Authorities in a south Karnataka district have started keeping tighter watch on rumour-mongering and hate messages on social media platforms ahead of religious festivals.

Police in the communally sensitive Dakshina Kannada district have cautioned people not to start or circulate any hate message or rumours that could affect law and order.

"Anyone spreading rumours or hate messages can be charged under IPC Section 505 as we have all the technical capability to find out the origins of such messages," said Mangalore city police commissioner M. Chandra Sekhar.

This section is applied in the event of any statement or rumour with the intent to cause alarm among the public. "We do get several messages that later turn out to be a hoax," the officer said, citing instances of false rumours.

The officer exhorted citizens to alert the police the moment they get any such messages so that it could minimise or even prevent any damage, especially if the content is communally sensitive.

The district authorities have already ramped up police presence to prevent anything untoward in view of the activities of cow vigilantes who recently lynched a BJP worker for transporting calves in neighbouring Udupi district.

A source in the state police department hinted the measure could be replicated across the state, although other districts are not as communally sensitive like Dakshina Kannada.

The district - Mangalore is its administrative headquarters - had been in the thick of communal tension for decades.

Bhushan Gulabrao Borase, superintendent of police in charge of the Dakshina Kannada rural district, that is the rest of the district except Mangalore city, said keeping a watch on social media had become imperative. "Rural people may be using social media less frequently. But even then we need to be careful," he said.

Cow vigilantism by Hindutva groups is a major concern.

He said people could land in trouble for a seemingly harmless message if it causes some serious issue. "It is better not to start such messages. But it's also important not to forward if one receives them," said Borase.

Sunil Abraham, executive director of The Centre for Internet and Society, had a word of caution, although he appreciated the intent behind the police move.

"It's a reasonable approach if they stick to the scope of the law (Section 505). The problem is only if police overstep their limits, like we have seen on several occasions."

But he agreed there was a need to keep an eye on what goes on in social media since many users abuse messaging platforms like WhatsApp.

"What we don't want is a Nazi Germany where the wife is asked to spy on her husband and the son on the father. But we also don't want the opposite when citizens just ignore everything," he said, asserting that it was the duty of civil society to inform the police if they found anything dangerous being circulated.

Extending Aadhaar to more areas is a hare-brained idea, it should be dropped

News reports that the mandatory use of Aadhaar could be extended to a host of new areas are extremely disturbing. According to these reports, the Unique Identification Authority of India (UIDAI) has identified 20 new areas for which Aadhaar can be made mandatory. This includes registration of companies and NGOs, insurance, competitive examinations and property and vehicle registration.

If this happens, then it confirms the worst suspicions of all those who are opposed to Aadhaar – and this spans ideological divides – that it can be used to seriously compromise individual privacy.

The defenders of Aadhaar – mainly the previous and current governments, the UIDAI and Nandan Nilekani, the father of the Aadhaar – have always argued that these concerns are exaggerated. They have pointed out that Aadhaar does not take any details that are not already in the public domain – name, date of birth and permanent address – and that the biometric data is not shared with any of the authorities that seek verification by Aadhaar. That data remains with the UIDAI and it only confirms that a person with a particular Aadhaar number is who he claims he is.

But Aadhaar’s opponents have argued that the extensive use of Aadhaar allows disparate bits of information to be linked and this could become a genuine concern if this hare-brained idea gets official approval.

Now, there is certainly no doubt that Aadhaar is, in the absence of anything better, the best technological tool for establishing identity. It is not entirely fool-proof – there are issues relating to the fingerprints of manual labourers and iris scan of aged people or those with cataract – a solution needs to be found for this. According to this report by the Centre for Internet and Society, there was fingerprint authentication failure in 290 of 790 ration card holders in Andhra Pradesh who did not lift rations, and there was an ID mismatch in 93 instances. These problems notwithstanding, there is no denying that Aadhaar has helped in significantly containing (perhaps not entirely eliminating) the problem of identity theft for diversion of government doles and other benefits.

So making Aadhaar compulsory for such cases is perfectly justifiable. Indeed, the Act giving legal status to Aadhaar is called Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016.

Mandatory quoting of Aadhaar can even be justified in the cases where duplication or falsification of identity can be used by criminals or those who fall foul of the law. Passports, for example, can be brought under the ambit of Aadhaar. Or even driving licences. A person whose licence has been suspended for repeated traffic violations should not be allowed to get another one under the same name or an assumed name.

