C-DoT's surveillance system making enemies on internet

Reporters Without Boundaries says it gives unbridled power to law- enforcement agencies to snoop on citizens.

The Central Monitoring System (CMS) developed by the Centre for Development of Telematics (C-DoT) has come under fire from a France based non-profit organisation, which claims the system has the capacity to directly snoop on all forms of communications over phone and internet, without involving telecom operators.

The NGO's Reporters Without Boundaries report 2014, 'Enemies Of The Internet' has equated C-DoT with Government Communications Headquarters (GCHQ) in the UK, and the US's National Security Agency (NSA), which recently came under criticism for spying on citizens.

CMS, India's mass electronic surveillance system, was rolled out in 2013.

Before the CMS, tapping was done by the telecom operators, but not before taking prior permission. The CMS gives direct access to C-DoT employees and law-enforcement agencies.

CMS has created an automated front containing central and regional databases, which central and state government agencies can use to intercept and monitor any landline, mobile or internet connection in India.

Minister of state for information technology Milind Deora said, "The new data collection system will actually improve citizens' privacy because telecommunications companies would no longer be directly involved in the surveillance."

Asked what would prevent C-DoT employees, who would have access to data, from misusing it, Deora said, "There is a switching mechanism (that) diverts the call to law-enforcement agencies and eliminates layers. The existing surveillance and interception system is actually insecure as the operator, people from the home ministry and other government officials have access to the data. The CMS will erase such people from play."

"I want the people to know the design aspects and how the system is being used for lawful interceptions, so that they can shed their inhibitions We do not want to put power in the hands of the bureaucrats" he said.

Harold Dcosta, a cyber security expert who trains Maharashtra and Goa police, said, "It's possible that employees of CDoT/law enforcement agencies could use the information gathered by CMS for personal or political use although 43 and 43 A of the IT Act would protect people when something like that happens and will give the person compensation.

He said, "There should be more transparency with regard to CMS".

Sunil Abraham, executive director of Bangalore-based non-profit Centre for Internet and Society said the mistaken assumption in their thinking is technology will serve as a check and balance.

"Technology can always be compromised," he said. There is no way to find out about what is actually going on. If the CMS is abused it is very difficult to prove."

Deora said a privacy law is being drafted to address these issues. Last month, a parliamentary standing committee rejected the government claim that IT Act protects citizens' privacy. The committee, chaired by former Congress MP Rao Inderjit Singh, said, "The committee is extremely unhappy to note that the government is yet to institute a legal framework on privacy."

Burma to host first Internet freedom forum

Myanmar ICT Development Organisation (MIDO) will host “Myanmar Internet Freedom Forum” in Yangon from June 1-2. In the first forum of its kind in Burma, MIDO aims to raise awareness of Internet freedom in a country that has endured decades of media censorship.

In a country with a notoriously low Internet penetration rate, MIDO has been conducting Internet and communications technology (ICT) training in cities and remote areas “to empower citizens using ICT to address core development and poverty-reduction goals.” It is involved in BarCamps and government organized forums as well.

“As our organisation focuses on ICT4D and Internet Policy, Internet freedom is also a vital issue that we look on,” said Htaike Htaike Aung, Program Manager of MIDO.

The major goal of the Myanmar Internet Freedom Forum is to advocate for Internet freedom in Burma (Myanmar). “As the media and policy makers do not have awareness on Internet Governance Forum and its agenda, the issues have not been addressed and lack media attention,” said MIDO in its proposal submission. “Not having local resources on Internet Governance is also a cause for the lack of advocacy groups and campaigns.”

MIDO also aims to promote “access” and “digital rights” with a multi-stakeholderism approach involving government, journalists, bloggers, social media activists, netizens and international experts so that all voices are allowed and heard. Various topics such as Cyber Law, Digital Security, E-education and Netizen Empowerment will be discussed during panel discussions and breakout sessions at the event.

MIDO expects 300 attendees for Day 1 of the forum, when the Center for Internet and Society, the Thai Netizen Network and other regional groups will be joining local netizens and organisations for discussion. “For the government representatives, we’re still trying to get confirmation,” explained Htaike Htaike.

MIDO will invite about 20 netizens from around the country to join interested participants from Yangon to discuss how to effectively monitor Internet freedom on the second day of the forum. The aim is to establish a network to monitor and report on Internet censorship in Burma. MIDO hopes to publish Internet Censorship Index each year with help of the reports generated from the network.

