align: justify; ">Assistance of Rs. 1000 per month is provided to meet the rehabilitation and daily living requirements to those fulfilling the following requirements:</p>
<ul>
<li>Disability should be at least 40 per cent</li>
<li>Total family income should not exceed Rs. 75,000 per annum</li>
<li>Should have resided in Delhi for at least five years before applying</li>
<li>Should possess disability certificate from the medical board of a government hospital</li>
<li>Should not be in receipt of similar assistance from another source</li>
</ul>
<p style="text-align: justify; ">Persons with disabilities above the age of 60 years are eligible for financial assistance under the Scheme of Old Age Assistance. <a href="#fn10" name="fr10">[10]</a> Under this scheme persons in the age range of 60 to 69 years are eligible for a monthly pension of Rs. 1000 and persons 70 years and above are eligible for a pension of Rs. 1500 per month. Beneficiaries will be automatically transferred from the disability pension scheme upon completion of 60 years to the old age pension scheme. Likewise, upon completion of 69 years, beneficiaries will be automatically eligible for the higher pension. Applicants fulfilling the following conditions may apply in the prescribed format with proof of domicile, age and income:</p>
<ul>
<li>Should have resided in Delhi NCT for the last five years</li>
<li>Total family income should not exceed Rs. 60,000 per annum</li>
<li>Should not be in receipt of pension from any other source</li>
</ul>
<p>All voluntary organisations working for persons with disabilities will have to register with the department to be recognised by the Social Welfare Department under the Persons with Disabilities Act 1995.<a href="#fn11" name="fr11">[11]</a></p>
<p>The Joint Director (Social Welfare) is the competent authority for this purpose. Organisations fulfilling the following conditions are eligible to apply to the office of the District Social Welfare officer:</p>
<ul>
<li>Should have been in the field for not less than three years</li>
<li>Should be already registered under the relevant law</li>
<li>Should have a properly constituted managing body according to its written constitution</li>
<li>Should be a non profit organisation</li>
<li>Should be able to run the organisation without funding from the government</li>
<li>Professionals should be RCI registered</li>
<li>Premises should be disability friendly and have barrier free access</li>
<li>Should have audited accounts for the last three years</li>
</ul>
<p style="text-align: justify; ">The Department of Social Welfare organises disability camps annually in association with government hospitals, DTC, Department of Education, Office of the Divisional Commissioner, National Trust, Indian Railways and disability NGOs.<a href="#fn12" name="fr12">[12]</a> The following services are provided at the camps:<br />Disability certificate from the government hospital of the area</p>

<li>DTC passes</li>
<li>Identity card from the office of the DC</li>
<li>Registration in integrated school</li>
<li>Railways concession pass</li>
<li>Services for autism and cerebral palsy</li>
<li>Aids and Appliances</li>
<li>Forms to avail various schemes</li>
</ul>
<p>Persons with disabilities are provided one per cent reservation in allotment of DDA plots.</p>
<p>DTC issues free passes for persons with disabilities. Escorts for persons with visual impairment are given 50 per cent concession.</p>
<p>Persons with disabilities who are owners of vehicles are exempted from payment of road tax.</p>

<b>In a follow up to the ongoing project of compiling a National Compendium of Laws, Policies and Programmes for Persons with Disabilities, we are conducting a research to study the allocation in the budget for schemes for persons with disabilities, expenditures incurred for each scheme and total numbers of beneficiaries for all states and union territories.</b>
<p style="text-align: justify; ">In this context, applications under the RTI Act have been sent to departments covering persons with disabilities in all states requesting the following details for the period 2012 – 2014:</p>
<ol>
<li>Total budget allocated for each scheme per year.</li>
<li>Total expenditure on budget for each scheme per year.</li>
<li>List of beneficiaries for each scheme per year.</li>
</ol>
<p style="text-align: justify; ">Responses are currently being received from various districts and state departments for the above queries. State-wise details will be compiled and published on the website.</p>

<p style="text-align: justify; ">The union territory of Puducherry has not passed any legislation for persons with disabilities but implements the provisions under the central laws. The benefits that are currently being offered to persons with disabilities include educational scholarships and social protection programmes that provide financial assistance, aids and appliances and subsidised fuel among others. The government currently implements around 21 schemes for persons with disabilities.</p>

<p>Students with disabilities applying for the scholarships should fulfil the following conditions:</p>

<li style="text-align: justify; ">Applicants should not be less than five years of age and should have resided in Puducherry for not less than five years.</li>
</ul>
<h3 style="text-align: justify; ">Social Protection</h3>
<p style="text-align: justify; ">The government offers annual state awards in recognition of persons with disabilities and services rendered to them. An award of Rs. 10,000 is offered to one outstanding employee with disability in either government or private employment or a person who is self employed. An award of Rs. 15,000 is given to an individual serving the cause of persons with disabilities. An award of Rs. 25,000 is given to an institute serving the cause of persons with disabilities. The awards are given subject to selection by a state level committee. Persons with disabilities selected for awards should have a minimum of 40 per cent disability.</p>
<p style="text-align: justify; ">Persons with disabilities who are employees of the government are covered by a group insurance scheme. In case of death of any employee with disability due to an accident while in service, the sum insured would be paid to the family of the deceased employee as follows:</p>

<p style="text-align: justify; ">Employees of the government with 40 per cent or more disability are covered under this scheme.</p>
<p style="text-align: justify; ">Persons with disabilities who are not employees of the Puducherry government are covered under the Insurance Scheme for Persons with Disabilities other than the employees of the Government of Puducherry 2004. In case of death of the disabled person due to an accident, an amount of Rs. 25,000 is paid to the family. In case of loss of one limb or one eye, an amount of Rs. 12,500 is paid to the person. The policy covers persons with disabilities in the age group of five to 74 years with disability of 40 per cent or more and who are residents of Puducherry for not less than five years.</p>
<p style="text-align: justify; ">The government of Puducherry issues identity cards to persons with disabilities for ready reference to avail the benefits of welfare schemes. Persons with disability of not less than 40 per cent and whose total income does not exceed Rs. 35,000 per annum are eligible to apply for identity cards.</p>
<p style="text-align: justify; ">The government provides marriage grant for persons with disabilities. For marriage between a disabled person and a non disabled person, a grant of Rs. 25,000 is provided, of which Rs. 5000 is given in cash and Rs. 20,000 is given in the form of National Savings Certificate. For marriage between persons with disabilities, a grant of Rs. 50,000 is given. Of this, Rs. 20,000 is paid in cash and Rs. 30,000 is given in the form of National Savings Certificate. Persons with disabilities applying for this grant should fulfil the following eligibility criteria:</p>
<ul>
<li>Total income should not exceed Rs. 35,000 per annum</li>
<li>Should be above the age of 18 years (in case of women) and 21 years (in case of men).</li>
<li>Extent of disability should be 40 per cent or above</li>
<li>Should be the first marriage of the applicant</li>
<li>Marriage should be registered with the registrar</li>
<li>Should be a resident of the union territory of Puducherry</li>
<li>Application for the grant should be made within 120 days of the marriage</li>
</ul>
<p style="text-align: justify; ">The government of Puducherry implements a scheme to provide subsidy on fuel to persons with disabilities who own motorised vehicles. The scheme provides 50 per cent subsidy on fuel to a maximum of 25 litres per month. Applicants who fulfil the following eligibility criteria are eligible to apply:</p>
<ul>
<li>Total income should not exceed Rs. 35,000 per annum</li>
<li>Extent of disability should be 40 per cent or more</li>
<li>Applicant should have resided in Puducherry for more than five years</li>
<li>The vehicle should be registered in the name of the applicant</li>
<li>Applicant should have a valid driver’s licence</li>
</ul>
<p style="text-align: justify; ">The government of Puducherry grants financial assistance to persons with disabilities. Persons whose extent of disabilities are between 40 percent and 65 per cent are eligible for a grant of Rs. 1100 per month, those with disabilities between 66 per cent and 85 per cent are eligible for a grant of Rs. 1400 per month and persons with more than 86 per cent disabilities are eligible for a grant of Rs. 1750 per month. Persons applying for financial assistance should not have income exceeding Rs. 35,000 per annum and should have resided in Puducherry for not less than five years. Extent of disabilities for visually impaired, orthopedically disabled and hearing and speech impaired should be 40 per cent or more and those with mental disabilities should have an IQ less than 69 to be eligible to apply.</p>
<p style="text-align: justify; ">The government offers reimbursement for maintenance of tricycles for persons with disabilities. A grant of Rs. 200 per annum is offered to persons who fulfil the following criteria:</p>
<ul>
<li>Extent of disability should be 40 per cent or more</li>
<li>Applicant should have resided in Puducherry for not less than five years</li>
<li>Tricycle should have been supplied by the Department or NGO free of cost</li>
<li>Applicant should produce the bill for repair charges issued in their name</li>
</ul>
<p style="text-align: justify; ">The government supplies motorised tricycles free of cost to persons with locomotor disability affecting the lower limbs. The disability should be not less than 65 per cent. Total annual income of the applicant’s family should not exceed Rs. 35,000. Applicant should have resided in Puducherry for not less than five years. The applicant should be certified by the concerned medical authority that he or she is able to operate the motorised vehicle. The applicant should not be in receipt of transport allowance for conveyance from the department or any other source. The applicant should be in gainful employment or be pursuing higher studies.</p>
<p style="text-align: justify; ">Persons with disabilities are provided aids and appliances such as callipers, crutches, tricycles, hearing aids, spectacles and low vision aids by the government upon the advice of the specialists concerned attached to government general hospitals at Puducherry, Karaikal, Mahe and Yanam. Persons applying for these appliances should have an income not exceeding Rs. 24,000 per annum, should have resided in Puducherry for not less than five years and the extent of their disability should be 40 per cent or more.</p>
<p style="text-align: justify; ">The government provides free bus passes to persons with disabilities for travelling within the union territory. Persons with at least 40 per cent disabilities, who are residents of Puducherry for not less than five years and whose annual income does not exceed Rs. 35,000 are eligible to apply for the free bus passes.</p>
<p style="text-align: justify; ">Persons with disabilities are eligible to receive Rs. 100 per month through Anganwadi centres towards transport allowance. Persons applying for the allowance should fulfil the following eligibility criteria:</p>
<ul>
<li>Total income should not exceed Rs. 35,000 per annum</li>
<li>Should be above five years of age</li>
<li>Extent of disability should be 40 per cent or more</li>
<li>Should not have any formal educational qualification</li>
<li>Should have resided in Puducherry for not less than five years</li>
</ul>
<p style="text-align: justify; ">If the applicant is in possession of free bus pass, he or she should surrender the same to the Directorate of Social Welfare. Applicant should also declare in the application form whether he or she would prefer to avail the transport allowance or the free bus pass.</p>
<p style="text-align: justify; ">Organisations working for the welfare of persons with disabilities are eligible to received musical and sports equipment from the government. Organisations must be registered to be eligible for this scheme.</p>
<p style="text-align: justify; ">Persons with visual impairment are eligible to receive a radio from the government. Applicants must meet the following eligibility criteria:</p>
<ul>
<li>Income should not exceed Rs. 35,000 per annum</li>
<li>Extent of disability should be 40 per cent or more</li>
<li>Should have been a resident of Puducherry for not less than five years</li>
</ul>
<p style="text-align: justify; ">Persons with disabilities are provided sarees and dhotis during Deepavali and other regional festivals. Persons wishing to benefit from the scheme should have at least 40 per cent disability, should have resided in Puducherry for not less than five years and should have registered themselves with the local Anganwadi centres.</p>
<p style="text-align: justify; ">The government of Puducherry conducts a free annual tour for persons with disabilities to places of interest. Participants are selected for the tour conditionally upon meeting the following eligibility criteria:</p>
<ul>
<li>Should be in the age group of 18 to 50 years</li>
<li>Extent of disability should be 40 per cent or more</li>
<li>Should not be a government employee or child of a government employee</li>
<li>Income should not exceed Rs. 35,000 per annum</li>
<li>Should not have attended the tour in the past ten years</li>
<li>Should not suffer from any contagious diseases</li>
<li>Should have registered their names in the local Anganwadi centres</li>
</ul>
<p style="text-align: justify; ">The government of Puducherry celebrates the International Day for Persons with Disabilities on the 3rd of December every year with activities and games.</p>
<p style="text-align: justify; ">Puducherry implements the Perunthalaivar Karmaveerar Kamaraj scheme towards funeral expenses of persons with disabilities. A grant of Rs. 2000 is given for the funeral expenses of persons with at least 40 per cent disability who have resided in Puducherry for not less than five years and whose income was less than Rs. 35,000 per annum. The grant is paid to the family member under whose care the deceased person was living at the time of his or her death.</p>
<h3 style="text-align: justify; ">Miscellaneous</h3>
<p style="text-align: justify; ">Puducherry offers cash incentive to eye donors to encourage eye donation. An incentive of Rs. 10,000 is awarded to a close relative of the donor. Donors should be 18 years of age or older to be eligible. Donors should have resided in Puducherry for not less than five years. The incentive can be claimed by a close relative only after the transplantation is completed. The incentive can be claimed only upto 90 days after the transplantation.</p>