But why should it be mandatory for bank accounts, if an individual is not interested in getting government doles? The quoting of Aadhaar for property transactions also does not make sense. If the idea is to prevent fraudulent transactions, it will not be foolproof. A person intending to sell an already sold property or one he does not own can do so even with an Aadhaar number, since people are allowed to own more than one piece of property. What will prevent this from happening is compulsory registration and digitisation of records as well as mandatory property titling; there has been little progress on both.

When filing of income tax returns is not possible without a PAN, there is little rationale for making Aadhaar mandatory for filing returns and even for PAN. It is not clear how quoting of Aadhaar is going to help in ensuring that fly-by-night companies and NGOs do not get established.

The insistence of Aadhaar on purchase of vehicles, landline and mobile phone connections and demat accounts is seriously violative of individual privacy and has enormous potential for misuse. The Act does give the government unbridled power to access data in the name of national security. This itself is worrying, since it can allow security agencies to go an random fishing expeditions to access personal financial transactions. Making it mandatory for even buying cars and phone connections (even though it is not illegal to own more than one vehicle or telephone connection) makes it even riskier – private agencies get access to one’s Aadhaar number. Forget security agencies, even unscrupulous private persons can track an individual’s personal activities, especially financial transactions.

As it is, investigating agencies want to tap Aadhaar and biometric data at the drop of a hat. The UIDAI had to approach the Supreme Court in 2014 against a Goa High Court order ordering it to share biometric details of everyone enrolled in the state for solving a gang rape case. Even after the Supreme Court ruled in favour of UIDAI, a Kerala special investigation team wanted it to share biometric details to solve another rape case. If Aadhaar now becomes mandatory for a host of financial and other transactions, the points of potential privacy breaches only increase.

The move to extend the mandatory use of Aadhaar has to be stopped in its tracks. The mandatory use should be limited to delivery of government welfare benefits and doles (after ensuring that glitches are eliminated) and security-related services like passports. For everything else, it should be purely voluntary. There can be no compromise on this.

Accessing pirated content might lead to prison term & Rs 3-lakh fine

The central government is putting the onus of downloading and viewing of copyrighted content from sites it has blocked (with the help of internet service providers) on users.

Visiting torrent (a particular type of files) websites while on Tata Communications’ network recently had users being shown a message that viewing or downloading content on those sites could land them in prison for up to three years and a fine of up to Rs 3 lakh.

“There is not enough room in our prisons to keep these infringers and enough time in our courts to try them. It might sound very exciting as a message to put out but, essentially, they’re trying to scare people into good behaviour,” said Sunil Abraham, executive director at research firm Centre for Internet and Society.

There has been no change to the Copyright Act of 1957 or the Information Technology Act of 2000 for the updated notice being shown to users upon visiting blocked sites. Under these provisions, visiting a site, which is blocked is not illegal, unless it is child pornography.

“Copyright infringement happens all the time and even in developed countries, the rates are very high. Crackdowns on individuals and consumers are never going to solve the problem,” added Abraham.

Experts say the most the government could do is prosecute a couple of people and make examples of them, to dissuade others. This practice is followed globally. There are no examples, though, in India of prosecution for copyright infringement of online content.

The recent alteration of the statement seen by users on Tata networks was done on the directives of the Bombay High Court, after the company appealed that showing individual messages for why each website was blocked was not feasible. The resulting message sparked media frenzy that visitors of blocked websites could now be imprisoned.

Other media reports revealed that the recent blocking of websites by internet service providers was prompted by court orders to prevent piracy of Dishoom, the Bollywood movie.

Globally, there’s been a move to clamp on torrent websites which host pirated content, aided by large information technology entities such as Apple or Facebook. Last month, the US authorities arrested Kickass Torrents’ founder, Arten Vaulin, and blocked all the domains of the website, only to have it resurface a day later.

Tulu gets official Wikipedia page, but Mumbai linguists say more is needed

Sitting in his Sunkadakatte home in Bengaluru, Dr UB Pavanaja still recalls the moment when he was at the WikiConference India 2016 in Chandigarh earlier this month. Academicians from all over India had gathered at the event, to share their views about issues related to India on Wikipedia. While the talks were still in progress, Katherine Maher, executive director, Wikimedia Foun-dation, USA, paused to make an announcement.