With a 7% of Internet penetration rate, this is a problematic area in Burma, though there has been some progress and Internet business opportunities have begun to emerge. The Internet Freedom Forum, as an all-inclusive platform, has potential to bring necessary knowledge to the public, such as awareness of rights when accessing Internet and other privacy issues which are vital for new netizens.

Bumpy road ahead for RFID Tags in vehicles

The government plans to make digital tags in vehicles mandatory to ensure seamless passage at the toll booths, but the implementation of the proposed move may not be so smooth.

On one hand, the digital tags stand to compromise the safety of the vehicle and the owners, while on the other, majority of automobiles manufacturing companies claim that the vehicles are being equipped with the digital tags since 2013 and it is the implementation of the order that has been grossly ineffective.

Post the recent demonetisation, as a part of the government’s efforts towards a cashless society, Economic Affairs Secretary Shaktikanta Das stated that the union government has advised the automobile manufacturers to provide a digital identity tag in all new vehicles, including cars, to enable electronic payment at all toll plazas and ensure seamless movement at check posts.

He said the provision of Electronics Product Code Global Incorporated (EPCG)-compliant Radio Frequency Identification (RFID) facility in all new vehicles will ensure payment of toll digitally and also avoid the waiting time, and the vehicles will move seamlessly without having to wait at check posts. “This will improve the functioning of toll plaza, digital payments,” Das said.

In fact, the move to mandate all the vehicles with RFID tags was first made in 2013 when the then government made it compulsory to install Radio Frequency Identification (RFID) tags on the medium and heavy motor vehicles through the proposed rule 138A of the Central Motor Vehicle Rules, 1989. However, the same could not be fully implemented for several reasons and was also opposed by public and advocacy groups alike.

In 2013, the Centre for Internet and Society (CIS), a non-profit organisation sent an open letter to the Society of Indian Automobile Manufacturers (SIAM) to urge them not to install RFID tags in vehicles in India as the legality; necessity and utility of RFID tags had not been adequately proven.

The letter stated that such technologies raise major ethical concerns, since India lacks privacy legislation, which could safeguard individual’s data. The letter added that the proposed rule 138A of the Central Motor Vehicle Rules, 1989, mandates that RFID tags are installed in all light motor vehicles in India.

However, section 110 of the Motor Vehicles Act (MV Act), 1988, does not bestow on the Central Government a specific empowerment to create rules in respect to RFID tags. Thus, the legality of the proposed rule 138A is questioned, and we urge you to not proceed with an illegal installation of RFID tags in vehicles until the Supreme Court has clarified this issue.

Speaking to The Statesman, Pranesh Prakash, Policy Director, Centre for Internet and Society said, “Our stand remains the same as it was three years ago when we spoke out against this move: mandating RFID tags in all vehicles is a terrible idea, and a privacy and security nightmare. “It is important to ensure that RFID tagging (and other similar technologies, like automated licence plate readers) do not end up as a means of engaging in mass surveillance and tracking, which would be contrary to the judgments of the Supreme Court in cases like Kharak Singh vs the Union Government.

“The government has not provided any safeguards — such as mandating non-storage of any vehicle-identifying data. The government has asked manufacturers of all vehicles to include trackers, not just for goods vehicles or mass transport vehicles.

“Nor has the government come up with any standards to ensure security of the RFID tags — to prevent unauthorized third parties from tracking you or deducting money from your account. In short, the government should immediately retract its advice to vehicle manufacturers, and should work with experts to fix these problems,” Prakash said.

Building Knowledge and Capacity around Telecommunication Policy in India

Ford Foundation has given a grant of USD 200,000 to the Centre for Internet & Society (CIS) over a period of two years (2011-2013) to build expertise in the area of telecommunications in India.

The project involves the following key activities:

Knowledge repository: Creating a repository comprising information about telecommunications related issues and policies and online course materials designed for a multi-stakeholder audience.
Capacity building: organising interactive public lectures and workshops around the country to disseminate information on telecom issues.
Dissemination: using traditional and new forms of media to disseminate information to academia, civil society, policy makers and the general public.

Background

Access to telecommunications facilities and services is a key enabler of socio-economic development of countries in the Information Society. The rapid proliferation of internet and mobile phones as a medium of administration and governance, commerce, education, social networking and communication, has made the development of telecommunications infrastructure and policies a high priority for governments worldwide.