<h3 style="text-align: justify; ">Certification of Disability</h3>
<p style="text-align: justify; ">1.1 The Persons with Disabilities Amendment Rules, 2009<a href="#_ftn1" name="_ftnref1">[1]</a> provide detailed guidelines for issue of disability certificates. The Rules lay down that disability certificates may be issued either by a medical authority competent to issue disability certificates in the district of residence of the applicant or by the concerned medical authority in the government hospital where the applicant has undergone or is undergoing treatment in connection to the disability.</p>
<p style="text-align: justify; ">The certificate issued by the Medical Board makes a person eligible to apply for facilities, concessions and benefits admissible under schemes of the Government or Non-Governmental Organisations, subject to such conditions as the Central or the State Government may impose.</p>
<p style="text-align: justify; ">1.2 The Government has notified the guidelines for evaluation of locomotor, blindness, low vision, hearing, mental retardation and multiple disabilities and the procedure for certification vide notification No. 16-18/97-NI I dated 1st June, 2001. As per the guidelines, the Director General of Health Services, Ministry of Health and Family Welfare, Nirman Bhawan, New Delhi is the final authority for any controversy / doubt regarding the interpretation of the definitions/classifications / evaluations tests etc.</p>
<p style="text-align: justify; ">1.3 Procedure for Certification 2002<a href="#_ftn2" name="_ftnref2">[2]</a> via Notification No. 16-18/97-NI dated 18 February 2002 provides guidelines for Evaluation and Assessment of Mental Illness.</p>

<h3 style="text-align: justify; ">Education</h3>
<p style="text-align: justify; ">2.1 Article 41 of the Constitution of India titled Right to Work, to education and to public assistance in certain cases states that the State shall, within the limits of its economic capacity and development, make effective provision for securing the right to work, to education and to public assistance in cases of unemployment, old age, sickness and disablement, and in other cases of undeserved want.</p>
<p style="text-align: justify; ">2.2 The 86<sup>th</sup> Amendment to the Constitution introduced a new Article 21-A that made the right to education a fundamental right of all children from the age of six to 14 years. It also substituted Article 45 as Provision of early childhood care and education of children below the age of six years that states that the state shall endeavour to provide early childhood care and education for all children until they complete the age of six years.</p>
<p style="text-align: justify; ">2.3 Section 26 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995 (PWD Act) provides that the appropriate Governments and the local authorities shall-</p>
<p style="text-align: justify; ">(a) Ensure that every child with a disability has access to free education in an appropriate environment till he attains the age of eighteen years;</p>
<p style="text-align: justify; ">(b) Endeavour to promote the integration of students with disabilities in the normal schools;</p>
<p style="text-align: justify; ">(c) Promote setting up of special schools in Government and private sector for those in need of special education, in such a manner that children with disabilities living in any part of the country have access to such schools;</p>
<p style="text-align: justify; ">(d) Endeavour to equip the special schools for children with disabilities with vocational training facilities.</p>
<p style="text-align: justify; ">2.4 Section 27 of the PWD Act provides that the appropriate Governments and the local authorities shall by notification make schemes for-</p>
<p style="text-align: justify; ">(a) Conducting part-time classes in respect of children with disabilities who having completed education up to class fifth and could not continue their studies on a whole-time basis;</p>
<p style="text-align: justify; ">(b) Conducting special part-time classes for providing functional literacy for children in the age group of sixteen and above;</p>
<p style="text-align: justify; ">(c) Imparting non-formal education by utilizing the available manpower in rural areas after giving them appropriate orientation;</p>
<p style="text-align: justify; ">(d) Imparting education through open schools or open universities;</p>
<p style="text-align: justify; ">(e) Conducting class and discussions through interactive electronic or other media;</p>
<p style="text-align: justify; ">(f) Providing every child with disability free of cost special books and equipments needed for his education.</p>
<p style="text-align: justify; ">2.5 Section 28 of the PWD Act provides that the appropriate Governments shall initiate or cause to be initiated research by official and nongovernmental agencies for the purpose of designing and developing new assistive devices, teaching aids, special teaching materials or such other items as are necessary to give a child with disability equal opportunities in education.</p>
<p style="text-align: justify; ">2.6 Section 29 of the PWD Act provides that he appropriate Governments shall set up adequate number of teachers' training institutions and assist the national institutes and other voluntary organizations to develop teachers' training programmes specializing in disabilities so that requisite trained manpower is available for special schools and integrated schools for children with disabilities.</p>
<p style="text-align: justify; ">2.7 Section 30 of the PWD Act provides that without prejudice to the foregoing provisions, (be appropriate Governments shall by notification prepare a comprehensive education scheme which shall make Provision for-</p>
<p style="text-align: justify; ">(a) Transport facilities to the children with disabilities or in the alternative financial incentives to parents or guardians to enable their children with disabilities to attend schools.</p>
<p style="text-align: justify; ">(b) The removal of architectural barriers from schools, colleges or other institution, imparting vocational and professional training;</p>
<p style="text-align: justify; ">(c) The supply of books, uniforms and other materials to children with disabilities attending school.</p>
<p style="text-align: justify; ">(d) The grant of scholarship to students with disabilities;</p>
<p style="text-align: justify; ">(e) Setting up of appropriate fora for the redressal of grievances of parent, regarding the placement of their children with disabilities;</p>
<p style="text-align: justify; ">(f) Suitable modification in the examination system to eliminate purely mathematical questions for the benefit of blind students and students with low vision;</p>
<p style="text-align: justify; ">(g) Restructuring of curriculum for the benefit of children with disabilities;</p>
<p style="text-align: justify; ">(h) Restructuring the curriculum for benefit of students with hearing impairment to facilitate them to take only one language as part of their curriculum.</p>
<p style="text-align: justify; ">2.8 Section 31 of the PWD Act provides that all educational institutions shall provide or cause to be provided amanuensis to blind students and students with low vision.</p>
<p style="text-align: justify; ">2.9 Section 39 of the PWD Act provides that all Government educational institutions and other educational institutions receiving aid from the</p>
<p style="text-align: justify; ">Government, shall reserve not less than three per cent seat for persons with disabilities.</p>
<p style="text-align: justify; ">2.10 Right of Children to free and compulsory Education (RTE) Act 2009 provides that every child has the right to full time elementary education of satisfactory and equitable quality in a formal school that satisfies certain essential norms and standards.</p>
<p style="text-align: justify; ">Schemes:</p>
<p style="text-align: justify; ">2.11 SSA - Sarva Shiksha Abhyan:</p>
<p style="text-align: justify; ">SSA<a href="#_ftn3" name="_ftnref3">[3]</a> is a flagship central scheme that provides for free and compulsory education for children in the age group of six to 14 years including coverage of children with special needs under special focus groups. SSA will ensure that children with disabilities are provided education in appropriate environment and will adopt a zero rejection policy that will ensure that no child is left out of the education system.</p>
<p style="text-align: justify; ">2.12 Rashtriya Madhyamik Shiksha Abhyan (RMSA)<a href="#_ftn4" name="_ftnref4">[4]</a>:</p>
<p style="text-align: justify; ">RMSA aims to enhance access to secondary education and improve its quality. This scheme subsumes the earlier Integrated Education for the Disabled at Secondary Stage (IEDSS)<a href="#_ftn5" name="_ftnref5">[5]</a> scheme under its umbrella and supports children with disabilities aged 14 or above for completing their secondary education from Class 9 to Class 12 in government, local body and government aided schools.</p>
<p style="text-align: justify; ">The scheme provides for identification of children with disabilities moving from elementary school to secondary and providing them with aids and appliances for their disabilities, access to learning material, transport facilities, hostel facilities, scholarships, books, assistive technologies and provision of scribes and readers.</p>
<p style="text-align: justify; ">2.13 Scheme of National Scholarship for Persons with Disabilities:<a href="#_ftn6" name="_ftnref6">[6]</a></p>
<p style="text-align: justify; ">Scholarship is awarded for pursuing post matric / professional / technical courses of duration more than one year. For students with autism / cerebral palsy / mental retardation / multiple disabilities the scholarship is provided from Class 9 onwards. Advertisements are placed in all national dailies and on the MSJE website in the month of June. Applicants are eligible if they have disability above 40 per cent and the total family income does not exceed Rs. 15,000 per month.</p>