“The Tulu Wikipedia page has just gone live,” she boomed into the microphone. “It was a moment of great joy because we were working on this project for the last eight years,” says Pavanaja, programme manager (Indian languages) at the Centre for Internet and Society, Bengaluru, and one of the mentors of Tulu Wikipedia.

UNESCO has listed Tulu as one of the endangered languages, which is at the risk of falling out of use, because it has a few surviving speakers. Pavanaja says the Wikipedia page is a medium for people to access material on Tulu. “Today, it’s the first page that appears on Google, so the accessibility of the language will hopefully increase manifold,” Pavanaja says.

The Mumbai connect

Sukesh Shetty, owner of Hindmata Hotel in Tardeo, who is continuing the tradition of running a restaurant business started by his grandfather, feels his connection with the language is restricted to his interaction at home. “I ensure I speak in Tulu with my children. But, my four-year-old speaks Marathi better than Tulu because we have a Mah-arashtrian maid,” he laughs.

The 46-year-old is part of the Bunta Sangha, an organisation devoted towards rallying the Tulu-speaking Bunt community.

Shetty feels the lack of availability of Tulu literature and movies in Mumbai are responsible for the declining interest in the language. “You don’t get to watch any Tulu films because they are never screened here. We don’t even have a channel that telecasts Tulu movies. But, the Wikipedia page is a step ahead,” he says.

The Tulu Wikipedia page (tcy.wikipedia.org) went live this month. Currently, there are around 200 registered users of the page

Accessing Tulu

Wikipedia is currently available in 22 Indian languages, including, Assamese, Bish-nupriya, Kashmiri, Konkani, Newari, Odia, Pali and Urdu among others. With the inclusion of Tulu, the count has gone up to 23. “There are about 200 registered users (editors) of Tulu Wikipedia. On an average, we have around eight to 10 active editors. Dr Vishwanatha Badikana, a Kannada professor, and engineer Bharatesha Alasandemaj-alu are the highest contributors,” says Dr Pavanaja.

Tulu Wikipedia was in “incubation” since 2008. This term is used to describe similar online encyclopedias, which are still waiting to go “live”. “Tulu is written in the Kannada script, but the language is believed to be 2,000 years old. But, to create a Wiki page, we needed to prove that it’s a classical language and deserves recognition. We had to submit sizeable amount of literature, ancient manuscripts and literary work for the language to qualify,” he says.

Dr Badikana, who works as a History professor at St Alosious College, Mangalore University, says they had to generate awareness about the language through workshops. “Tulu is predominantly an oral language, and hence, people don’t take interest in documenting it. With Kannada being state-recognised, it’s more popular. We had to hold writing workshops in Tulu to motivate people,” he says.

A languishing script

Of late, Tulu — believed to be one of the oldest Dravidian languages — has been generating great interest amongst linguists and academicians alike. The excavation of an ancient manuscript, Tulu Devimahatme, a prose work like the Mahabharata, from the 15th century and two epic poems written in 17th century, namely Sri Bhagavata and Kaveri by language experts in the last few years have revived interest in the language.

However, a major grouse in the community has been its non-inclusion in the Eighth Schedule of the Indian Constitution, which lists the official languages of the country. Presently, it recognises 22 languages with Tulu being the only Dravidian language to have been left out.

Professor Tukaram Poojary, who was instrumental in setting up the Rani Abbakka Tulu Research Centre in Bantwal, Karnataka in 1995, has sent a memorandum to Pranab Mukherjee, President of India for the inclusion of the language in the Eight Schedule.

“Scholars like the nineteenth missionary-linguist Bishop Robert Caldwell have called this language ‘peculiar and very interesting’,” says Poojary. According to him, Tulu is one of the most highly developed languages in the Dravidian family. “But it never received any royal patronisation as was seen with other Dravidian languages such as Telugu, Tamil or Malayalam,” he says.

Shimantur Chandrahas Suvarna, a popular Tulu writer based in Borivli has been diligently writing short stories, poems and novels in the language for the last 40 years. “Although, I write in both Kannada and Tulu, I have been focusing more on the latter, because if we don’t speak and document the language, it will die,” says the 61-year-old, who moved to Mumbai in 1979 after his father set up an Udipi hotel called Hotel Sadanand in Mazgaon.

Suvarna feels the lack of serious literature before the 15th century has hampered Tulu’s claim as one of the legitimate South Indian languages. “In the first half of the 19th century, the German missionaries popularised the language. They produced the Tulu lexicon and a Tulu-English dictionary. But, after the Christian missionaries started printing the Bible and related literature in Kannada, the old script was discarded and the Kannada script was adopted to write Tulu,” he said.