India’s telecommunications sector has been growing at a phenomenal rate of 45 per cent over the past few years and according to Telecommunications Regulatory Authority of India (TRAI), has become the world’s third largest network[1] with a tele-density of 65 per cent, 785 million telephone connections (750 million mobile and 35 million fixed landline connections), and 10 million broadband subscribers as of December 2010. The growth of mobile phones has surpassed fixed line networks, making the mobile the primary means of communication.

However, despite the rapid growth and expansion of telecommunications infrastructure in India, there still remains an underserved need for access and availability of services and facilities to persons living in rural and remote areas, poor persons, disabled, illiterate and elderly persons. The rural tele density remains low at 30 per cent and the number of broadband connections is also comparatively quite low. In addition to this, there is also an overall lack of public awareness about legislative and regulatory issues, market trends, international debates and research in this area, which is essential to ensuring that regulatory and market developments promote consumer choice and interests. The imperative to educate and build capacity is one which needs to be addressed both within India and globally.

Problem Statement

The rapid growth in telecommunications infrastructure and services in India over the past decade has not been complemented by correspondingly desirable levels of public awareness and participation. The lacuna in awareness about regulation, international trends and research among stakeholders has given way to minimal representation of public and consumer groups in the policy formulation and regulation process.

There are very few courses on telecommunications which are offered online and in Indian universities and institutions. These deal primarily with technical aspects of telecommunications and do not adequately touch upon other important elements such as regulations and policies or international best practices.[2]

There is a dire need for a dedicated resource focusing on informing and training people on a wide range of issues in the telecommunications sector, as well as bringing transparency to current national developments in policy and project implementation. Such a resource is important to ensure that public interest is protected and critical national resources are deployed in an efficient, just and transparent manner. Similar initiatives such as the Link Centre offer limited support to persons living in India since they do not focus on India.

Project Description

CIS proposes to build awareness and capacity on telecom issues for a multi-stakeholder audience comprising researchers and academicians, policy makers and regulators, consumer and civil society organisations, education and library institutions and lay persons through the creation of a dedicated web based resource focusing on knowledge dissemination. This resource will comprise a repository containing articles and sample course modules on telecommunications issues and policies It will be built on an open platform and all content will be openly licensed under a creative commons license which will be made available free of charge to the users. The content will be on par with international standards and will undergo constant review and updates to keep abreast of current trends and debates. The Moodle learning management system will be used to manage the content.

Project Goals and Activities

The goals and activities of this project are given below:

Knowledge Repository

Goal: To create an on line repository of telecommunications related information and learning materials targeted at a multi stakeholder audience.
Activities:

Create and maintain open educational resources[3] on telecommunications that facilitates self directed and collaborative learning in a Multi user environment.
Provide information in a variety of audio, video, text and alternate accessible formats on telecommunications related topics,
Provide a single source for all information and documentation related to policy environment for telecommunications in India

Capacity Building

Goal: To raise levels of expertise and provide a set of comprehensive skills to interested students, bureaucrats, media personnel and members of civil society, so that they can understand, engage with and influence the development of telecommunications in India.

Activities:

Organise 6 workshops over two years in different locations to test the open education resources and solicit feedback. These will be conducted by the CIS project team and some external resource persons.
Organise 10 public talks by subject experts at the CIS office in Bangalore and different venues around India, which will be podcast live from the CIS web site. These may be more topical and relevant to current developments.

Dissemination

Goal:

To ensure the mainstreaming and sustainability of the learning materials created by CIS by partnering with academia;
To make the telecom policy process in India more scrutable to civil society and politicians; and
To create awareness amongst the Indian Diaspora and Internet users in India.

Activities:

To work with academia to develop teaching modules from the content available in the repository. These modules could be in the form of text or video lectures, podcasts, etc.
To disseminate content in the form of easy to read FAQs, posters, Primers, cheat sheets, DVDs, audio visual materials and other accessible formats to civil society organisations and policy makers.
To execute a comprehensive social media strategy for disseminating information and increasing public engagement. These could include:

Using social networking platforms like Twitter, Facebook, Orkut, My Space etc to infiltrate existing on line communities using carefully crafted tit bits from the repository to increase traffic.
Using You Tube, Blip TV etc for video uploads, web casts and podcasts.
Engaging with existing on line communities by contributing to ongoing and new discussions on mailing lists and blogs.
Building on a regular basis a data base of opinion and thought leaders on line and off line using a constituent relationship management software and using mass personalised e mail to encourage them to popularise our content repository through their communication channels.

