The National Law School of India University, Bangalore is hosting a conference on May 29 and 30 at the Taj Residency in Bangalore.

The Law and Technology Committee (elTek) of the National Law School of India University, Bangalore is hosting ‘Consilience’, a conference, where, as the name suggests, a multi-disciplinary approach is adopted to tackle and discuss a topic of contemporary relevance. Past editions of the conference have brought together luminaries like Mr. Montek Singh Ahluwalia (Deputy Chairman, Planning Commission), Mr. R. Ramraj (MD and CEO, Sify Technologies Ltd.,), Mr. Richard Stallman (Founder – GNU Project), Hon’ble Justice Yatindra Singh (Allahabad High Court, India), Mr. Rahul Matthan (Partner, Trilegal ) and discussed contemporary issues such as “Legal Aspects of Business Process Outsourcing”, “Biotechnology and the Law” and“Free and Open Source Software".

The use of the Internet has proliferated in the past few years, and the positive side is clear to see. However, there is also a huge negative associated with this growth in use of the Internet. With the free dissemination of information, there is also dissemination of illegal and immoral materials. For instance, copyright protected songs and movies are found easily on the internet, sometimes even before they are officially released. The Internet has also made obscene materials like child pornography easily accessible at the click of a button. All of this has a marked negative impact on society and therefore, due to the overriding social interest at stake, the State steps in to regulate and punish the offenders. Internet intermediary liability affects everyone who uses the Internet in numerous ways, both directly and indirectly. Internet intermediary liability could shape the very future of the Internet, yet it surprising how little it has been discussed in India.

Pranesh Prakash was a speaker at this event organized by the National Law School of India University on May 9 and 10, 2015 in Bangalore. The theme for this conference was "Net Neutrality".

For those of you who came in late, Net Neutrality refers to the idea that all data on the internet should be treated equally. What this means is that you shouldn't be charged more for using one website or less for another. The internet is meant to be equal for all to access. To access YouTube one should not have to pay extra, just because Airtel is trying to grow.

However, to maintain this network that we love so much, telecom operators argue they have to spend thousands of crores of rupees on licences and cable infrastructure without getting much return. Therefore they want to be able to charge differently for using different websites. This makes it is a very contentious issue as it involves a tricky balancing of business interests v. freedoms of the digital age. For a little more insight on the topic, see the document attached which explains net neutrality in a very simple manner.

The conference was graced by a host of experts in the field, such as Rajan Mathews (Director-General, Cellular Operators Association of India), T.V. Ramachandran (Resident Director, Regulatory Affairs and Govt. Relations, Vodafone Essar Ltd.), the Policy Director for Centre for Internet and Society, Mr. Pranesh Prakash, and the general counsel of CISCO India, Mr. Joginder Yadav. Students and experts alike gave differing opinions and facilitated a great debate.

Gurshabad Grover attended Connections 2018, a pre-IETF event organised by the India Internet Engineering Society (IIESoc) in Bangalore on October 31 and November 1, 2018.

IIESoC organized the event with an objective to:

Discuss the interests and issues important to the network deployment, operation and design of networks in India as they impact IETF standards.

Educate and prepare new members for IETF involvement. Facilitate member involvement in IETF areas.

Provide information, guidance and direction to assist Indian community in involvement in the IETF.

Work from different IETF working groups was discussed in four tracks: IoT Standardisation, SDN and Network Operations, IPv6, and Deployments.

Specific Issues of Discussions & Description

Connecting the next two billion users on the Internet poses unique challenges that must be addressed. The next two billion users will have very different profiles as compared to the first billion in terms of factors such as geography, demography, gender, disability, technology access, language access, and connectivity devices. In addition, with the coming of the Internet of Things, the users of the Internet may also include devices, sensors and sensor networks. Further, the context of the Internet itself may be changing, particularly in relation to efforts by various State and non-State actors to restrict freedom of access to the Internet and freedom of expression on it.Free & Open Source Software (FOSS) has now assumed greater significance in the light of revelations related to arbitrary surveillance conducted by states. This issue highlights the need to use audited technology and infrastructure to prevent the wanton violation of privacy of citizens. FOSS can be used to build shared community infrastructure that will protect users from privacy abuses. As most of the online applications run on top of free software, there is also a need for greater collaboration between the industry and free software community to ensure security and robustness of software to prevent incidents like the heartbleed bug vulnerabilities. As the next two billion comes online, FOSS assumes great significance for building a safe and secure Internet and robust communication platforms.The panel will discuss the following issues:• Relevance of FOSS as an access enabler and source of robust, cost-effective andfreedom-preserving software• The importance of FOSS in preventing arbitrary surveillance• Co-operation among businesses and free software community to develop secure.