Today, there are no books or literature in the Tulu script and there are only a handful of tuluvas, who can read the script, says Suvarna.

According to him, during the last three years, there has been a surge in literary interest with more than 100 writers contributing articles, poems to a quarterly journal published by the Karnataka Tulu Sahitya Academy Research.

Last year, the University of Mumbai, in collaboration with the Kannada department, and the Rani Abbakka Tulu Research Centre, held a series of lectures on the inclusion of Tulu in the Eighth Schedule. Professor GN Upadhya, head of the department of Kannada at MU, who was part of the series, feels the issue has now become political. “There’s no political willingness on part of the MPs and MLAs to lobby for this language, because it doesn’t constitute a vote bank,” he says.

A language in restoration

Around two million people in the southwest part of Karnataka and the Kasaragod district of Kerala speak Tulu. In Mumbai, about 10 lakh people speak the language. At the beginning of the 20th century, the practice of writing the language in the Tulu script witnessed a decline and was gradually abandoned in favour of the Kannada script. It was only in 2010 that Tulu began to be taught as a subject at the higher primary level schools of coastal Karnataka.

Tulu takes a major Wiki leap, all thanks to a dedicated team

Tulu is one of the five Dravidian languages but it has the least number of speakers. Though it has a script, lack of usage has made it almost obsolete, forcing Tulu writers to write in Kannada. This has, however, benefited Tulu today, allowing it to boast of its own Wikipedia

Anyone who proposes a Wikipedia in a new language knows the labour between the proposal stage and the period it goes live. The long phase usually erodes the enthusiasm and in many cases, the proposal never passes the incubation period. In the case of Tulu Wikipedia, there were a few determined to ensure it saw the light of the day.

Like Vasanth CN, who had rallied for the Wikipedia page since it was first proposed in 2008. A native of Dharmasthala, the language enthusiast detailed how tcy.wikipedia.org came into being. “When it was first proposed in 2008, there were six people behind it,” he recalled. After a while, the Board of Trustees and Language Committee of Wikipedia accepted the proposal.

Then came the incubation period, stretching over eight years, where enthusiasm ebbed and swelled among the parties working for a Tulu Wikipedia page. “If you see the Wikipedia homepage, you see a lot of system messages. Our task was to translate these system messages first. By 2011-12, we had succeeded in generating about 120 articles related to the Tulu language and the region in which it is spoken,” he said.The tricky part was to get the page active. It needed volunteers and they were hard to come by. “For a Wikipedia page to become live, we required at least 600 articles. Moreover, we also required at least five active volunteers who could contribute content or edit existing pages” he said.

It took several workshops at different venues to get the numbers.

Vasanth told Express that the motivation behind the project was to ensure a recognition for the language and to help it evolve. “It is important to have a knowledge base in the local language,” he said. At present, the page has over 780 articles. “If there is encouragement from government agencies such as the Tulu Academy, we can easily increase the content,” he said. He added that further support was required to upload works of ancient and modern Tulu literature, in online avenues such as wikisource.

U B Pavanaja from Centre for Internet and Society, said that efforts picked up in 2014 to make the page live. Commenting on the significance of the language, he said that Tulu had a rich heritage. Several religious books and works of literature had been translated to Tulu during the late 18th century, which included the Bible. In coastal districts, Tulu can be chosen as an optional subject today, he said.

Focus on India—WikiConference produces new apps; state government adopts free licenses

The second WikiConference India, held August 5–7 in the northern Indian city of Chandigarh, drew hundreds of new and experienced members from 20 language communities of various Wikimedia projects from India, Bangladesh, Sri Lanka, and Nepal. This event was more thematic than the first WikiConference India (held in 2011), with numerous presentations, panel discussions and workshops on the gender gap, Wikipedia in education, Mediawiki, and state of the movement in India. The event was organized by the Community of Wikimedians in India, supported by Wikimedia India and the Centre for Internet and Society, and funded by the Wikimedia Foundation. The newly formed user group Punjabi Wikimedians hosted the event. WikiConference India's main goal was to build community and increase participation among Wikimedians in India. Interest in the event was strong: 452 Wikimedians from more than six countries applied for ~100 scholarships. Wikipedia's well known gender gap was evident: only 55 scholarship applicants were women, but a strong focus on diversity resulted in ~25% of scholarship recipients going to women, and the inclusion of speakers of ~20 languages. In all, about 250 people attended the conference. Several Foundation staff spoke at the event, including executive director Katherine Maher, Asaf Bartov, and Tighe Flanagan.