<p style="text-align: justify; ">Financial assistance is provided for procuring computer with editing software for students with visual impairment / hearing impairment pursuing graduate / post graduate professional courses and support access software for students with cerebral palsy.</p>
<p style="text-align: justify; ">2.14 Rajiv Gandhi Fellowship scheme:</p>
<p style="text-align: justify; ">This scheme provides scholarships to persons with disabilities to pursue higher education such as M Phil / Ph D. The scheme offers 200 fellowships every year and covers all the universities and institutions covered by the University Grants Commission. All students with disabilities admitted to M. Phil / Ph. D programmes of any university or academic institution are eligible to receive the fellowship provided they meet the requirements of the scheme. The fellowship will be awarded for a maximum of five years.</p>
<p style="text-align: justify; ">2.15 The Central Board of Secondary Education (CBSE) has amended its examination by-laws for students with disabilities. <a href="#_ftn7" name="_ftnref7">[7]</a> The amended by-laws are listed below:</p>
<p style="text-align: justify; ">o Rule 23 of Chapter 4 that provides exemption from the third language has been amended to include students with visual impairment, hearing and speech impairment, dyslexia and all other types of disabilities as defined in the PWD Act 1995.</p>
<p style="text-align: justify; ">o Rule 24 of Chapter 4 has been amended to permit students with visual impairment, physical disability, dyslexia, autism and other disabilities as defined in the PWD Act 1995 appearing for Secondary School examination or Senior School Certificate Examination, to use amanuensis and is permitted extra time at the rate of</p>
<p style="text-align: justify; ">For paper of 3 hours duration 60 minutes</p>
<p style="text-align: justify; ">For paper of 2½ hours duration 50 minutes</p>
<p style="text-align: justify; ">For paper of 2 hours duration 40 minutes</p>

<h3 style="text-align: justify; ">Employment</h3>
<p style="text-align: justify; ">3.1 Section 32 of the PWD Act provides that appropriate Governments shall:</p>
<p style="text-align: justify; ">(a) Identify posts, in the establishments, which can be reserved for the persons with disability;</p>
<p style="text-align: justify; ">(b) At periodical intervals not exceeding three years, review the list of posts identified and up-date the list taking into consideration the developments in technology.</p>
<p style="text-align: justify; ">3.2 Section 33 of the PWD Act provides that every appropriate Government shall appoint in every establishment such percentage of vacancies not less than three per cent for persons or class of persons with disability of which one per cent. Each shall be reserved for persons suffering from-</p>
<p style="text-align: justify; ">(i) Blindness or low vision;</p>
<p style="text-align: justify; ">(ii) Hearing impairment;</p>
<p style="text-align: justify; ">(iii) Locomotor disability or cerebral palsy, in the posts identified for each disability:</p>
<p style="text-align: justify; ">Provided that the appropriate Government may, having regard to the type of work carried on in any department or establishment, by notification subject to such conditions, if any, as may be specified in such notification, exempt any establishment from the provisions of this section.</p>
<p style="text-align: justify; ">3.3 Section 36 of the PWD Act provides that where in any recruitment year any vacancy under section 33, cannot be filled up due to nonavailability of a suitable person with disability or, for any other sufficient reason, such vacancy shall be carried forward in the succeeding recruitment year and if in the succeeding recruitment year also suitable person with disability is not available, it may first be filled by interchange among the three categories and only when there is no person with disability available for the post in that Year, the employer shall fill up the vacancy by appointment of a person, other than a person with disability: Provided that if the nature of vacancies in an establishment is such that a given category of person cannot be employed, the vacancies may be interchanged among the three categories with the prior approval of the appropriate Government.</p>
<p style="text-align: justify; ">3.4 Section 38 of the PWD Act provides that the appropriate Governments and local authorities shall by notification formulate schemes for ensuring employment of persons with disabilities, and such schemes may provide for:</p>
<p style="text-align: justify; ">(a) The training and welfare of persons with disabilities</p>
<p style="text-align: justify; ">(b) The relaxation of upper age limit</p>
<p style="text-align: justify; ">(c) Regulating the employment</p>
<p style="text-align: justify; ">(d) Health and safety measures and creation of a non-handicapping environment in places where persons with disabilities are employed</p>
<p style="text-align: justify; ">(e) The manner in which and the person by whom the cost of operating the schemes is to be defrayed</p>
<p style="text-align: justify; ">(f) Constituting the authority responsible for the administration of the scheme.</p>
<p style="text-align: justify; ">3.5 Section 47 (1) of the PWD Act provides that no establishment shall dispense with or reduce in rank, an employee who acquires a disability during his service.</p>
<p style="text-align: justify; ">Provided that, if an employee, after acquiring disability is not suitable for the post he was holding, could be shifted to some other post with the same pay scale and service benefits.</p>
<p style="text-align: justify; ">Provided further that if it is not possible to adjust the employee against any post, he may be kept on a supernumerary post until a suitable post is available or he attains the age of superannuation, whichever is earlier.</p>
<p style="text-align: justify; ">3.6 Section 40 of the PWD Act provides that the appropriate Governments and local authorities shall reserve not less than three per cent in all poverty alleviation schemes for the benefit of persons with disabilities.</p>
<p style="text-align: justify; ">3.7 Section 43 of the PWD Act provides that the appropriate Governments and local authorities shall by notification frame schemes in favour of persons with disabilities, for the preferential allotment of land at concession] rates for:</p>
<p style="text-align: justify; ">(b) Setting up business</p>
<p style="text-align: justify; ">(f) Establishment of factories by entrepreneurs with disabilities</p>
<p style="text-align: justify; ">3.8 The government has established special employment exchanges for persons with disabilities in all state capitals and special employment cells have been set up in all district headquarters for recruitment to government posts reserved for persons with disabilities. In places where special employment exchanges have not been established, special employment cells have been set up within regular employment exchanges. Persons with disabilities are required to register themselves with the special employment exchanges / cells to be eligible for government employment under reservation. Special employment registrations can also be done at the 17 vocational rehabilitation centres for persons with disabilities.</p>
<p style="text-align: justify; ">3.9 Scheme to provide incentive to private employers:</p>
<p style="text-align: justify; ">The government provides for employment of persons with disabilities in the private sector through incentives to employers. <a href="#_ftn8" name="_ftnref8">[8]</a> The government pays the employer's contribution of the disabled employee's provident fund and employee state insurance up to three years for employment of persons with disabilities to a maximum salary of Rs. 25,000 per month.</p>
<p style="text-align: justify; ">3.10 NHFDC schemes:</p>
<p style="text-align: justify; ">The National Handicapped Finance and Development Corporation provides loans to persons with disabilities for self employment. <a href="#_ftn9" name="_ftnref9">[9]</a> The details of the schemes are given as under:</p>
<p style="text-align: justify; ">i. for setting up small business in service / trading sector - loan of Rs. 3,00,000 (Three lakh)</p>
<p style="text-align: justify; ">ii. For setting up small business in sales / trading sector - Rs. 5,00,000 (five lakh)</p>