This is a prototype for an interface, which allows talking to plants remotely via the internet. Whether you want to have something to do with the ‘community industry’ or not, it has something to do with you. Through its burgeoning expansion, our forms of relating, caring, communicating and collaborating, are being transformed, enclosed, templated and put to work. The most affective components of network culture are rapidly being engineered into ‘product’. Just as virtual space is augmented, real space becomes ever more virtualised, securitised and impoverished. The rise of the network-assembled community has coincided with a radical disinvestment of national and municipal communities in the age of austerity. As services are withdrawn, the ‘community’ itself is enjoined to step into the breach. ‘Community’, in the era of networked neoliberalism, has become both a target of governance as well as of business.
Beyond the commercial drive which is ‘connecting people apart’, communities of difference are also flourishing in the post-internet age. Reimagining community is not just the preserve of belligerent nationalisms and Web 2.0 but also a long-standing activity of alternative, artistic and political cultures’ responses to commercialisation and industrialisation, from the 17th century puritans and diggers, the artist communes of the 19th century, through to the political squatter scenes of post-68 generation, the hacklabs of the past years and new movements such as Anonymous. The Community Complex will ask how normative forms of sociality and identification are not only produced but also challenged in today’s mashup of the virtual and real, free and waged labour, computational and affectual, real-time and bio-time, as well as minor and molar imaginings of connection. To achieve this we bring together different perspectives and experiences of critically engaging with the new realities of mediatised ‘community’ and its reimagination.

Conflict of interest cloud over CCI chief

The chairperson of the Competition Commission of India (CCI) and three of the six commission members are participating in a conference organised by Assocham and sponsored by private companies like Ericsson, trade associations and two legal firms specialising in intellectual property cases. This, civil society organisations argue, raises issues of conflict of interest in a quasi-judicial body like CCI participating in a conference organised by private parties that have cases before the commission.

The article by Rema Nagarajan was published in the Times of India on August 7, 2015.

For instance, the event partner Ericsson is facing CCI investigations on matters related to standard essential patents (SEPs), one of the conference topics, and issues related to licensing of technologies on fair and equitable terms.

The vice president and head of the legal section of Ericsson also has a speaking slot in the inaugural event. The brochure clearly states that the event partner on payment of Rs 5 lakh gets several privileges including a speaker's slot in the inaugural and business sections.

Several civil society organisations including Alternative Law Forum, Centre for Internet and Society and IT for Change from Bangalore, Knowledge Commons Collective, National Working Group on Patent Laws, and Software Freedom Law Centre from Delhi have written to the CCI protesting against its participation in the conference.

In their letter to CCI chairperson Ashok Chawla, they pointed out that the day-long conference titled Interface between Intellectual property (IP) and Competition Law, being held in a five star hotel on August 7, was focusing on issues being adjudicated by CCI. While Chawla is listed in the brochure as giving the inaugural address, CCI members GP Mittal and MS Sahoo are chairing two technical sessions and a third member SL Bunker is giving a special address at the valedictory function.

Other speakers include Rajiv Aggarwal, Controller General of Patents, Designs and Trademarks, representatives of Google, Intel, Microsoft, the UK IP Office, senior advocates from three Indian law firms specialising in IP and representatives of international law firms and consultancy firms.

"It is a well-set precedent that judicial and quasi-judicial bodies never directly or indirectly discuss matters pending before them. The conference is centred on discussing issues that are currently under the investigation of CCI along with commercial entities, including one which is facing the investigation," stated the letter adding that all the judicial or quasi-judicial bodies were expected to avoid not only actual conflict of interest but also perceived conflict of interest.

The civil society signatories pointed out that the event was not an academic event but a commercial one organised by a chamber of commerce along with the industry with clear commercial objectives. "The participation of CCI in the event would compromise the credibility and independence of CCI. Therefore, CCI as a guardian of public interest should not be subject to the lobbying efforts of IP owners. Providing privileged access to lobbying efforts of private enterprises like Ericsson, Qualcomm, Microsoft and Intel would cast a dark shadow on the neutrality of CCI," stated the letter requesting Chawla not to participate in the conference and to direct CCI members and CCI staff involved in investigations to avoid participation.

Conference: Internet at Liberty 2010

This conference is being held in Budapest from 20 to 22 September 2010. It is co-sponsored by Google and Central European University. Sunil Abraham and Anja Kovacs are attending the conference.

The conference Internet at Liberty 2010 will explore creative ways to address the boundaries of online free expression, the complex relationship among technology, economic growth and human rights, ways in which dissidents and governments are using the Internet, the role of Internet intermediaries, and pressing policy and legal issues such as privacy and cybersecurity. The event will bring together grassroots global activists alongside representatives of NGOs, academic centers, governments and corporations. The Centre for Media and Communication Studies is playing a core role in the organisation of the event.

Conference Report: 'Privacy Matters' Bangalore

On February 5th the 'Privacy Matters" conference was held at the TERI Regional Center in Bangalore. The event was a full day and centered around issues of privacy including: privacy rights of minorities, privacy and open government data, and privacy and identity.