A highlight of the conference was the hackathon track, which spanned all three days of the conference. It proved highly productive, yielding seven apps that are expected to help Wikimedians in a variety of ways. I spoke with Santosh Shingare (Cherishsantosh), the Bangalore-based Wikimedian who organized the hackathon. Santosh had previously served as an organizer of the 2011 WikiConference, and has run hackathons annually since then. Santosh's primary motivation for holding such events is learning; he spoke of limited opportunities to learn about new areas of technology beyond his core skills in WebRTC and Android. He enjoys collaborating with other Wikimedians and sharing technical skills. This event was his first with an international draw, and he looks forward to opportunities to collaborate beyond India's borders in the future.

As Santosh outlined in a message to the Wikimania email list, the hackathon's 35 participants made substantial progress with the following projects:

WikiSpeak with native language (web and Android): Speaking the text of Wikipedia articles
Edit Tamil Wiktionary (Android)
Audio file upload to Wikidata (Android): Assists users in uploading small files that demonstrate the pronunciation of lexical items
A layer that shows local Wikipedia articles on a Google Map
Optical character recognition for Hindi and Malayalam
Communication platform [WebRTC] (Web Application): Santosh wrote this app himself; hackathon participants used it to communicate
Notifications: browser notifications for Wikipedia functions such as recent changes

Santosh highlights that the projects grew out of advance communication. To identify problems and generate ideas, the hackathon organizing team posted a survey ahead of the event. Requests from various language communities, including Hindi, Tamil, Punjabi, and Malayalam, drove several of the projects. The software is all freely licensed, and there are no plans to generate revenue.

Santosh is not a prolific Wikipedia writer or editor, but rather sees value in his ability to communicate among Wikimedians who seek features from various language communities, including his native Marathi and other Indic languages in which he has varying degrees of fluency.

He plans to update the Wikimedia community shortly with further details on each of the seven projects. He is already planning the next of India's annual hackathons. Hackathon organizers worldwide might be interested in learning more about Indian Wikimedians' efforts, and Wikimedians around the world can expect to benefit from their projects.

Indian state of Tamil Nadu adopts Creative Commons license

Last week brought a rare piece of good news in the world's uncertain progress towards the widespread free licensing of information on the Internet. Ravidreams announced on the Wikimedia India mailing list that the government of one of India's largest and most populous states—Tamil Nadu—has issued an instruction to Tamil University and "all other government departments and institutions to release all their publications, archives and collections under Creative Commons by Share-Alike license".

The move comes one year after the collaboration between the Global Tamil Wikimedia Community and the Tamil Virtual Academy, an independent institution set up by the state government in 2001 to provide online resources for Tamil-language communities around the world. TVA and the Tamil-language Wikimedia community collaborated to persuade the government to make the order. Wikimedia India (one of three Creative Commons affiliates in the country) served as an institutional partner, signing the initial agreement on behalf of the Indian Wikimedia community, and funding a Wikimedian in Residence at TVA.

Ravi, who also serves on the TVA committee for outreach, told the Signpost that the TVA is very keen to share its collection of encyclopedic resources with Tamil Wikimedia projects. The community contributed strategic knowledge of free-content licensing, providing precedents for free content release by other governments in India and other countries, and helped in the drafting of the actual order. "But it takes a lot of time, effort, high-profile connections to change how government institutions work", he said.

It's very hard to bring change through a bottom-up approach. These precedents help when someone at the top gets interested in changing things. So, any community that expects to influence public policy should be prepared to do a lot of groundwork.

Tamil-language Wikipedian Thamizhpparithi Maari serves as Assistant Director, TVA and state coordinator of its computing outreach unit, which the government is funding to encourage students in the state to use open-source media and software; this program includes the development of mobile apps and the running of contests to enhance students' computing skills. He described to the Signpost the elaborate process of finally gaining legal and administrative approval for the CC-by-SA release order. Thamizhpparithi has already started a process of digitising books from the universities to share with the Tamil wiki community, involving between 400,000 and 500,000 pages in some 200 books, using Google optical character recognition (OCR).