<p style="text-align: justify; ">vii. For building business premises on own land for employment - Rs. 3,00,000 (three lakh)</p>
<p style="text-align: justify; ">The business for which financial assistance is sought should be directly operated by the applicant. In case of persons with autism, cerebral palsy or mental retardation, the parent / spouse / legal guardian of the applicant is authorised to enter into contract with NHFDC on behalf of the applicant.</p>
<p style="text-align: justify; ">Applicant should fulfil the following eligibility criteria:</p>
<p style="text-align: justify; ">Should have a disability of minimum 40 percent</p>
<p style="text-align: justify; ">Should be an Indian citizen</p>
<p style="text-align: justify; ">Should have the required professional / technical qualification for the business undertaken</p>
<p style="text-align: justify; ">Loans should be repaid by a maximum of 10 years.</p>
<p style="text-align: justify; ">3.11 Swarna Jayanthi Gram Swarozgar Yojna<a href="#_ftn10" name="_ftnref10">[10]</a></p>
<p style="text-align: justify; ">This initiative from the Ministry for Rural Development was launched as an integrated self employment programme for the rural poor on 1<sup>st</sup> April 1999. The scheme involves establishment of Self Help Groups (SHGs) for social mobilisation, training, capacity building and provision of income generating assets through bank credit and government subsidy. Three per cent reservation is provided to persons with disabilities under this scheme.</p>
<p style="text-align: justify; ">The subsidy allowed under SJGSY for persons with disabilities is 50% of project cost subject to a maximum of Rs. 10,000.</p>
<p style="text-align: justify; ">In case of persons with disabilities, SHGs may be formed with a minimum of five members.</p>
<p style="text-align: justify; ">3.12 Swarna Jayanti Shahari Rozgar Yojna (SJSRY):<a href="#_ftn11" name="_ftnref11">[11]</a></p>
<p style="text-align: justify; ">This is a scheme by the Ministry of Housing and Urban Poverty Alleviation initiated to provide self employment and wage employment for the urban poor living below the urban poverty line.</p>
<p style="text-align: justify; ">Under the Urban Self Employment Programme, three per cent reservation is provided to persons with disabilities under this programme.</p>
<p style="text-align: justify; ">This scheme is not applicable to persons educated beyond the 9<sup>th</sup> standard.</p>
<p style="text-align: justify; ">3.13 Scheme for providing financial assistance to set up new enterprises under PMEGP (Prime Minister Employment Generation Programme): <a href="#_ftn12" name="_ftnref12">[12]</a></p>
<p style="text-align: justify; ">This scheme initiated by the Ministry of Micro Small and Medium Enterprises (MSME) is implemented through the Khadi and Village Industries Commission (KVIC) as the nodal body at the national level and through state KVIC Directorates, state Khadi and Industries Boards and Districts Industries Centres and banks at the state level.</p>
<p style="text-align: justify; ">The maximum cost of the project/unit admissible under manufacturing sector is 25 lakh and under business/service sector is 10 lakh.</p>
<p style="text-align: justify; ">For persons with disabilities: Beneficiaries contribution of project cost is 0.5%;</p>
<p style="text-align: justify; ">Rate of subsidy of project cost: 25% in urban areas; 35% in rural areas</p>
<p style="text-align: justify; ">The balance amount of the total project cost will be provided by Banks as term loan as well as working capital.</p>

<p style="text-align: justify; "><b>A. Schemes under the Department of Disability Affairs</b> <b>for persons with disabilities</b></p>
<p style="text-align: justify; ">4.1 <span>Assistance to Disabled Persons for Purchase /Fitting of Aids and Appliances</span></p>
<p style="text-align: justify; "><span> (ADIP ) Scheme: </span></p>
<p style="text-align: justify; ">The main objective of the scheme is to assist needy persons with disabilities in procuring durable sophisticated and scientifically manufactured, modern, standard aids and appliances that can promote their physical, social and psychological rehabilitation by reducing the effects of disabilities and enhance their economic potential. Aids and appliances which do not cost less than Rs. 50 and not more than Rs. 10,000 are covered under the scheme. The scheme also covers travelling expenses for the beneficiary with one escort to the nearest medical centre for fitting of aids / appliances, cost of surgical / medical intervention before the fitting, and boarding and lodging expenses to a maximum of 15 days.<a href="#_ftn13" name="_ftnref13">[13]</a></p>
<p style="text-align: justify; "><span>4.2 Deendayal Disabled Rehabilitation Scheme (DDRS):</span></p>
<p style="text-align: justify; ">This scheme replaced the earlier 'Scheme to Promote Voluntary Action for Persons with Disabilities' on 01.04.2009. Under this scheme financial assistance is provided through NGOs for various projects for providing education, vocational training and rehabilitation of persons with disabilities. It is a scheme to promote voluntary action for persons with disabilities. The maximum level of support could be up to 90% of the eligible amount of grant for the project.</p>
<p style="text-align: justify; ">4.3 <span>Scheme of National Awards for the Empowerment of Persons with Disabilities:</span> In order to recognise their effort and encourage others to strive to achieve excellence in this field, separate awards are being presented to the most efficient/outstanding employees with disabilities, best employers, best placement agency/officer, outstanding individuals, outstanding institutions, role models, outstanding creative disabled individuals and for outstanding technological innovation and adaptation of innovation to provide cost effective technology. Awards are also given to Government Sector, Public Sector Undertakings and private enterprises for creating barrier free environment for the persons with disabilities, the best district in the field of disability rehabilitation, best Local Level Committee of the National Trust and to the best State Channelising Agency (SCA) of the National Handicapped Finance and Development Corporation (NHFDC). Preference is given to the placement of women with disabilities, particularly, from the rural areas and self-employed women.<a href="#_ftn14" name="_ftnref14">[14]</a></p>
<p style="text-align: justify; ">4.4 <span>Composite Regional Centres for Persons with Disabilities (CRCs)</span><span>:</span> Due to lack of adequate facilities for rehabilitation of Persons with Disabilities, the Ministry has set up multiple Composite Regional Centres for Persons with Disabilities at Srinagar, Sundernagar (Himachal Pradesh), Lucknow, Bhopal, Kozhikode, Ahmedabad (No. 6-9/2009-NIS) and Guwahati to provide both preventive and promotional aspects of rehabilitation like education, health, employment and vocational training, research and manpower development, rehabilitation for persons with disabilities etc.</p>
<p style="text-align: justify; ">4.5 <span>District Disability Rehabilitation Centres (DDRCs):</span> The Ministry with active support of State Governments is facilitating setting up District Disability Rehabilitation Centres (DDRCs) to provide rehabilitation services to persons with disabilities. Centres are being set up in unreached and unserved districts of the country in a phased manner. These centres are to provide services for prevention and early detection, referral for medical intervention and surgical correction, fitment of artificial aids and appliances, therapeutical services such as physiotherapy, occupational and speech therapy, provision of training for acquisition of skills through vocational training, job placement in local industries etc. at district headquarters and local camps.</p>
<p style="text-align: justify; "><b>B. Schemes under the Ministry of Rural Development</b> <b>for persons with disabilities</b></p>
<p style="text-align: justify; "><span>4.6The Indira Gandhi National Disability Pension Scheme</span> :<a href="#_ftn15" name="_ftnref15">[15]</a> This was inserted as a component of the National Social Assistance Programme on 17<sup>th</sup> February, 2009 by the Secretary, Ministry for Rural Development. Under IGNDPS, central assistance of Rs. 300 p.m. per beneficiary is provided to persons with severe or multiple disabilities in the age group of 18-79 years and belonging to a household living BPL as per criteria prescribed by Government of India.</p>
<p style="text-align: justify; "><span>4.7 Indira Awaas Yojana:</span> It is a centrally sponsored housing scheme for providing dwelling units free of cost to the rural poor living below the poverty line at a unit cost of Rs. 20,000 in plain areas and Rs. 22, 000 in the hill/difficult areas. Three percent of its funds are reserved for the benefit of disabled persons living below the poverty line in rural areas.</p>