Conference Summary

On the 5th of February, civil society, lawyers, students, NGO’s, and representatives from the IT companies gathered together at the TERI Southern Regional Center to take part in 'Privacy Matters' - a public conference held to discuss privacy issues in India, and the privacy legislation that has been proposed in the parliament. The conference was opened by Prashant Iyengar, head researcher at Privacy India. Mr. Iyengar explained the mandate of Privacy India, which is to raise awareness of privacy, spark civil action, and promote democratic dialogue around privacy challenges and violations in India.

Keynote: Ashish Rajadhyakksha, Senior fellow, Centre for the Study of Culture & Society

Mr. Rajadhyaksha delivered the keynote speech. In his presentation he focused on privacy in relation to the changing nature of the individual. He pointed out how humans are now becoming technologically enhanced individuals - in essence cybernetic organisms. These technological enhancements can be both positive and negative, but in both cases come with multiple and complicated questions of privacy, because the technological enhancements facilitate everyday life but at the same time create possible privacy violations. He further raised the point that people are not aware of these privacy implications, and thus violations of privacy are not seen as coercive acts, and people do not see their liberty as being placed at risk or challenged.

Privacy and Minorities: Session I of the conference focused on the privacy rights of minorities and privacy and open government data

Zainab Bawa, CIS RAW fellow spoke on Privacy and Open Government Data. Her presentation, titled Property Rights, Privacy, and Open Government Data looked at how data by governmental agencies is handled. Her research is specifically on land records and the government. In her work she looks at:

How data bases are designed

How documents are translated into English
How hard copy documents are digitized

How information is posted

What are the privacy implications for all these processes

Shubha Chacko from Sangama spoke on the issues of sex workers and questions of privacy. Ms. Chacko opened her presentation by pointing out that there is a common conception that sex workers have no rights to privacy. She then talked about the precarious position sex workers find themselves in, because the law and society find it offensive that a sex worker brings into the public sphere what society believes is to happen in the private. Ms.Chacko also spoke on the invasive techniques that sex workers are subjected to such as HIV intervention and open disclosure of health records, and how these invasive techniques take away the privacy of sex workers. Furthermore, the nature of sex workers work means that they are not privy to the same right of anonymity that many believe is an important principle of privacy. Ms. Chacko closed her presentation by pointing out that the UID might actually bring privacy to sex workers. Closing the panel, Sahana Basavapatna spoke on refugees, the UID, and privacy. Ms. Basavapatna spoke about the difficult situation that refugees are placed in as they have no identity in India, but are also easily identified.

How can a privacy legislation be framed and implemented in order to not perpetuate existing societal stigmas?

Identity and Privacy: Session III of the conference focused on identity and privacy

Hamish Fraser (Partner at Truman Hoyle, Sydney, Australia) spoke on the Australia Identity card, and how, among other reasons, it was privacy concerns that squashed the identity card in Australia. Furthermore, out of the attempt to make an Australian Identity Card, the Privacy Act of 1995 was passed. Currently in Australia individuals do not have identity cards, but instead they have numbers for different services – such as a tax number, a health number, and a driver license number. These numbers are not unique, and one number for a certain service cannot be used for another service, thus the government cannot track an individual by their number. Mr. Hamish also touched on the ten principles of privacy that the Australian legislation adopts, and pointed out that though the legislation does not have strong teeth, in Australia there is a strong culture of privacy that makes the law enforceable. Michael Whitener (Principal and co-founder of VistaLaw International LLC) spoke next. His presentation titled “Science Fiction Becomes Reality, but at What Cost” focused on the privacy aspects of biometrics and changing technology.

Raman Chima, Privacy analyst for Google, was the final speaker on the panel. Mr. Chima worked to expose myths that people hold about why Google collects information, and how they use that information. For instance Google gathers limited information to develop valuable products and services, and to develop innovative products that reflect strong privacy standards. Mr. Chima also pointed out that though online tracking can have negative implications, it also has many positive implications - such as allowing spam to be stopped and tracking disease in areas. He concluded his presentation by urging citizens to become more informed, and ask for more rights. He also pointed out that privacy has yet to be spelled out and presented in a way that any person can comprehend, understand, respect, and follows

Privacy and Social networking Session IV of the conference focused on privacy and social networking

Ujjvala Ballal from Inclusive Planet , a social networking site for the disabled, focused her presentation on the privacy rights of the disabled. She raised the point that disabled people have been struggling for equal access rights for many years. In the process they have lost much of the privacy that they have a right to. She went on to explain that there are many privacy issues that are unique to a disabled persons. Some of which include: the disclosure of their disability, the stigma that comes along with their disability, and the denial of services based on their disability.

Gagan K. (NLSIU Law Student) spoke on Privacy Issues in Social Networking Websites. Gagan pointed out that on social networking sites privacy issues include:

Should information pertaining to the disabled be held to higher standards of privacy, because of its sensitive nature?

How can a privacy legislation be drafted, so it is accessible to the disabled?

Could a privacy legislation construct regulations on the handling of data, in order to prevent profiling and discrimination?

Conclusion: the concluding session was a time for discussion and opinion sharing