"This is just the beginning; we expect millions of pages to be uploaded to Tamil Wikisource", Ravi said. Most of the content that will become available for uploading is in Tamil, although some will be in English and other Indian languages; this will present significant opportunities for the Tamil Wikimedia community.

There are about 70 million native speakers of Tamil, and another eight million second-language speakers. It is an official language in Tamil Nadu, Sri Lanka (with which the state shares a maritime border), and Singapore, and is also used in Malaysia and the African island of Mauritius. The language, written in a distinctive curvilinear script, has a rich literature of poetry reaching back thousands of years, and of novels over the past few centuries; this is attested by a related category on the English Wikipedia that is already of impressive size.

New help page takes aim at common newbie obstacle: Many articles carry banners, to flag problems with the articles. New contributors often lack an understanding of how to go about removing the banners, if they address the underlying issues. In recent months, Fuhghettaboutit created a help page to explain the process, and advocated for linking to the page from the templates. The help page now gets several thousand views per day, suggesting that it is filling a significant gap.
Machine-assisted translation of Wikipedia articles, which has increased with the introduction of the Wikimedia Foundation's Content Translation Tool (covered by the Signpost in a June 2015 op-ed, in June 2016, and in various other pieces), has sparked a controversy in recent weeks. Nirmita Narasimhan gets NCPEDP-Mphasis Universal Design Award

The NCPEDP-Mphasis Universal Design Awards were given away in the capital on August 14, 2016. Nirmita got the award in the "Persons with Disabilities" category.

Shri Krishan Pal Gurjar, Hon'ble Minister of State for Social Justice and Empowerment presided over the event, in the presence of Som Mittal, Jury Chair and Chariman, NCPEDP, Dr. Meenu Bhambhani, VP & Head - Corporate Social Responsibility, Mphasis Ltd, and Javed Abidi, Honorary Director NCPEDP, several corporates and winners.

The National Centre for Promotion of Employment for Disabled People (NCPEDP)-Mphasis Universal Design Awards was incepted in 2010. Conservative estimates of the World Bank and World Health Organization suggest that there are about 70-100 million individuals with a disability in India.

One of the biggest challenges faced by people with disabilities is accessibility. Accessibility not only means access to physical spaces but also means access to information, technology, transport, services, aids and appliances, etc.

The awards aim to raise awareness about accessibility. This year, about 60 applications were received from across the country. The awards are the brainchild of Javed Abidi, who is also the global chair for Disabled People's International (DPI).

The 12 award winners were as follows:-

Prem Nawaz Khan Maraikayar of PayPal Inc; Sandeep Sankat, Associate Professor in the Department of Architecture, School of Planning and Architecture, Bhopal; and Sujatha Srinivasan of Rehabilitation Research and Device Development (R2D2) lab in the Department of Mechanical Engineering at IIT Madras bagged the awards.

Category: Persons with disabilities

Danish Mahajan and Divya Sharma of Radio Udaan; Nirmita Narasimhan, policy director with the Centre for Internet and Society; and Sathasivam Kannupayan of www.enabled.in won this award in the in persons with disabilities category.

Shri Krishan Pal Gurjar, Hon'ble Minister of State for Social Justice and Empowerment observed, "Commuting for the handicapped is a challenge in our country. Therefore all modes of transport should work towards this cause. We have to create a code of benefit for persons with disabilities, which ought to be complied with by all government and non-government institutions."

"Through this award, we want to be able to tell organizations in India that accessibility is a huge commercial opportunity as well as a social responsibility. We are delighted with some of the work we have seen this year, but sincerely hope that more and more organizations come into the fold, " said Javed Abidi.

Dr Meenu Bhambhani, VP & Head- Corporate Social Responsibility, Mphasis Ltd said,

" Mphasis started supporting universal design because we didn't want accessibility to just be an afterthought. From the very beginning, be it transport or building or policy or the system, persons with disabilities should be included in the services. However, when the jury sits every year, sometimes it takes us all day to come to a decision. Universal design just needn't be an idea but it needs to be commercialised."

Welcome to the July 2016 newsletter of the Centre for Internet and Society (CIS).

For us at CIS, July was filled with a a wonderful diversity of activities, opportunities, windows, and future gazing. We made a crucial intervention by bringing attention to the misrepresentation of India's position at the UNHRC meeting by global media, and continued our contribution to the drafting of the open data license by Government of India.