<p style="text-align: justify; ">Accessibility is a measure of the extent to which a product or service can be used by a person with a disability as effectively as it can be used by a person without that disability.<a href="#_ftn16" name="_ftnref16">[16]</a> <br /> <br /></p>
<p style="text-align: justify; ">5.1 Article 15 (2) (a) of the Constitution of India States that no citizen shall, on grounds only of religion, race, caste, sex, place of birth or any of them, be subject to any disability, liability, restriction or condition with regard to access to shops, public restaurants, hotels or places of public entertainment.</p>
<p style="text-align: justify; ">5.2 Section 44 of the PWD Act states that establishments in the transport sector shall, within the limits of their economic capacity and development for the benefit of persons with disabilities, take special measures to-</p>
<p style="text-align: justify; ">(a) Adapt rail compartments, buses. Vessels and aircrafts in such a way as to permit easy access to such persons;</p>
<p style="text-align: justify; ">(b) Adapt toilets in rail compartments, vessels, aircrafts and waiting rooms in such a way as to permit the wheel chair users to use them conveniently.</p>
<p style="text-align: justify; ">5.3 Section 45 of the PWD Act provides that the appropriate Governments and the local authorities shall, within the limits of their economic capacity and development. Provide for-</p>
<p style="text-align: justify; ">(a) Installation of auditory signals at red lights in the public roads for the benefit of persons with blindness or low vision;</p>
<p style="text-align: justify; ">(b) Causing curb cuts and slopes to be made in pavements for the easy access of wheel chair users;</p>
<p style="text-align: justify; ">(c) Engraving on the surface of the zebra crossing for the blind or for persons with low vision;</p>
<p style="text-align: justify; ">(d) Engraving on the edges of railway platforms for the blind or for persons with low vision;</p>
<p style="text-align: justify; ">(e) Devising appropriate symbols of disability;</p>
<p style="text-align: justify; ">(f) Warning signals at appropriate places.</p>
<p style="text-align: justify; ">5.4 Section 46 of the PWD Act provides that the appropriate Governments and the local authorities shall, within the limits of their economic capacity and development, provide for-</p>
<p style="text-align: justify; ">(a) Ramps in public buildings;</p>
<p style="text-align: justify; ">(b) Braille symbols and auditory signals in elevators or lifts;</p>
<p style="text-align: justify; ">(d) Ramps in hospitals, primary health centres and other medical care and rehabilitation institutions.</p>
<p style="text-align: justify; ">5.5 Section 48 (e) of the PWD Act provides that the appropriate Governments and local authorities shall promote and sponsor research, inter alia, in the area of site modifications in offices and factories.</p>
<p style="text-align: justify; ">5.6 Section 30 (B) of the PWD Act provides that the appropriate Governments shall by notification prepare a comprehensive education scheme which shall make Provision for the removal of architectural barriers from schools, colleges or other institutions imparting vocational and professional training.</p>
<p style="text-align: justify; "><span> 5.7 Guidelines and Space Standards for Barrier Free Built Environment for Disabled and Elderly Persons: <a href="#_ftn17" name="_ftnref17"><span>[17]</span></a> </span></p>
<p style="text-align: justify; ">In order to create a barrier free environment in consonance with the provisions of the PWD Act, the Government of India, Ministry of Urban Affairs & Employment (MUAE) is currently engaged in the process of amending/modifying the existing building bye-laws which would be applicable to all buildings and facilities used by the public. With this intention to ensure that everyone, including the physically disabled and elderly persons will have equal access in everyday life in the city, the MUAE has constituted a committee under the chairmanship of DG (W), CPWD for the purpose of developing comprehensive Guidelines and space Standards for barrier free built environment for disabled and elderly persons. The office of the Chief Commissioner of Persons with Disabilities has also developed guidelines for planning barrier free environment for persons with disabilities. The chapter on accessibility in the National Building Code published by the Indian Bureau of Standards also provides guidelines for creating accessible infrastructure.</p>
<p style="text-align: justify; "><span> </span></p>
<p style="text-align: justify; "><span>5.8 National Policy on Universal Electronic Accessibility:</span></p>
<p style="text-align: justify; "><span> The </span> <span>Department of Electronics and Information Technology, Ministry of Information Technology </span> <span> has notified the National Policy on Universal Electronic Accessibility to regulate the provision of accessible electronics and ICTs services & products, and universal design concepts for persons with disabilities. </span></p>

<p style="text-align: justify; ">6.1 Persons with disabilities are eligible for income tax deduction under Section 80U of the Income Tax Act. <a href="#_ftn18" name="_ftnref18">[18]</a> Persons with disabilities in the range of 40% to 80% are eligible for a deduction of Rs. 50,000. Persons with more than 80% disability are eligible for a deduction of Rs. 1,00,000.</p>

For students with autism / cerebral palsy / mental retardation / multiple disabilities the scholarship is provided from Class 9 onwards. Advertisements are placed in all national dailies and on the MSJE website in the month of June. Applicants are eligible if they have disability above 40 per cent and the total family income does not exceed Rs. 15,000 per month.<br />

Fees up to Rs. 10,000 are reimbursed every year. Financial assistance is provided for procuring computer with editing software for students with visual impairment / hearing impairment pursueing graduate / post graduate professional courses and support access software for students with cerebral palsy.</li>
<li style="text-align: justify; ">Students with disabilities are provided three per cent reservation in seats in government and government aided educational institutes.</li>
<li style="text-align: justify; ">Comprehensive Education Scheme for Disabled Children – The scheme provides for accessible and barrier free built-in infrastructure and transport facilities, supply of books, uniforms and stationery, specialised learning aids and scholarships for students with disabilities. Other provisions in the scheme include exemption from mathematics and pictoral questions for visually impaired students, use of scribes / readers for students with visual impairment / orthopaedic disabilities / learning disabilities, extra time in examinations for disabled students, exemption from third language and modification of curriculum to facilitate inclusive education.</li>
<li style="text-align: justify; ">Inclusive Education for the Disabled at Secondary Stage (IEDSS) – This scheme supports children with disabilities aged 14 or above for completing their secondary education from Class 9 to Class 12 in government, local body and government aided schools. The scheme provides for identification of children with disabilities moving from elementary school to secondary and providing them with aids and appliances for their disabilities, access to learning material, transport facilities, hostel facilities, scholarships, books, assistive technologies and provision of scribes and readers.</li>
<li style="text-align: justify; ">Rajiv Gandhi Fellowship scheme – This scheme provides scholarships to persons with disabilities to pursue higher education such as M Phil / Ph D. The scheme offers 200 fellowships every year and covers all the universities and institutions covered by the University Grants Commission. All students with disabilities admitted to M. Phil / Ph. D programmes of any university or academic institution are eligible to receive the fellowship provided they meet the requirements of the scheme. The fellowship will be awarded for a maximum of five years.</li>

<li style="text-align: justify; "><span>IF for any year the vacancies reserved for persons with disabilities are not filled, the vacancies are required to be carried forward for three consecutive years until a suitable candidate is found. If a suitable candidate is not found even after three years, the vacancies may be filled through interchanging between disabilities after which the reservation ceases to exist.</span></li>
<li style="text-align: justify; "><span>Persons with disabilities are given an age relaxation of up to ten years in the upper age limit for recruitment to government positions. They are also exempted from payment of application fees and examination fees.</span></li>
<li style="text-align: justify; "><span>The government provides that persons with disabilities should not be denied promotion in their employment on account of the disability / medical fitness if they are otherwise medically fit and can discharge their duties satisfactorily.</span></li>
<li style="text-align: justify; "><span>The government has identified positions in various departments and sections that are to be reserved for persons with disabilities based on their ability to perform the work of the position.</span></li>
<li style="text-align: justify; "><span>The government provides that persons with disabilities recruited to Group C and Group D employment on regional basis may be given postings, as far as possible under administrative constraints, nearest to their native places within the region. Requests from disabled employees for transfers to offices in or nearest to their native places may also be given priority.</span></li>
<li style="text-align: justify; "><span>The government has established special employment exchanges for persons with disabilities in all state capitals and special employment cells have been set up in all district headquarters for recruitment to government posts reserved for persons with disabilities. In places where special employment exchanges have not been established, special employment cells have been set up within regular employment exchanges. Persons with disabilities are required to register themselves with the special employment exchanges / cells to be eligible for government employment under reservation. Special employment registrations can also be done at the 17 vocational rehabilitation centres for persons with disabilities.</span></li>
<li style="text-align: justify; "><span>The government provides for employment of persons with disabilities in the private sector through incentives to employers. The government pays the employer’s contribution of the disabled employee’s provident fund and employee state insurance up to three years for employment of persons with disabilities with a minimum salary of Rs. 25,000 per month.</span></li>
<li style="text-align: justify; "><span>The Ministry of Petroleum and Natural Gas has reserved 7.5 per cent of all types of dealership agencies of public sector oil companies for persons with physical disabilities. This does not include defence personnel injured while on service. The dealership is advertised in one English daily and one regional language daily having maximum circulation in the district where the dealership is located. Applicants should be Indian citizens, aged between 21 years to 30 years, should have a minimum educational qualification of matriculation or equivalent, should produce disability certificate with minimum 40 percent disability of either upper limb or lower limb or both limbs considered together. Persons with partial hearing impairment are also eligible to apply. Persons with total visual impairment are eligible to apply for retail outlets, kerosene / LDO dealerships but are not eligible to apply for LPG dealership. Total family income of applicant should not exceed Rs. 50,000 per annum.</span></li>
<li style="text-align: justify; "><span>The National Handicapped Finance and Development Corporation provides loans to persons with disabilities for self employment. The details of the schemes are given as under:</span></li>