Overall project activities:
Identify other senior experts and consultants for the project
Set up server infrastructure and the Moodle Learning Management System and training the project team to use it.
Organise six workshops and 10 public talks with live podcasts over two years to disseminate information on these topics.

Plan and Measurable Progress Indicators

For the purpose of measuring progress, the project can be divided into four phases of six months duration. The total number of learning materials to be created is 230 over two years. These are divided into 150 text lessons (Primers, FAQs, cheat sheets and posters) and 72 videos. The target for each phase will be to create approx 37 texts and 18 videos. Based on that, the project deliverables are as follows:

Phase I

Activities:

Hiring the core team, consultants and technology person to set up and manage the system.
Setting up the Moodle Learning Management System and training the team in using it. Mapping out topics for content generation and allocating work.

Milestones:

Complete the hiring of all project personnel.
Complete the Moodle Learning Management system set up and training.
Completion of 37 text lessons and 18 videos.

4. Organised one workshop and two public lectures to get feedback on the completed modules.
5. Awareness raising and inviting comments on completed modules through social media and mailing lists.

Phase II

Activities:

All relevant policies, legislations, rules and important case law will be mirrored on the web site
Another 38 text lessons and 18 videos will be added to the repository.
The next 2 Workshops and 3 public lectures will be conducted to get feedback on the learning materials and build awareness.
Awareness building, call for comments and community engagement activities will continue through social media, mailing lists and the CIS news letter

Milestones:

Half of the course content (75 text lessons and 36 videos) created and available on site.
Policy and regulatory information available on site.
Engagement with communities on social networking platforms, mailing lists and blogs continues.
A total of 3 Workshops and 5 public lectures conducted.
Engagement with academia for creating course content begins.

Phase III

Activities:

Content generation, capacity building and dissemination activities continue.

Milestones:

75 per cent of the content (112 text lessons and 54 videos) will be up on the web site.
4 workshops and 8 public lectures conducted.
Social media outreach continues with regular traffic on the web site.
Engagement with academia to create course modules continues.

Phase IV

Activities:

All the course modules will be completed and events conducted. A lot of effort will be taken for Dissemination and outreach.

Milestones:

All the content (150 text lessons and 72 videos) will be up on the web site.
All relevant policies, rules and legislations will be on line.
Data bases of course participants, media and other persons who were part of the course outreach will be prepared.
All six workshops and ten public lectures conducted.

CIS interest in the project:

CIS is committed to ensuring public access and participation in the information society through the internet. We work towards creating a policy environment which promotes consumer interests by facilitating unhindered access to web sites, digital content and technologies and fosters creation of networks for sharing knowledge and culture.

Since our engagement with telecommunications issues has been at a very nascent level, we would like to build expertise in this area through this project.

Policy

Regularly provide feedback and comments to proposals and notifications which are issued by the Department of Telecommunications and TRAI,[4] especially with respect to spectrum allocation.
We recently sent some notes to the Government of India in December 2010/January 2011: facts, assessments and suggestions and in February, we expect to meet with a Member, Planning Commission (Arun Maira) to advocate coordinated scenario.
We have initiated the Universal Service Obligation Fund of India to fund several projects for persons with disabilities. To that end, we created a framework document which is available on the USOF website.[5] these projects may come to approximately 1 million dollars.
Providing recommendations on accessibility in telecommunications for persons with disabilities and elderly persons to be included in the New Telecom Policy which is to come out in March 2011.

The International Telecommunications Union

We were contracted by the ITU to prepare a paper on Mobile best practices for Persons with Disabilities in December 2010. The report is complete and we are awaiting feedback from the ITU for finalisation
Edited and published a print version of the handbook on e-accessibility for persons with disabilities, which was sent to over 200 regulators and Ministries of ICT around the world.
Co-organised an event on Enabling Access to Education for Persons with Disabilities (Edict 2010) with ITU and other UN agencies, the Department of IT and civil society organisations in October 2010.
Presently working on a global paper with the co-operation of ITU and G3ict which will look at how the Universal Service Funds of countries are being utilised to fund projects to promote access for the disabled.