We made a submission to the Ministry of Home Affairs to reject the Geospatial Information Regulation Bill, and also appealed to the MPs to re-examine the Regional Comprehensive Economic Partnership (RCEP). We contributed to the making of an open source typeface and input tools for the Santhali language. We were studying developmental initiatives driven by big data in three parts of India (more on that in the August newsletter), mapping the emerging global governance frameworks for big data in development, and planning our future steps in this field. We initiated a study of digital transitions in Indian newspapers with support from the Reuters Institute for the Study of Journalism at University of Oxford, and also produced a series of analysis of industrial policy engagements by NASSCOM and iSPIRT.

We also kept pushing digital and new media research in India through our annual call for essays (abstracts have been accepted), and a brilliant talk on game studies and storytelling by Dr. Souvik Mukherjee. We were busy, and happily so.

CIS sent a letter to Members of Parliament to appeal to re-examine the Regional Comprehensive Economic Partnership, a mega-regional trade agreement currently under negotiation. Japreet Grewal and Pranesh Prakash in an article published by FactorDaily argued that India did not oppose the United Nations move to make Internet access a human right. Submitted comments on the "Government Open Data Use License - India". CIS listed out its comments and recommendations on name of the licence, changing the language on permissible use of data, adding section on the scope of applicability of the licence, etc. CIS published the Report of the Group of Experts on Developments in the Field of Information and Telecommunications in the Context of International Security and Implications for India. The report developed by governmental experts from 20 States addresses existing and emerging threats from uses of ICTs, by States and non-State actors alike. CIS is collaborating with the Reuters Institute for the Study of Journalism at University of Oxford to study various aspects of digital transition in Indian news media. Zeenab Aneez is leading the pilot study exploring digital transition in three newspapers across English, Hindi, and Malayalam markets. Over a series of three blog posts, Pavishka Mittal documented engagements by NASSCOM and iSPIRT in industrial policy making in the Indian IT sector during 2006-2016, including on transfer pricing policy. Deputy US Trade Representative Ambassador Robert Holleyman discussed the Digital 2 Dozen document with Ambassador Shyam Saran. Anubha Sinha participated in the discussions and wrote a summary. Meera Manoj conducted an analysis of the different models of collection, management, sharing, and governance of global development data that are being discussed in several international forums. Shubhangi Heda in a blog entry has explored the concerns related to data protection and digital privacy under the Trans Pacific Partnership agreement signed recently between United States of America and 11 countries located around the Pacific Ocean region, across South America, Australia, and Asia.

As part of our endeavour to make available accessible content for persons with disabilities, we are developing a text-to-speech software in 15 languages with support from the Hans Foundation. Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

Responses to Trai’s consultation paper on free data contain some good suggestions

Trai has announced that it will come up with a final consultation paper on ‘Free Data’, and also a pre-consultation paper on Net Neutrality by the end of this month.

The blog post by Asheeta Regidi was published by FirstPost's Tech 2 on August 15, 2016.

The pre-consultation paper on Free Data (the Consultation Paper), which was issued in May 2016, asked for options where free data could be provided for accessing certain websites or apps without violating the Discriminatory Tariff Regulations issued earlier in February. The objective of the paper is to maximise internet penetration, and make internet available even to the poorest.

The models suggested in the Consultation Paper are a reward of free data for certain internet uses, zero data charges for accessing certain content, and refunding data charges in a manner similar to refund of LPG subsidies. These models are very similar to plans like Facebook’s Free Basics and Airtel Zero, which were banned by the Discriminatory Tariff Regulations.

While it is clear that Trai has no intention of withdrawing the Discriminatory Tariff Regulations, the Consultation Paper does appear to open up the doors to net neutrality violations again. Here’s a look at the comments and counter-comments that have come in response to this paper.

Large TSPs and TSP associations want content-based free data schemes
The response of large TSPs like Vodafone, Idea and so on are quite predictable. They, alongwith most of the TSP associations such as ACTO, COAI and AUSPI, are in support of the idea of free access to certain sites. They, in fact, point out the similarities between the proposed models and the similar models brought out by them, such as Airtel’s One Touch Internet and Reliance’s Facebook Tap. They have also asked for a withdrawal of the Discriminatory Tariff Regulations, on the grounds that they hamper the innovation and forbearance capabilities of the TSPs.

They do, however, take issue with the fact that a TSP agnostic platform, or a platform which is completely independent of the TSPs, is to be given the power to decide how the lower prices or discounts are to be provided. They allege that there is nothing to prevent such a platform from acting as a gatekeeper in itself. They argue that TSPs are in a better position to perform this function, since they are subject to strict regulatory and licensing requirements from Trai.