<p style="text-align: justify; ">The business for which financial assistance is sought should be directly operated by the applicant. In case of persons with autism, cerebral palsy or mental retardation, the parent / spouse / legal guardian of the applicant is authorised to enter into contract with NHFDC on behalf of the applicant. <h3 style="text-align: justify; ">Social Security, Health, Rehabilitation and Recreation</h3>
<ol style="text-align: justify; ">
<li>The Indira Gandhi National Disability Pension Scheme: This was inserted as a component of the National Social Assistance Programme on 17th February, 2009 by the Secretary, Ministry for Rural Development. Under IGNDPS, central assistance of Rs. 300 p.m. per beneficiary is provided to persons with severe or multiple disabilities in the age group of 18-79 years and belonging to a household living BPL as per criteria prescribed by Government of India. This scheme has been implemented in 8 districts of Manipur and a total of Rs 13.4 lakhs has been received by the State Government for this scheme in 2010-11.</li>
<li>Composite Regional Centres for Persons with Disabilities (CRCs): Due to lack of adequate facilities for rehabilitation of Persons with Disabilities, the Ministry has set up multiple Composite Regional Centres for Persons with Disabilities at Srinagar, Sundernagar (Himachal Pradesh), Lucknow, Bhopal, Kozhikode, Ahmedabad (No. 6-9/2009-NIs) and Guwahati to provide both preventive and promotional aspects of rehabilitation like education, health, employment and vocational training, research and manpower development, rehabilitation for persons with disabilities etc. </li>
<li>District Disability Rehabilitation Centres (DDRCs): The Ministry with active support of State Governments is facilitating setting up District Disability Rehabilitation Centres (DDRCs) to provide rehabilitation services to persons with disabilities. Centres are being set up in unreached and unserved districts of the country in a phased manner. These centres are to provide services for prevention and early detection, referral for medical intervention and surgical correction, fitment of artificial aids and appliances, therapeutical services such as physiotherapy, occupational and speech therapy, provision of training for acquisition of skills through vocational training, job placement in local industries etc. at district headquarters as well as through camp approach. </li>
<li>Assistance to Disabled Persons for Purchase /Fitting of Aids and Appliances (ADIP Scheme): The main objective of the scheme is to assist needy persons with disabilities in procuring durable sophisticated and scientifically manufactured, modern, standard aids and appliances that can promote their physical, social and psychological rehabilitation by reducing the effects of disabilities and enhance their economic potential. Aids and appliances which do not cost less than Rs. 50 and not more than Rs. 6,000 are covered under the scheme. Further travelling cost would be admissible and limited to a bus fare in the ordinary class or railway by second class sleeper subject to a limit of Rs. 250 for the beneficiary irrespective of the number of visits to a medical centre.<a href="#fn1" name="fr1">[1]</a></li>
<li>Public Sector Banks: Under the ‘Scheme for Public Sector Banks for Orphanages, Women’s Homes and Physically Handicapped Persons’, the benefits of the differential rate of interest are available to physically handicapped persons as well as institutions working for the welfare of the handicapped. Rate of interest will be uniformly charged at 4% per annum keeping in view the social objectives. Under the scheme of Financing Small Scale Industries, a special provision has been made in the rate of interest for the physically handicapped person (0.5% concession) for availing capital limit up to Rs.2,00,000/-. </li>
<li>The National Handicapped Finance and Development Corporation (NHFDC): This corporation has been set up by the Ministry of Social Justice & Empowerment, Government of India on 24th January 1997. The company is registered under Section 25 of the Companies Act, 1956 as a Company not for profit. It is wholly owned by Government of India and has an authorised share capital of Rs. 400 crores (Rupees Four Hundred Crore only). The NHFDC functions as an Apex institution for channelising the funds to persons with disabilities through the State Channelising Agencies (SCAs) nominated by the State Government(s). The schemes include loans for setting up small business in service/trading/industrial units, for higher studies/professional training, for manufacturing /production of assistive devices for disabled persons, for agricultural activities, for self employment amongst persons with mental retardation, Cerebral Palsy and Autism.</li>
<li>Deendayal Disabled Rehabilitation Scheme (DDRS): Replaced the earlier ‘Scheme to Promote Voluntary Action for Persons with Disabilities’ on 01.04.2009. Under this scheme financial assistance is provided through NGOs for various projects for providing education, vocational training and rehabilitation of persons with disabilities. It is a scheme to promote voluntary action for persons with disabilities. The maximum level of support could be up to 90% of the eligible amount of grant for the project. During the 10th Five Year Plan grant-in-aid to the extent of Rs. 335.4 cr. was released to NGOs under the revised DDRS.<a href="#fn2" name="fr2">[2] </a></li>
<li>Indira Awaas Yojana: It is a centrally sponsored housing scheme for providing dwelling units free of cost to the rural poor living below the poverty line at a unit cost of Rs. 20,000 in plain areas and Rs. 22, 000 in the hill/difficult areas. Three percent of its funds are reserved for the benefit of disabled persons living below the poverty line in rural areas.<a href="#fn3" name="fr3">[3] </a></li>
<li>Scheme of National Awards for the Empowerment of Persons with Disabilities: In order to recognise their effort and encourage others to strive to achieve excellence in this field, separate awards are being presented to the most efficient/outstanding employees with disabilities, best employers, best placement agency/officer, outstanding individuals, outstanding institutions, role models, outstanding creative disabled individuals and for outstanding technological innovation and adaptation of innovation to provide cost effective technology. Awards are also given to Government Sector, Public Sector Undertakings and private enterprises for creating barrier free environment for the persons with disabilities, the best district in the field of disability rehabilitation, best Local Level Committee of the National Trust and to the best State Channelising Agency (SCA) of the National Handicapped Finance and Development Corporation (NHFDC). Preference is given to the placement of women with disabilities, particularly, from the rural areas and self-employed women.<a href="#fn4" name="fr4">[4]</a></li>
<li>Trust Fund for the Empowerment of Persons with Disabilities: The Supreme Court in its order dated 16th April, 2004 in the Civil Appeals No.4655 and 5218 of 2000 had directed that the banks, who had collected an estimated excess amount of Rs.723.79 crores annually from the borrowers through rounding off in collection of interest tax, should transfer it to a trust which would be used for welfare of persons with disabilities. The Court had constituted a Committee under the chairmanship of Comptroller and Auditor General of India with Finance Secretary and Law Secretary as members. The Ministry had sought directions of the Apex court for transfer of these funds to the National Trust for Welfare of persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities for purposeful utilization. The Supreme Court is yet to take a view on the request of the Ministry but in the meantime the trust has been set up and the banks have been advised by the Banking Division of the Ministry of Finance to deposit the due amount in the Trust account.</li>
<li>Technology Development Projects in Mission Mode: With a view to provide suitable and cost effective aids and appliances through the application of technology and to increase their employment opportunities and integration in society of the physically disabled, the above scheme was started during 1990-91. Under the scheme, suitable R&D projects are identified and funded for developing aids and appliances. The scheme is implemented through the IITs. Educational Institutes, Research Agencies and Voluntary Organisations etc. Financial assistance is provided on 100% basis. The four Technical Advisory Groups monitor the selection of the projects and also their progress at different stages in areas of disabilities, namely, Orthopaedic (including Cerebral Palsy), Visual, Speech and Hearing and Mental. All the projects those are recommended by the respective Technical Advisory Groups placed before the Apex Level Committee headed by Secretary, Ministry of Social Justice and Empowerment.<a href="#fn5" name="fr5">[5] </a></li>

<p style="text-align: justify; ">Guidelines and Space Standards for Barrier Free Built Environment for Disabled and Elderly Persons<a href="#fn6" name="fr6">[6] </a>: In order to create a barrier free environment in consonance with the provisions of the Act, the Government of India (Ministry of Urban Affairs & Employment) is currently engaged in the process of amending/modifying the existing building bye-laws which would be applicable to all buildings and facilities used by the public. With this intention to ensure that everyone, including the physically disabled and elderly persons ,will have equal access in everyday life in the city, the Min. of UA&E has constituted a committee under the chairmanship of DG(W), CPWD with the following members for the purpose of developing comprehensive Guide lines and space Standards for barrier free built environment for disabled and elderly persons.</p>

<h3>Certification</h3>
<ol>
<li style="text-align: justify; ">Guidelines for issue of Disability Certificates: the Persons with Disabilities Rules, 1996 provide the broad guidelines for issue of the disability certificates. The Rules lay down that a Medical Board, duly constituted by the Central and the State Government, shall issue a Disability Certificate. The certificate issued by the Medical Board makes a person eligible to apply for facilities, concessions and benefits admissible under schemes of the Governments or Non-Governmental Organisations, subject to such conditions as the Central or the State Government may impose. It is for this reason that the Central Government has issued these guidelines with the aim of simplifying the procedures for issue of disability certificates. It has also created some additional guidelines for the issue of disability certificates to students with disabilities.</li>
<li style="text-align: justify; ">Guidelines for evaluation of various disabilities and procedure for certification: The Government has notified the guidelines for evaluation of locomotor, visual, hearing, mental retardation and multiple disabilities and the procedure for certification, formulated by the Expert Committees set up by the Government, under the Chairmanship of Director General Health Services (DGHS), vide notification No. 16-18/97-NI I dated 1st June, 2001. As per the guidelines, the Director General of Health Services, Ministry of Health and Family Welfare is the final authority, should there arise any controversy / doubt regarding the interpretation of the definitions/classifications / evaluations tests etc. Therefore, for any problems relating to evaluation of various disabilities and procedure for certification, Director General of Health Services, Ministry of Health and Family Welfare, Nirman Bhawan, New Delhi may be approached.</li>