Academic Interventions

Organised a lecture tour for telecom expert Sagie Chetti in collaboration with the Link Centre in 2009 to share information in various universities and institutions around the country on the landscape of the telecommunications sector in South Africa. Presentations were held at the Indian Institute of Technology (IIT), Chennai and IIT, Mumbai, the International Institute of Information Technology (IIIT), Bangalore, Indira Gandhi National Open University (IGNOU), National Institute of Science, Technology and Development Studies (NISTADS) and Jamia Millia Islamia University – all based in Delhi. The visit concluded with meetings with officials from the Telecoms Regulatory Authority of India (TRAI).

Broadband user base still has a long way to go

Internet users in India have crossed the 100-million mark, still distant from China’s nearly 500 million and the 250 million or so in the US, but experts are buoyant about prospects in cyberspace even as low broadband penetration and poor online payment and distribution channels persist as hurdles.

Abhishek Goenka, partner, BMR Advisors, who leads the firm’s real estate and information technology practice, agreed.
"While the over 100 million users comprise less than 10% of India’s population, it is 20-30% of the urban population, which is an exciting enough number," he said.

India and China are strengthening their position in the global Internet ecosystem rapidly, a May 2011 McKinsey report had noted.

"Both countries show growth rates of over 20%," said the report, even as it pegged the total (estimated) worldwide contribution of the Internet at $1.67 trillion (2.9% of total gross domestic product).

It added that public expenditure on the Internet—including spending for consumption and investment by the government on software, hardware, services and telecoms—ranged widely from 5% of the total GDP contribution in India to more than 20% in the UK, the US, Brazil and Russia.

Despite the optimism in the industry, there is a consensus that unless broadband numbers and speeds increase, meaningful commerce on the Internet will not happen in India.

Broadband subscriber figures stood at a mere 12.69 million in August, according to the Telecom Regulatory Authority of India (Trai). In contrast, China had around 364 million broadband users (98.1% penetration) in 2010, according to InternetWorldStats.

This has a bearing on growth—a 2009 World Bank report suggested that GDP expansion in developing countries gets a boost of 1.38 percentage points for every 10 percentage point increase in broadband penetration.

An October 2011 report by Ericsson, Arthur D Little and Chalmers University of Technology in 33 Organisation of Economic Cooperation and Development (OECD) countries, confirmed that doubling the broadband speed increases GDP by 0.3% which, in the OECD region, is equivalent to $126 billion. The study also revealed that further doubling speed can yield growth in excess of 0.3%.

Kartik Hosanagar, an associate professor at Wharton School of the University of Pennsylvania, and co-founder of Yodle Inc., agreed that the definition of broadband in India (256 kbps and above) should be upgraded to international standards (1 Mbps and above) while adding that the 100 million mark "is a very important number, since it provides a big enough market for large firms wanting to play in it".

Sunil Abraham, executive director at the Centre For Internet and Society said the broadband volume was small and that India was not a big market like China.

He rued that the government had not done enough to facilitate broadband adoption, the way it did for mobile phones. There were around 866 million wireless connections till this August and 70% of them were active, according to Trai.

Shree Parthasarathy, senior director, Enterprise Risk Services, Deloitte India, listed weaknesses in the 100 million-plus Internet user base, with most people still using it to check email and social sites.

In the 30 urban cities where the survey was conducted, 89% use it to access email, 71% for social networking, 64% to search education-related content, 55% for chat and 49% to access video, music and images, according to the latest IAMAI report.

Online transactions are not a significant part of this as yet. "It will increase in years to come, particularly when people begin to see more value in e-stores than brick and mortar stores," Parthasarathy said.

Murthy of Pinstorm offered a different perspective—the reach of the Internet now rivals television, he said. "To reach an upscale audience in India, the Internet is now the only mass medium—TV is a niche medium here. This is a reversal of traditional roles."

Goenka of BMR Advisors, however, said the comparison of Internet penetration with the reach of TV sets was unfair and that the two markets were very different. "TV units are also found in semi-urban and rural areas, whereas the 100 million Internet (users) are indicative of the spending powers of these users. It is a good indication for e-commerce companies."

Analysts like Goenka of BMR Advisors and Raghav Anand, associate director, Ernst and Young India, contended that smartphones and 3G networks would accelerate the growth of the user base.

“The 120 million Internet user base indicates that the run rate is good, and it could be 200 to 250 million in two to three years,” Anand said. “The numbers are significant and anyone looking at investing or scaling up should do it now. The growth rates are making Internet play very interesting.”

Since 75% of the users are young, adult males, “it is a very attractive segment for advertisers also”, he said. Of the 250 million Internet users in three years that he predicts, “120-130 million would be through phones.