Smaller TSPs and other companies fear net neutrality violations
Smaller TSPs like Atria, Citicom and MTS are against content based free data proposal, mostly on the grounds that the models suggested violate net neutrality. They point out that allowing content based free data in any form will give an unfair advantage to large TSPs and content providers. Smaller companies and start-ups will be left in the lurch since they will not have the financial capabilities to effectively compete with such schemes. These entities also share the fear of the TSPs that there is nothing to stop a TSP agnostic platform from also acting as a gatekeeper.

Some alternative suggestions for free data schemes which do not violate net neutrality
The approach suggested by Trai will, to a large extent, only benefit existing users of the internet, since a basic internet access of some sort is required before the users can enjoy the benefits of a rewards or a refund. Software Freedom Law Centre (SFLC), in its comments, points to research that found that only 12 percent of the users of zero rating services abroad (no data charges for certain websites), started using it because of the zero rating. Clearly, these schemes are not achieving the objective of increasing internet usage, and an alternative solution is required.

Many of the responses came up with alternative suggestions for free data schemes which can increase internet usage without violating net neutrality. Some of these suggestions are listed below:

The Digital Empowerment Foundation suggests the provision of free data quotas or packs, which would give a limited amount of data free of charge to all consumers. Any data usage above the basic pack will be charged at normal rates. It also suggests making such packs mandatory as a part of the TSP licensing terms or alternatively subsidising the cost of these packs through other benefits to the TSPs.
MTS suggests that content providers be allowed free internet access for a limited time or quantity, such as 30 minutes per day, or 100MB per day, to certain groups, like low income groups.
Mozilla and SFLC suggest the ‘equal rating’ system, where a small amount of data per day is made available free of charge to all internet users, over and above whatever other packs they may have purchased.
The Centre for Internet and Society suggests that the government allow TSPs to provide free internet to all, at a lower speed, and in return exempt the TSPs from the USO contributions in their license fees. This will ensure free data to all without differentiating based on content.
SFLC also suggests an increase in free public Wi-Fi hotspots, like the kind being made available in Indian railway stations, to increase internet accessibility without content-based discrimination.
MTNL suggests that if content-based free data is to be allowed, the government should determine what constitutes the basic services to be allowed for free, such as railway booking services, and not leave this to the understanding of the TSPs.
MTS also suggests that content providers be allowed to give data-based rewards for certain activity, such as watching associated advertisements.
Atria suggests that if free data is to be allowed, first establish a negative list of what cannot be done, such as no throttling of speeds.

First establish ground rules of net neturality
One common aspect of most of the comments to the Consultation Paper was the confusion regarding Trai’s stance on net neutrality. Many entities, including the large TSPs, pointed out the contradiction between this Consultation Paper and the Discriminatory Tariff Regulations.

This paper gives the impression that the Discriminatory Tariff Regulations were issued not to prevent content based discrimination, but to prevent telecom service providers from becoming ‘gatekeepers’. In reality, that is not the main fear of the people, but the fear that net neutrality will be affected. The culprits might be anyone, whether it is the TSP, the content provider or the TSP agnostic platform suggested by Trai. It needs to modify its approach, and first lay down the fundamental rules on net neutrality. Any other regulations must first comply with these rules.

While the motives of Trai are laudible, it is hoped that Trai will look into the several suggestions made that will achieve the dual targets of maximum internet penetration as well as securing net neutrality.

We are conducting research on the changes within the Indian music industry, with a particular focus on the impact of new technologies.

At this time, we are interested in the voices of India-based musicians. Specifically, we are interested in understanding how you earn money as a musician. Using technology to address issues

Can technology help the visually-disabled, who have no access to books and reading resources in their schools?

Currently, they are provided Braille books, most of which do not cover the schooling syllabus or are provided late in an academic year. This forces them to depend on scribes or someone to read out textbooks — something most cannot afford.

It is here that technology can provide some semblance of independence, believes Nirmita Narasimhan, policy director at The Centre for Internet and Society. “Open source screen readers are available in over 10 languages. During the time of publishing of textbooks, all that needs to be done is to prepare a digital copy. Within no time, audio for the blind will be available,” she said, adding that this was one of the demands put for inclusion in the National Education Policy.

Teachers can be trained to use these readers. They can guide students, she said.