<b>CIS collaborated with Ashoka India to host ‘Open House with George Abraham’ – an open discussion on inclusion of persons with disabilities in mainstream society on Wednesday, May 21, 2014 at the Ashoka premises.</b>
<p style="text-align: justify; ">The event involved screening of episodes from ‘NazaryaNazariya’ — a television series on living with visual impairment — followed by a discussion with George Abraham, CEO, Score Foundation, on identifying and resolving challenges that restrict inclusion of persons with disabilities in mainstream society.</p>
<p style="text-align: justify; "><i>Nazarya Nazariya</i> (Sight or Perspective) is a series that was created by the Delhi based <a class="external-link" href="http://scorefoundation.org.in/">Score Foundation</a> and was telecast on <a class="external-link" href="http://www.ddindia.gov.in/Default.aspx">Doordarshan</a>. The series showcases different challenges faced by persons with visual impairment and explores steps to ensure inclusion of the visually impaired.</p>
<p style="text-align: justify; ">The discussion with George Abraham initially centred around the importance of education and universal design — the topics highlighted in the two episodes that were screened — before moving on to other areas such as use of assistive technology, enhancing employability of persons with disabilities, developing equal employment opportunities and creating an inclusive workplace.</p>

The state has an estimated population of 419,887<a href="#fn1" name="fr1">[1] </a>persons with disabilities in a total population of 25,545,198<a href="#fn2" name="fr2">[2] </a>people. Chhattisgarh has issued one scheme under General Entitlements, one scheme under Women and Children with Disabilities, three schemes under Education, two schemes under Skill Development and Employment, three schemes under Social Security, Health, Rehabilitation & Recreation and one scheme under Schemes & Grants for Organisations & Individuals for Disabilities.</p>

<p>4. Skill Development and Employment</p>
<p style="text-align: justify; ">4.1 The Chhattisgarh Nishaktjan Vitan & Vikas Nigam provides loans with low interest rates to persons with disabilities for starting their own businesses.<br /><br />4.2 The Uthan Subsidy Yojna is a scheme for persons with disabilities availing loans for self-employment. The government provides 50 per cent subsidy on the remaining loan if the disabled person pays all the instalments regularly for three years.</p>

<h3>Skill Training and Employment</h3>
<p style="text-align: justify; ">2.1 The government provides three per cent reservation for persons with disabilities in Grade C and Grade D government posts in direct recruitment. Reservations are provided at one per cent for visually impaired, one per cent for hearing impaired and one per cent for locomotor disabled.</p>
<p style="text-align: justify; ">2.2 Persons with disabilities are eligible for age relaxation of up to ten years in upper age limit for applying to government positions.</p>
<p style="text-align: justify; ">2.3 Persons with disabilities are provided an assistance of up to Rs. 5000 for self employment. 25 per cent of the amount is provided as subsidy while 75 per cent of the amount is provided as interest free loan. <p style="text-align: justify; ">The Department of Social Justice is responsible for the welfare of persons with disabilities in Madhya Pradesh. The state has an estimated population of 14,08,528<a href="#fn1" name="fr1">[1] </a>persons with disabilities of the total population of 72,597,565 people.<a href="#fn2" name="fr2">[2]</a> Madhya Pradesh has issued five notifications for Education, one notification for Skill Training and Employment, six notifications for Social Security, Health, Rehabilitation and Recreation and one notification for Accessibility.</p>
<h2 style="text-align: justify; ">Legal Provisions</h2>
<p>The notifications issued by the state for persons with disabilities are listed categorically as below:</p>
<h3>Education</h3>
<p style="text-align: justify; ">1.1 The government implements a scheme that provides scholarships for eligible students with disabilities to pursue higher education abroad. <a href="#fn3" name="fr3">[3]</a> Students applying for scholarship under this scheme should fulfil the prescribed educational requirements, not be more than 35 years of age on the 1st January of the year of application and the total family income should not be more than Rs. 96,000 per annum. This scholarship is available to only one child per family. Application should be made on the prescribed format with all required attachments including witness form, income certificate, caste certificate, disability certificate and domicile proof.</p>
<p style="text-align: justify; ">1.2 Madhya Pradesh implements a scheme that enables students with disabilities to pursue higher education in the fields of medicine, engineering, computer science and management studies through provision of maintenance and transport allowances and scholarships.<a href="#fn4" name="fr4">[4]</a></p>
<p style="text-align: justify; ">Fees of the disabled students of government universities and colleges would be directly paid by the Department. For students studying in private universities and colleges, fees equal to the government fees would be paid by the department and the balance is to be borne by the student. The students are eligible for a maintenance allowance of Rs. 1500 for a period of ten months which will be directly paid to the college. Students with disabilities are eligible to receive an amount of Rs. 500 from the Nagar Nigram Kshetra and an amount of Rs. 300 from the Nagar Palik Kshetra towards transport allowance for a period of 10 months. This amount would be directly paid to the college authorities. Applications under this scheme are to be made in the prescribed format. Applicants should fulfil the following conditions:</p>
<ul>
<li>Should have a minimum disability of 40 per cent.</li>
<li>Should be natives of Madhya Pradesh and should apply to study in universities and colleges within Madhya Pradesh.</li>
<li>Annual income of the family should not exceed Rs. 96,000.</li>
<li>Should not be in receipt of tuition fees and transport allowance from any other plan.</li>
<li>Students belonging to SC / ST or backward categories will have to choose to receive assistance for either SC/ST and backward classes, or for disabled students.</li>
</ul>

<p style="text-align: justify; ">Students with disabilities belonging to SC / ST category studying in technical colleges are also eligible to apply for scholarships. In addition to the scholarship given by the SC / ST boards, the Department of Social Justice also provides scholarship to weak SC / ST students. The annual income of parents whose children apply for scholarship should not exceed Rs. 96,000.</p>
<p style="text-align: justify; ">Students with disabilities belonging to SC / ST category who score 80 per cent in Class VIII are eligible to receive grant of Rs. 2500 as encouragement to continue higher studies. Similarly, disabled students of SC / ST category who score 60 percent in Class XII are eligible to receive Rs. 3000 as encouragement to continue higher studies in local colleges. Students with visual impairment belonging to SC / ST category and pursuing higher studies will be given reader allowance as listed below.</p>

<p style="text-align: justify; ">1.4 Madhya Pradesh implements a scheme to aid opening of hostels for students with disabilities.<a href="#fn6" name="fr6">[6]</a> The responsibility of opening and maintaining the hostel rests with the educational institution. Hostels may be opened with a minimum of five students. Separate hostels should be established for boys and girls. In case of rented buildings, the educational institution is eligible to receive a maximum of Rs. 1500 towards rent.</p>
<p style="text-align: justify; ">Boarding facilities are available only to students of government and non government educational institutions who are in Class XI or above and have applied for scholarship post matriculation. Students applying for hostels should be domiciled in Madhya Pradesh and their total family income should not exceed Rs. 96,000 per annum.</p>
<p style="text-align: justify; ">1.5 The Higher Primary Education Board has issued an order<a href="#fn7" name="fr7">[7] </a>stating that extra time of 20 minutes for every hour will be provided to students with disabilities in the upper limbs and students with cerebral palsy if attempting the exam without aid of a scribe. Extra time would not be granted to the students of the above category if using the services of a scribe. Extra time of 20 minutes per hour would be granted to students with visual impairment even if services of a scribe are used.</p>
<h3 style="text-align: justify; ">Skill Training and Employment</h3>
<p>2.1 The government provides financial assistance to persons with disabilities as encouragement for succeeding in the civil services examination of Madhya Pradesh.<a href="#fn8" name="fr8">[8]</a> Assistance will be provided in the following scale</p>

<p style="text-align: justify; ">Applications have to be made to the Composite Coordinators of Social Justice of the respective districts within 30 days of declaration of results.</p>
<h3 style="text-align: justify; ">Social Security, Health, Rehabilitation & Recreation</h3>
<p style="text-align: justify; ">3.1 The Department of Social Justice implements a scheme called Persons with Multiple Disabilities and Mental Retardation Grant 2009.<a href="#fn9" name="fr9">[9]</a> Persons with multiple disabilities and mental retardation who are above six years of age and receive a grant of Rs. 500 under this scheme are eligible to be covered by the Niramaya health insurance scheme being implemented by the National Trust. All beneficiaries will be insured by the district administration.</p>
<p style="text-align: justify; ">3.2 Persons with disabilities in the age range of six to 18 years with disability of not less than 40 percent and belonging to BPL families are eligible for pension of Rs. 150 per month under the Overall Social Safety Pension Scheme.<a href="#fn10" name="fr10">[10]</a></p>
<p style="text-align: justify; ">3.3 The government implements a scheme to encourage marriages for persons with disabilities by providing a grant of Rs. 25,000 for marriages where either the groom or the bride is disabled. For marriages where both the bride and groom are disabled, a grant of Rs. 50,000 is provided.<a href="#fn11" name="fr11">[11]</a></p>
<p style="text-align: justify; ">Individuals who are natives of Madhya Pradesh and who are non income tax payers are eligible to apply. The grant is available only for the first marriage of the disabled person. Applicants should be above 18 years of age in case of women and 21 years of age in case of men and should have a minimum disability of at least 40 per cent to be eligible.</p>
<p style="text-align: justify; ">3.4 Persons with multiple disabilities or mental retardation who are above the age of six years and whose parents / guardians are below poverty line are eligible to apply for aid from the Department of Social Justice.<a href="#fn12" name="fr12">[12]</a> The grant-in-aid will be directly deposited in the bank account of the applicant. Applicants should fulfil the following eligibility criteria:</p>
<ul>
<li>Should be natives of Madhya Pradesh.</li>
<li>Should produce age proof stating that they are above six years of age that is issued by the town municipality, city corporations, town Panchayat or the grama Panchayat.</li>
<li>Should produce a disability certificate stating a minimum of 40 per cent disability</li>
<li>The bank account of the beneficiary should be a joint account with either parents or guardians and should be held in a nationalised bank, a co-operative bank or a regional rural bank.</li>
</ul>
<p style="text-align: justify; ">3.5 The government has enhanced The aid to beneficiaries from the aided voluntary organisations to Rs. 1000 per month.<a href="#fn13" name="fr13">[13]</a></p>
<p style="text-align: justify; ">3.6 The government has issued an order providing disabled employees of the state government with travel allowance of Rs. 500 per month.<a href="#fn14" name="fr14">[14]</a></p>
<h3 style="text-align: justify; ">Accessibility</h3>

<p style="text-align: justify; ">The Department of Social Justice and Empowerment is responsible for the welfare of persons with disabilities in Haryana. The state has an estimated population of <a class="external-link" href="http://socialjustice.nic.in/statewisedisabled.php">4,55,040</a> persons with disabilities in a total population of <a class="external-link" href="http://en.wikipedia.org/wiki/Haryana">25,353,081</a>.</p>
<p style="text-align: justify; ">Haryana implements two schemes under Women and Children with Disabilities, three schemes under Education, three schemes under Skill Development and Employment, and five schemes under Social Security, Health, Rehabilitation and Recreation.</p>
<p style="text-align: justify; ">1. General Entitlements</p>

<b>Electronics and Information and Communication Technologies (ICTs) are widely used in all areas of life such as education, health care, employment, entertainment, banking and finance management and other aspects of daily living. </b>
<p style="text-align: justify; ">They not only make life easier for people in general, but have the potential to revolutionise the lives of persons with disabilities through larger inclusion and participation in these areas and by enabling independent living through use of appropriate assistive technologies (ATs).</p>
<p style="text-align: justify; ">In the year 2010, the erstwhile Department of Information Technology, Government of India circulated a draft consultation paper on the National Policy for Electronic Accessibility that sought to regulate the provision of accessible Electronics and ICTs services and products and universal design concepts for persons with disabilities. Post consultation and deliberation, the Government of India has passed the <a class="external-link" href="http://deity.gov.in/sites/upload_files/dit/files/NPE_Notification.pdf">National Policy on Universal Electronic Accessibility</a> (National Policy) in 2013. This is a brief analysis of the policy and the provisions therein.</p>
<p style="text-align: justify; ">The draft consultation paper had clearly identified the requirements of persons with disabilities that had to be kept in view while designing electronic accessibility solutions:</p>
<ul>
<li style="text-align: justify; ">Eliminating discrimination on the basis of disabilities and facilitating equal access to Information and Communication Technologies and Electronics (ICTE)</li>
<li style="text-align: justify; ">Understanding the diversity of persons with disabilities and creating solutions for their specific needs</li>
<li style="text-align: justify; ">Ensuring that accessibility standards and guidelines and universal design concepts are adopted and adhered to.</li>
</ul>
<p style="text-align: justify; ">While the draft consultation paper only sought to provide equal access to ICTE products and services to persons with disabilities, the objective of the National Policy has been expanded to include not just equal but also barrier free access. The category of disabilities has also been expanded to include mental disabilities. Further, the policy seeks to facilitate local language support and sync universal access with barrier free access that should be usable without adaptation.</p>
<p style="text-align: justify; ">The scope of the National Policy continues to cover access to ICTE products and services to persons with disabilities in the areas of universal design, assistive technologies and independent living aids as in the draft consultation paper, but the National Policy expands on the broad roles and functions of the major stakeholders.</p>
<p style="text-align: justify; ">The National Policy clearly defines the following points that were not discussed in the Draft Consultation Paper:</p>
<ul>
<li style="text-align: justify; ">The Department of Electronics and Technology is named as the nodal authority for monitoring the implementation of the policy.</li>
<li style="text-align: justify; ">Recommends constitution of a high level advisory committee of multiple stakeholders – central and state. ministries and department, industry, academia, disabled persons organisations and persons with disabilities for guiding and implementing the policy.</li>
<li style="text-align: justify; ">Recommends an amendment in the Information Technology (IT) Act to protect persons with disabilities who inadvertently break the law.</li>
<li style="text-align: justify; ">Lays emphasis on providing support in local languages to accessible Electronics and ICTs.</li>
</ul>
<p>The strategy and Action Plan defined in the Draft Consultation Paper have been augmented and restructured to include the following points described in the National Policy:</p>
<p>Creating awareness on universal electronics accessibility and universal design</p>
<ul>
<li style="text-align: justify; ">The National Policy specifically provides that the Department of Electronics and Information Technology will play the lead role.</li>
<li style="text-align: justify; ">Other central and state ministries, departments and agencies will also be responsible.</li>
<li style="text-align: justify; ">Carried out through Media, campaigns, conferences, workshops and seminars. </li>
<li style="text-align: justify; ">Will also include available and emerging assistive technologies and independent living aids and schemes.</li>
<li style="text-align: justify; ">Information to be made available in public domain in local languages in accessible format.</li>
</ul>
<p>Capacity building and Infrastructure Development</p>
<ul>
<li style="text-align: justify; ">The National Policy requires that schemes for capacity building on accessibility and assistive technologies be taken up within the government and for persons with disabilities.</li>
</ul>
<p style="text-align: justify; ">Education and Assistive Technologies Centres</p>
<ul>
<li style="text-align: justify; ">Accessibility standards and guidelines and universal design concepts to be included in the curriculum of Electronics and ICTs education.</li>
<li style="text-align: justify; ">Assistive technologies and independent living aids to be included in the curriculum of Special Education and Rehabilitation.</li>
<li style="text-align: justify; ">Model Electronics and ICTs centres to be set up to provide training and demonstration to special educators and persons with disabilities including persons with mental disabilities.</li>
</ul>
<p style="text-align: justify; ">Conducting research and development</p>
<ul>
<li style="text-align: justify; ">To develop assistive technologies and independent living aids based on accessibility standards and guidelines and universal design concepts</li>
<li style="text-align: justify; ">To provide incentives for the research and development of such products</li>
<li style="text-align: justify; ">To formulate schemes to support research and development organisations for developing such products</li>
<li style="text-align: justify; ">To include persons with disabilities and rehabilitation professionals in formulation, implementation and monitoring the schemes.</li>
</ul>
<p style="text-align: justify; ">Accessibility Standards</p>
<ul>
<li style="text-align: justify; ">The draft consultation paper provides that the accessibility standards and guidelines be taken or modified from existing standards and guidelines in accessibility</li>
<li style="text-align: justify; ">The National Policy specifically names existing accessibility standards and guidelines such as the following as examples</li>
</ul>
<ol>
<li>W3C Accessibility Standards</li>
<li>ATAG (Authoring Tools Accessibility Guidelines)</li>
<li>WCAG 2.0 (Web Content Accessibility Guidelines)</li>
<li>UAAG (User Agent Accessibility Guidelines)</li>
</ol>
<ul>
<li style="text-align: justify; ">Accessibility compliance would be monitored for government websites, websites for disability issues, general citizen centric websites and important websites with high traffic or high consumer transaction.</li>
</ul>
<p>Accessible format for content</p>
<ul>
<li style="text-align: justify; ">Content published in electronic format including text books, journals, publications, multimedia etc are required to be published in accessible format</li>
<li style="text-align: justify; ">Support in local languages to be provided for all content</li>
</ul>
<p>Developing programmes and schemes</p>
<ul>
<li>The National Policy lays emphasis on schemes for women and children with disabilities </li>
</ul>
<p>Developing procurement guidelines for Electronics and ICTs for accessibility and assistive needs</p>
<ul>
<li style="text-align: justify; ">The draft Consultation Paper merely states that ICTE procurement guidelines and processes should include accessibility standards and guidelines.</li>
<li style="text-align: justify; ">The National Policy requires that Electronics and ICTs procurement policies be evolved to confirm to the requirements of the National Policy.</li>
<li style="text-align: justify; ">Higher cost of accessibility compliant hardware and software to be budgeted for at procurement.</li>
<li style="text-align: justify; ">Incentives to be provided by the government to assist with the procurement of such products.</li>
<li style="text-align: justify; ">Any scheme formulated by the central or state governments for persons with disabilities should be linked with ongoing schemes for universal electronic accessibility.</li>
</ul>
<p style="text-align: justify; ">Affordable Access</p>
<ul>
<li style="text-align: justify; ">The Draft Consultation Paper requires that schemes be formulated to provide access to ICTE services and products to persons with disabilities at affordable costs.</li>
<li style="text-align: justify; ">Information about these schemes to be made available in the public domain in local languages in accessible format.</li>
<li style="text-align: justify; ">The National Policy promotes open source usage to meet affordable access requirements.</li>
</ul>
